Res No 042-18-15074RESOLUTION NO. 042-18-15074 A Resolution authorizing the City Manager to permit FLAF Sports Services, Inc. to perform professional resurfacing and painting services for tennis, handball and basketball courts at Brewer Park. WHEREAS, City staff recommends professional hard-court resurfacing and painting services at Brewer Park for two (2) tennis courts, two (2) handball courts, and one (1) basketball half court; and WHEREAS, the courts were last resurfaced in 2014, and are in dire need of resurfacing and painting services due to high foot-traffic and the installation of a new perimeter fence; and WHEREAS, competitive proposals were sought from three (3) different sources for resurfacing and painting services at Brewer Park; FLAF Sports Services, Inc. was the lowest and most responsive vendor; and WHEREAS, our goal in completing this project is to provide a beautiful, safe and quality playing environment for the public NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The City Manager is authorized to permit FLAF Sports Services, Inc. to perform professional resurfacing and painting services for tennis, handball and basketball courts at Brewer Park for an amount not to exceed $16,530. The total expenditure shall be charged to the Parks and Recreation Capital Improvement account number 301-2000-572-6450, which has a balance of $612,942 before this request was made. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity ofthe remaining portions ofthis resolution. This proposal is to resurface the court: it won't fix the slope or plain of the court if gny drainage problems are pre"en' due to improper slope. If that is the case, then FLAF Sports Services. Inc. would not be held responsible for any water depressions or water retention in the court. Current birdbaths will be repaired but the owner should understand that birdbaths may reappear later due to furth er settlement or the water may be moved to a different area of the court. 4. Blisters or bubbles in the color coating on asphalt and concrete courts most often are caused by moisture between the pavement and the coating material. within or beneath the pavement. Guarantee shall became void upon customer's failure to adhere and comply with the payment schedule. Proper tennis shoes must be wom on court. Tennis shoes will leave scuff marks on newly surfaced courts. Many shoes with dark colored soles will leave prominent marks on the surface. 6. FLAF Sports Services Inc. guarantees ali work against defects in workmanship or materials for a period of (j J year from the date of completion. If cracks and/or joint expansions are present, they will be repaired; however, they may reappear at any time, This guarantee excludes normal wear and tear, physical abuse orneglectand any other conditions beyond FLAF Sports Services Inc. control. such as damage due to sprinkler system. intrusion of weeds or grass, mushroom growth, ant nests infestation. etc. 7. COURT PREPARATION: Tennis Court Size: 50' x 244', Basketball Court Size: 64' x 34', 2 Handball Courts each 100' x60' The Contractor will pressure clean and power blow court(s) as necessary to remove loose dirt, mildew and oil. The Contractor will paint existing tennis net posts unless option below is selected. The Contractor shall roll entire court area with mechanical roller to smooth surface imperfections. The Contractor will patch depressions greater than 1/8" after 1 hour drying time in sunlight, grind down any ridges as necessary. Depressions are low spots that hold water on the court. Edge 'Of the Y2 basketball court and the west side of the tennis court beyond the fence shall be saw cut and resurfu.ced as the rest of the court. The Contractor will install fiberglass strips over cracks as needed to repair the excessive cracking and prevent the premature return of cracks. Note: court must have a minimum of 1 % slope in one plane in order to guarantee removal of water. SURFACING OF TENNISIBASKETBALL & RACQUETBALL COURT(S) The Contractor will apply (1) Coat of Acrylic Resurfacer over entire court area to fill voids and provide smooth surface. The Contractor will apply (3) Coats of Acrylic Color Concentrate (two-tone), To provide in depth color over court surface. Unless otherwise specified, repair of root damaged asphalt is not included. Should our field technician discover such root damage, repairs will be made at an additional charge of$ 7.00 / sf of area repaired The Contractor accepts no "responsibility for acts by anyone at job site except for those sub-contracted or employed by Sports Sur:fuces LLC. Courts Inc. The Customer shall keep all sprinkler systems off during resurfilcing work and for I day following the completion of work. DaIilage due to sprinkler system are billed as additional expense to owner. Re-mobilization fee: Ifproduction is halted due to circumstances beyond our control, pennit issues, or failure to receive progress payments a $500 re-mobilization fee shall be charged to pay for crew down time, gas and expenses CREDIT If the Customer does not pay as agreed upon. the Contractor shall have the right to file a lien against the real estate for the amount of the work done. No further work shall be accomplished if installment payments are not made at the time specified. In the event it is necessary to employ the services of an attorney to secure payment, as per the terms of this agreement, then the customer agrees to pay reasonable attorney fees.
