Ordinance No. 05-18-2294 An Ordinance amending Section 20-2.3 (definitions) as well as Sections 20-3.1(B) and 20- 3.3(D) (relating to the purpose statement and uses permitted for the Parks and Recreation zoning district) of the City's Land Development Code. WHEREAS, the City of South Miami regulates development within its boundaries through its Land Development Code (LDC); and WHEREAS, the LDC includes Article III, "Zoning Regulations" which includes the purpose statement for and the uses permitted in the Parks and Recreation zoning district; and WHEREAS, services other than recreational are often provided in park facilities; and WHEREAS, the LDC should reflect that these non-recreational services are specifically allowed in City parks and park buildings; and WHEREAS, the South Miami Planning Board held a public hearing on the LDC amendments on January 9,2018 and voted six (6) ayes to zero (0) nays to recommend approval. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. South Miami Land Development Code Article n, "Definitions", Section 20-2.3 is hereby amended to read as follows: * * * Community facilities. A facility in which health care, educational, cultural or social services are provided by a public or private non-profit organization located on a City-owned park of at least 3.4 acres in size and within the boundaries of the South Miami Community Redevelopment Area. * * * Section 2. South Miami Land Development Code Article III, "Zoning Regulations", Section 20-3.1 "Zoning uses districts and purposes is hereby amended to read as follows: * * * (B) District Purpose Statements. * * * (29) "PR" Parks and Recreation District: The purpose of this district is to provide for public parks and open space areas, including those associated with schools and other community facilities. This district is appropriate in areas designated "Parks and Open Space" on the City's adopted Comprehensive Plan. * * * Page 1 Ord. No. 05-18-2294 Section 3. Codification. The provisions of this ordinance shall become and be made part of the Land Development Code of the City of South Miami as amended. Page 2 Ord. No. 05-18-2294 Section 5. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance or the Guidelines adopted hereunder. Section 6. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 7. Tompkins, Planning and Zoning Director Date: March 6, 2018 SUBJECT: 'I An Ordinance amending Section 20-2.3 (definitions) as well as Sections 20-3.1(B) and 20-3.3(0) (relating to the purpose statement and uses permitted for the Parks and Recreation zoning district) of the City's Land Development Code. BACKGROUND: The South Miami Children's Clinic is located on City property at 6701 SW 58th Place, which is the City-owned Murray Park. The clinic is a not for profit organization operating as a charitable health care clinic, with an emphasis on pediatric care for the residents of South Miami. The property is currently zoned P~rks and Recreation (PR) which does not permit this type of activity. ANALYSIS: The City wishes to amend the Land Development Code (lDC) to correct this discrepancy and allow the Clinic to continue its charitable operations legally. The proposed amendment creates a definition for "Community facilities", which encompasses the charitable clinic use, and adds the term to the Permitted Use Schedule (Section 20-3.3(D)) as a permitted use in the PR district. Staff believes this will bring the Children's Clinic into compliance with the lDC and avoid any issue with the Property Appraisers Office. PLANNING BOARD ACTION: After a public hearing on January 9, 2018, the Planning Board unanimously recommended approval of the ordinance with the following change to the definition for "Community facilities": Staff recommendation: Community facilities. CITY COMMISSION ACTION: Community Facilities Text Amendment March 6, 2018 Page 2 of2 On February 6, 2018, the City Commission unanimously approved the ordinance on first reading. The item was deferred at second reading on February 20, 2018. Since that time, the definition of community facility has been revised to address a concern about the potential locations of these facilities. STAFF RECOMMENDATION: Staff recommends that the City Commission adopt the proposed ordinance with the Planning Board's revision. ..
