ORDINANCE NO.
4 An Ordinance pursuant to Section 20-5.7 providing for a Map Amendment to the City of South
5 Miami Official Zoning Map from Specialty Retail (SR) to Downtown SoMi (OS) on a 9.G8-acre
6 property known as The Shops at Sunset Place and as legally described herein.

8 WHEREAS, FRIT Shops at Sunset Place Fee Owner LLC has requested an amendment to the Official
9 Zoning Map to change the designation of the approximately 9.68-acre Shops at Sunset Place property
10 located southeast of US1 , north of SW 72 nd Street between SW 57 th Avenue and SW 58th Avenue from
11 Specialty Retail (SR) to Downtown SoMi (DS); and

13 WHEREAS, the Local Planning Agency reviewed the proposed amendment to the Official Zoning
14 Map , held an advertised public hearing on October 26, 2017, provided for public participation in the
15 process, and rendered its recommendation of approval to the City Commission on a vote of 6-1.

17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
18 SOUTH MIAMI, FLORIDA AS FOLLOWS:

20 Section 1. The City of South Miami hereby adopt s the amendment to the Official Zoning Map, as
21 set forth below, changing the designation for The Shops at Sunset Place property located between SW
22 57 t h and 58 th Avenues and , SW 72 Street and USl and located at 5701 SW 72 nd Street, and more specifically
23 described in the attached Exhibit 1, from Specialty Retail (SR) to Downtown SoMi (DS).

2 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the
3 Official Zoning Map of the City of South Miami as amended.

5 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any
6 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
7 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder.

9 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts
10 of sections of ordinances in direct conflict herewith are hereby repealed.

12 Section 5. Effective Date. This Ordinance shall be conditioned on the enactment of an ordinance
13 creating Downtown SoMi (DS) zoning district and shall become effective immediately after the enactment
14 that ordinance creating the Downtown SoMi (DS) zoning district.
