This resolution amends resolution # 4 -96 -9757 which appointed
personnel for the City's general election to be held on Tuesday,
February 13, 19960
Due to unforeseen circumstances several individuals appointed by
that resolution will not be available to serve on election day.
This resolution provides alternates to work the polls on February
1340

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA RELATING TO THE APPOINTMENT OF
APPROPRIATE PERSONNEL TO STAFF THE CITY OF SOUTH MIAMI'S
GENERAL ELECTION ON TUESDAY, FEBRUARY 13, 1996; EXPENSES
INCURRED WILL BE ALLOCATED FROM ACCOUNT NO. 01- 1200 -4920
TITLED "ELECTION."
WHEREAS, the General Election for the City of South Miami to
elect a Mayor for a two (2) year term, a commissioner from group
I, for a two (2) year un- expired term and two commissioners one
from groups II and III to four year (4) years has been called for
Tuesday, February 13, 1996 at the Dade County Public Library, 6000
Sunset Drive, South • Miami, Florida; and
WHEREAS to conduct this election the Commission desires to
appoint sufficient personnel to staff the polling place on February
13, 1996 from 6:00 a.m., until the close of the polls.
NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The Personnel for the General Election on

REQUEST:
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA,
RELATING TO THE APPLICATIONS BY WALTER SONNENREICH, TRUSTEE, TO DADE COUNTY FOR A
ZONE CHANGE FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF RED ROAD AND S.W. 74
STREET; OBJECTING TO THE APPLICATION BECAUSE OF INCONSISTENCY WITH THE ADOPTED
COMPREHENSIVE PLAN LAND USE DESIGNATIONS FOR THE CITY OF SOUTH MIAMI; PROVIDING FOR
AN EFFECTIVE DATE
Metropolitan Dade County is conducting a Public Hearing regarding an application for a change
of zoning to property located at the southeast corner of Red Road and S.W. 74 Street, in order to
permit construction of a bank with drive through facilities. The current zoning is for apartment
house uses and the proposed zoning is for business (commercial) uses. This property is located
directly across the street from the Hometown Overlay District in the City of South Miami.
The proposed bank is not consistent with the adjacent Comprehensive Plan land use designations
for the City of South Miami. Specifically, and most pertinent to the City, banks are "prohibited
or very strictly limited" in the Specialty Retail/ Residential 'land use designation which is the
underlying land use designation for the Hometown Overlay District Ordinance.
A resolution has been prepared stating the City's objection to the application which must be
presented by the City to the Zoning Appeals Board on Thursday, February 8, 1996, at 2:00 PM.
RECOMMENDATION: Approval of the resolution.
WHEREAS, the City of South Miami determines that the
proposed zone change is inconsistent with City of South Miami
adopted Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MAIMI, FLORIDA.
Section 1. The whereas clauses are incorporated and made
a part of this resolution.
Section 2. The Dade County Zoning Appeals Board is
requested to deny this application.
Section 3. In the event the Dade County Zoning Appeals
Boards determines to grant the application, Dade County is
requested, pursuant to section 163.3177(h)1., Fla. Stat., to
determine if the development proposal will have a significant

appropriate mitigation, if any, of the i

mpacts, and to commence
the intergovernmental dispute resolution process under section
185.509, Fla. Stat.
Section 4. The City Manager, or his designee, shall
represent the interests of the City before Dade County and shall
advise the applicant of the City's determination in this matter.
Section 5. Copies of this resolution shall be
transmitted to appropriate county officials.
