A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, AUTHORIZING THE CITY MANAGER TO
ACCEPT AN OFFER FROM THE SOUTH FLORIDA WATER MANAGEMENT
DISTRICT TO REPLACE TREE CANOPY AND PROVIDE OTHER
SERVICES AT DANTE FASCELL PARK AS A RESULT OF THE
DISTRICT'S POST HURRICANE ANDREW ACTIVITIES.
WHEREAS, in August of 1992, Hurricane Andrew destroyed much
tree canopy at Dante Fascell Park; and
WHEREAS, a result of the District's post hurricane Andrew
activities at Dante Fascell Park the District owes approximately
80,000 square feet of tree canopy to the City; and
WHEREAS, City Administration previously negotiated with the
District to have 15 Australian Pines removed form the park; and
WHEREAS, City Administration has further negotiated with the
District to reimburse to the City $15,000 in cash for canopy
replacement and remove an additional 15 Australian Pines at a cost
to the District of approximately $9,200.00 in in -kind services; and
WHEREAS, these negotiations will bring to the City over
$33,400.00 towards the beautification of Dante Fascell Park; and
WHEREAS, the City has a tree ordinance which requires that
entities replace tree canopy that has been removed or destroyed.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:

As we previously discussed on January 18, 1996, the South Florida Water
Management District owes to the City of South Miami 80,000 square feet of canopy at
Dante Fascell Park as a result of the District's post Hurricane Andrew activities. To
date, you have completed $9,200,,00 worth of work at the park removing 15 Australian
Pines in March of 1995.
As we have also discussed, the City is willing to accept from the District $15,000 in
cash for replacement of canopy and the removal of an additional 15 Australian Pines
which includes grinding stumps and hauling debris.
We feel that this agreement is fair for both parties and will enable the City to restore
the canopy at Dante Fascell to a pre- Hurricane Andrew condition.
