Ord No 03-18-2292ORDINANCE 03-18-2292 An Ordinance amending Section 20-3.3(E)of the City of South Miami Land Development Code permitting Outdoor Seating/Dining onall commercial properties that are within the Hometown District Overlay Zone(HD) WHEREAS,theCity of SouthMiami(the "City")currently permits outdoor dining/seating withinall commercial properties,exceptfor properties intheRO Residential Office Zoning District;and WHEREAS,theCity adopted the Hometown District Overlay Zone (HD)inorderto implement regulations characteristic of traditional downtowns andto enhance the City's community identity and sense of place;and WHEREAS,in furtherance of the intent and purpose of the Hometown District Overlay Zone(HD),theCity currently permits outdoor dining/seating on properties within the Hometown District Overlay Zone (HD);and WHEREAS,City staff recommends modifying Section 20-3.3(E)of the Land Development Codeto permit outdoor dining/seating onall commercial properties located within the Hometown District Overlay Zone(HD),including those zoned RO Residential Office;and WHEREAS,the Planning and Zoning Department has recommended approval of the Ordinance;and WHEREAS,on January 9,2018,the Planning Board considered the Ordinance,and followingapublichearingrecommendedapproval of theOrdinancebyavote of four(4)ayesto two (2)nays;and WHEREAS,theCity Commission desirestoacceptthe recommendation of thePlanning Board. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1,Section20-3.3(E)of theCity of SouthMiamiLand Development Codeis hereby amended to read as follows: 20-3.3 -Permitted use schedule. *** (E)Outdoor Seating/Dining,forAll Commercial Properties,exceptforPropertiesthatare zonedin the RO Residential OfficeZoningDistrict. Pg.2 of 0rd.No.03-18-2292 (1)Outdoor seating/dining shallbe permitted forall commercial properties,except forthose commercial properties that are located outside of the Hometown District Overlay Zone (HD)and that are zoned RO Residential Office Zoning District.A permit application for outdoorseatinganddiningorasidewalkcafeonpublicpropertyoronpublicrights-of- wayoronprivate property contiguouswithapublicright-of-way,mustbefiledwiththe Planning and Zoning Department andapprovedbytheCity Manager prior tosuchuse.The application shall include a layout (siteplan)of the location of all tables,chairs (including number andtype of chairs),benches,andotherfurniture;pedestrian ingress andegress; location of refuse containers;location of approved outdoor speakers;and other elements necessary to illustrate the proposed outdoor seating/dining useandarea(all drawings must be titled,indicate orientation,andbeatan acceptable scale).If applicable,thesite plan must clearly indicate which seatsandtablesareon private property and which areonthe public right-of-way.TheCity Manager shallrequirethatan amended site plan be submitted in order to address specific problems.Atleast seven (7)days prior tothe City's Manager's decision onan application fora property thatis zoned RO Residential Office Zoning District and located within the Hometown District Overlay Zone (HP),the City shall post a sign on the subject property which identifies the nature of the pending application and the means by which questions or comments onthe application may be directed.The City Manager shall consider any comments received bythe public prior to issuing a decision on the application. *** Section 2.Codification.The provisions of this ordinance shall become and be made part of the Code of Ordinances of theCity of South Miami as amended;that the sections of this ordinancemaybe renumbered or re-lettered to accomplish such intention;andthattheword "ordinance"maybe changed to"section"orotherappropriateword. Section 3,Severability.If any section,clause,sentence,or phrase of this ordinance isfor any reason held invalid or unconstitutional byacourt of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances andall sections andparts of sections of ordinances indirectconflictherewithareherebyrepealed.However,itis nottheintent of thissectiontorepealentireordinances,orparts of ordinances,thatgivethe appearance ofbeingin conflict whenthetwoordinancescanbe harmonized orwhenonlyaportion of the ordinance in conflict needstoberepealedto harmonize the ordinances.If the ordinance in conflictcanbeharmonizedbyamendingitsterms,itisherebyamendedtoharmonizethetwo ordinances.Therefore,onlythat portion thatneedstoberepealedto harmonize thetwo ordinances shallbe repealed. Background: The Hometown District Overlay Ordinance (HD)allows restaurant uses in the Residential Office (RO)district.Outdoor seating/dining,however,is regulated bySection 20-3.3(E)of the Land Development Code (LDC),andis prohibited for properties in the RO District.Accordingly,a RO zoned restaurant in the Hometownwouldnotbeallowedtooffer outdoor dining/seating. Analysis: Apartfromthe Hometown area,restaurants are prohibited inthe RO district.Thismakessense, as the RO districts often abut single-family residential zoningdistrictswhicharetypically separated or buffered fromhigher intensity useslike restaurants.TheHometownOverlay,on the other hand,is intended to create anactive,urban,pedestrian-oriented environment. Outdoor dining/seating contributes tothis environment,andisacommon feature of the traditional downtown character the regulations encourage.The proposed ordinance would thus further the intent of the Hometown Overlay. Currently,outdoor diningapplicationsare approved administratively,and there isno requirement foranynoticeto the public.Staffnotes,though,that.the existing RO zoned properties in the Hometown abut residential uses and thus believe additional consideration should be given toan application.The proposed ordinance includes arequirementfor posting a property with notice of the applicationand requires that anypublic comments beconsidered beforeadecisionis made ontheapplication.Staffbelieves these provisions,coupledwiththe other restrictionsofSection 20-3.3(E),willoffer adequate protection to the nearbyresidents. Planning Board Action: AfterapublichearingonJanuary9,2018,thePlanningBoard recommended approval of the ordinance bya vote offour(4)ayestotwo(2)nays.
