_add-on a)Add-on a) Sponsored by: Mayor Stoddard City Commission Meeting: 9-05-17 1 RESOLUTION NO: _____ _ 2 A Resolution of the Mayor and City Commission of the City of South 3 Miami, Florida in support of House Bill 47 sponsored by Representatives 4 Richard Stark and Emily Siosberg regarding changing the Florida Statute 5 on texting while driving from a secondary to a primary offense. 6 WHEREAS, Representative Stark has been an advocate for safety on our roads 7 since his election in 2012; and 8 WHEREAS, the Florida Legislature passed a law to ban texting while driving, but 9 only as a secondary offence, meaning that law enforcement cannot cite a driver unless 10 they are violating another law, such as speeding or careless driving; and 11 WHEREAS, texting while driving in Florida is not considered a moving violation, 12 and only carries a $30 fine as a traffic infraction; and 13 WHEREAS, currently 47 states plus the District of Columbia, Puerto Rico, Guam 14 and the Virgin Islands have a ban on texting and driving, and Florida is only one of four 15 that considers it a secondary offense; and 16 WHEREAS, 14% of all traffic crashes involve distracted drivers and of those more 17 than one half involved the use of a mobile phone; and 18 WHEREAS, an auto accident is five times more likely from mobile phone use than 19 from normal driving and texting requires that a driver take his or her eyes off of the road 20 more often than any other use of a mobile phone; and 21 WHEREAS, House Bill 47, sponsored by Reps. Richard Stark and Emily Siosberg 22 would delete the provision in amending s. 316.305, F.S so as to remove the requirement 23 that the law only be enforced as a secondary action. 24 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF 25 THE CITY OF SOUTH MIAMI, FLORIDA; 26 Section 1. The City Commission hereby supports HB 47 (Texting While Driving) 27 sponsored by Reps. Richard Stark and Emily Siosberg and support the change in s. 28 316.305, F.S so as to give our police officers the tools to increase road safety by making 29 texting while driving a primary offense, and to join the FL Don't Text and Drive Coalition. 30 Section 2. Severability. If any section, clause, sentence, or phrase of this 31 resolution is for any reason held invalid or unconstitutional by a court of competent 32 jurisdiction, this holding shall not affect the validity of the remaining portions of this 33 resolution.
