4 An Ordinance providing for a Small-Scale Map Amendment amending the City of South Miami
5 Comprehensive Plan Future Land Use Plan Map from Mixed Use Commercial Residential (Four-
6 Story) to Downtown SoMi (DS) (195 feet) on a 9.G8-acre property known as The Shops at Sunset
7 Place and as legally described herein.

9 WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing
10 process; and
11
12 WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed
13 amendments to ensure that the Comprehensive Plan provides appropriate policy guidance for growth and
14 development; and
15
16 WHEREAS, the Planning and Zoning Department working with the Applicant, FRIT Shops at Sunset
17 Place Fee Owner LLC, prepared a new Future Land Use Map Category to meet the needs of The Shops at
18 Sunset Place Redevelopment; and
19
20 WHEREAS, the City of South Miami and Applicant have jointly prepared a small-scale Future Land
21 Use Map amendment to change the designation of the approximately 9.68-acre Shops at Sunset Place
22 property located southeast of US1, north of SW 72 nd Street between SW 57 th Avenue and SW 58 th Avenue
23 from Mixed Use Commercial Residential (Four-Story) to Downtown SoMi (DS); and
24
25 WHEREAS, the Local Planning Agency has reviewed the proposed amendments to the
26 Comprehensive Plan and held an advertised public hearing on October 26,2017 and provided for public
27 participation in the process and rendered its recommendation of approval to the City Commission on a
28 vote of 5-2.

30 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
31 SOUTH MIAMI, FLORIDA AS FOLLOWS:

33 Section 1. The City of South Miami hereby adopts the Small-Scale Amendment to the Future Land
34 Use Map as indicated on the Map set forth below and changing the future land use map category from
35 the Mixed Use Commercial Residential (Four-Story) to Downtown SoMi (DS) for the property identified as
36 The Shops at Sunset Place at 5701 SW 72nd Street and legally described in the attached Exhibit 1.

2 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the
3 Future Land Use Map of the City of South Miami's Comprehensive Plan, as amended_

5 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any
6 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
7 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder.

9 Section 4. Ordinance in Conflict. All ordinances or parts of ordinances and all sections and parts
10 of sections of ordinances in direct conflict herewith are hereby repealed.

12 Section 5. Effective Date. This Ordinance shall be conditioned on the enactment of an ordinance
13 creating Downtown SoMi (DS) future land use category ("small scale development amendment") for the
14 City's Comprehensive Plan and it shall become effective 31 days after its adoption, if unchallenged,
·15 otherwise, if it is challenged, it shall become effective immediately after the state land planning agency
16 or the Administration Commission, respectively, issues a final order determining that the adopted small
17 scale development amendment is in compliance as provided by Chapter 163.
