ORDINANCE NO.04-18-2293 An Ordinance amending the City's Land Development Code,Section 20- 3.3(D)and Section 20-7.12(A)and Section 20-3.4(B),regarding restaurant uses. WHEREAS,theLandDevelopmentCode(LDC)currentlycontainsseveral categories of restaurants including general restaurant,small restaurant,accessory restaurant,convenience restaurant,and walk up restaurant;and WHEREAS,all restaurant usesintheCity require Special Use approval fromthe City Commission prior to commencement;and WHEREAS,the most common restaurant uses in the City are the "Restaurant, General"use and the "Restaurant,Walk Up"use;and WHEREAS,it may bea hardship on new restaurants to require a Special Use permitprior to commencement;and WHEREAS,the special useapproval process cantake several months,which may unnecessarily delay the opening of a restaurant and; WHEREAS,theCity Commission adopted Ordinance #01-09-1993 on February 3,2009,effectively removing the "Small Restaurant"useand its'specialuse conditions fromallsections of theLandDevelopmentexceptSection 20-7.12(A)of theLand Development Code;and WHEREAS,thePlanningBoardheldapublichearingontheordinanceonJanuary 9,2018 andvoted6ayesto0naystorecommendapproval;and WHEREAS,the Mayor and City Commission desires to amend Article III,Section 20-3.3(D),Section 20-3.4(B)andArticleVII,Section20-7.12(A)of theCity of South Miami's Land Development Codetomakeboththe "Restaurant,General"and "Restaurant, WalkUp"ausethatispermittedbyrightinallcommercialzoningdistricts. (ii)The City Commission shall review and recommend approval,disapproval or modification of all site plans and project specifications,including,but not limited to,traffic circulation,landscaping,lot size,access and facility arrangement for this Special Use Permit. (b)RESTAURANT,GENERAL h—All such establishments shall provide onlyinside or patio service on private property.Public streets,rights of way,sidewalks and required setbacks may not be used for patio or street side services of any kind. ii.No services of a drive inor of afastfood nature shallbe permktedr iii.TheCity Commission shallreviewandrecommendapproval,disapprovalor modification of allsiteplansand project specifications forthisspecialusepermit. Section 5.Severability.If any section,clause,sentence,or phrase of this ordinance isforany reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffectthe validity of the remaining portions of this ordinance orthe Guidelines adopted hereunder. Background: Currently,the Land Development Code (LDC)contains several categories of restaurant uses that include "General Restaurant/',"Small Restaurant","Accessory Restaurant","Convenience Restaurant",and "Walk up Restaurant/'Of the restaurant uses mentioned,the "General Restaurant"use and the "Walkup Restaurant"use are the most commonly used categories- Pursuant to both the Permitted Use Schedule,Section 2033(D)and the Permitted Storefront Uses,Section 20-7.12(A)of the LDC,both use categories require the applicantto obtain aSpecial Use permit from the City.Because of the timeit takes to obtain the required permit,itmaybea hardship on new restaurants opening in the City. Asan ongoing effort to ensure that the LDC maintains consistency,the LDC is routinely cleaned up whenever an error presents itself.In this situation,itwasidentified that the "Small j Restaurant"use is still listed in Section 20-7.12(A)ofthe LDC.On February 3,2009,the ! Commission adopted Ordinance #01-09-1993,removing the "Small Restaurant"use and its'! special use conditions.Most likelyan oversight,the removal of the "Small Restaurant"usein I Section 20-7.12(A)was overlooked.• Analysis: ForaSpecial Use Permit to be granted,theapplicationmustbe reviewed by the PlanningBoard I andapproved by the City Commission.In anefforttofostereconomicdevelopment in the City and assist new restaurants,the Cityis proposing that both the "Genera!Restaurant"useand the "WalkUpRestaurant"usecategoriesbeamendedso that theyarebothpermittedby right in aH the commerciaidistrictswhere they arepermitted.Currently,new restaurants entering the City mustgothrough the lengthyspecialuseprocess before theycanobtainabuildingpermitfor construction oraBusinessTaxReceiptfor operation.By amending the LDC,the time needed to go through the required Cityreviewswouldbe reduced byupto three (3)months.Itis Staffs' ^recommendation that the City could benefit from the reduction in time that it takes for a • Restaurant Special Use Text Amendment February 6,2018 Page2of2 restaurant toget started.A reduction intimecouldcreatea more positiveand attractive appearance intheDowntownareaby filling vacant storefronts sooner. Whenresearching the LDC foralistof the restaurant usesthatare permitted in the City,itwas realized that the "Small Restaurant"usewas still listedin Section 20-7.12(A)eventhoughthe City Commission effectively removed itviaOrdinance #01-09-1993.At the time the ordinance was adopted,itwasthe observation of the Planning Department that limitingthelocationofsmall restaurants to the Hometown District caused a negative effecton restaurants that wanted to locatein other areasof the City.Tocomplywith the originalintentofOrdinance#01-09-1993,it is Staff's recommendation thatthe "Small Restaurant"usebe removed from Section 20-7.12(A) aswell. Planning Board Acton: After the public hearing heldat the Planning Board's January 9,2018 meeting,the Board recommended approvaloftheapplicationwithavoteof6ayesto0 nays.
