More specifically , that your plans to : construct a sub- grade therapy room, a flotation tank and biofeedback room , a swimming pool , a wading pond , a fish pond , a whirlpool spa , and a playground area ; for your personal use and for the use of your "guests " , who will include handicapped children and their parents , who will typically not number more than 10 or 12 at any one time and who will park no more than 2 vehicles at any one time on your property ; do not fall within the intent and, purpose of the RS-3 district . I also noted that the plans as submitted do not provide enough information about the proposed amount of impervious lot coverage and other details about the proposed construction that would need to be furnished to review the proposal to see if it meets the specific district regulations appli - cable to property zoned RS-3. As I explained at the meeting , based on the opinion above , the only . possible administrative procedure you could follow to try to have your plans approved would. be to apply for a Home Occupational License . That process takes about 12 weeks and requires a $200 fee the first year , and there is obviously no guarantee of approval . Finally , as explained , you may appeal this administrative decision directly to the City Commission by writing a letter to the City Clerk by March 31 , 1982 . IMPORTANT NOTE: This is not your typical utility building or storage shed. The exterior would be trimmed in artificial stone and the entire building might be made to look as though nature had accidentally piled three or four huge boulders together in one end. of the garden. Made of conrete or other approved materials, the spa will be recessed into the ground. so that the outer rim of the spa is slightly higher than the surrounding grade. SWIMMING POOL: Approximately 20'x10' in one part and 8'x16' in its second part. Has all the latest ap- proved technology for health, safety, clean- liness and a heater. Deep pool: For swimming, is up to 8 ft. deep; 20x10 Shallow pool: For wading, is 22 to 3 ft. deep; . 8x16 The deep pool & the shallow pool appear to meet under a short foot bridge. They don' t really meet. The waters of the two pools do intermingle under the foot bridge, but a barrier keeps swimmers from getting under the bridge and prevents swimming from shallow to deep. DECKS & WALKS: Decks & walks cover approximately 4/ of the area to the rear of the house. They are all to be made of cedar or other suitable materials and permanently anchored, on site. FENCES, GATES : All to conform to building codes, including automatic closing & locking gates, sturdy fences made of stone and./or durable wood. GARDENS AND LANDSCAPING: These have been designed by a landscape archi- tect. They conform to best uses for South Flo- rida. It is my understanding that the property owners' .attorney is asking for a change of lot facing so that S.W. 78 Street will be the front of the above referenced property instead of S.W. 77 Terrace. The redesignation of lot facing will allow the property owner to maintain existing, non-conforming improvements made to the property and resolve several out- standing Zoning Code violations. In considering this request, I took into account the following factors: 1. The facing of a lot is not regulated by the Zoning Code. 2. The Planning Board does,- n-ot have- jurisdiction over lot facings according to Article XII of the Zoning Code; therefore, a public hearing is not required in order to determine the facing of a lot. 3. Historically, the narrow portion of a lot or building site has been deemed to bbothe front. of a property. Since the Zoning Code does not address lot facings, it is my opinion that the determination of a lot facing shall be made at the discretion of the Building and Zoning Director. Such determination should be based upon precedent, existing con- ditions, impact to the surrounding area and the reasons for the requested change. Property of Dr. and Mrs. Gelinas 5888 S.W. 77 Terrace cont. . . With reference to these four criteria, I made the following observations: 1. Precedent. Although the narrow portion of a lot is usually deemed to be the front, the property in question is a through- lot and, therefore, has two narrow sides.-.-one facing. S.W. 77 Terrace and the -other facing S.W. 78 Street. Historically, however, the house on the subject property has had a front door and walkway facing S.W. 77 Terrace, as the property's address indicates. 2. Existing Conditions. Properties adjacent to the subject site are also through- lots, yet they face S.W. 77 Terrace. Additi.onally, all the houses along S.W. 77 Terrace between S.W. 58 Avenue and S.W. 59 Avenue face S.W. 77 Terrace. 3. Impact. The front of a property is normally its best side and usually contributes the most to the abutting street in terms of aesthetics, consistency, and property value. From that perspective, redesignation of the property's facing would not enhance the quality or character of S.W. 77 Terrace. 4. Reason for Change. As I understand it, the sole purpose of' this request is to correct outstanding Zoning Code violations. In conclusion, based upon the above noted observations, it is my opinion that the request to change the lot facing should not be granted and that the subject property should continue to face S.W. 77 Terrace. This relationship has been beneficial for parents, students , teachers , and administrators who have participated in the program. We are currently involved in developing our 1987-1988 budget and cannot make a firm commitment for funding of projects . There is also the possibility of a shortfall in projected revenues which would make increased allocations for current projects impossible. However, staff has recommended continued funding of the Lucky Acorns Program in the amount of $44,495 from local funds . Additionally, the Office of Vocational , Adult , and Community Education anticipates approval of your request for Community Instructional Services in the amount of $11,000. These funds, if approved, will be allocated in the same manner as they were for the previous fiscal year. Staff has also researched the proposed General Appropriations Bill , as you suggested in your letter. Under Specific Appropriation 465, Special Grants Category, Grants and Aids, $1 million is recommended for use by community based organizations for dropout prevention projects. Dr, George Koonce, Director for the Dropout Prevention Program, indicated that he would support your application to the Department of Education for funding. The Office of Vocational , Adult, and Community Education has also indicated similar support and will produce a letter outlining our relationship with your organization and support for the Lucky Acorns Program. Isere, children learn how to stay out of trouble; and parents learn how to protect their children. FAMILY TRAINING We train parents as well as children. Research shows that the home onvironment Of a Child is MOSt important for child development. Test results show our training improves family solidarity. WHAT LUCKY ACORNS DOES: IMPROVED SELF-ESTEEM Children who feel good about themselves are much less likely to get into trouble. We teach children to feel like a winner and live like a winner. And we teach the parents how to encourage that kind-of- thinking at home. • - IMPROVED FAMILY COMMUNICATION Parents need to know what their children are doing, what they are feeling and thinking about. Communication is a skill. We teach parents and children how to communicate. HOW LUCKY ACORNS WORKS: FORMAL CLASSES This is a structured academic training program. We hold scheduled classes, keep attendance records, follow a fixed curriculum, and use testing to measure the results. PROFESSIONAL INSTRUCTORS: We hire state certified teachers only. Careful screening is followed by nine weeks of intensive field training. Only sensitive, gifted, and dedicated professionals may hope to qualify. SCIENTIFIC METHODS: We use group discussion, taped lessons, guide books, puppetry, audio-visual equipment, and other specific learning aids. WHO LUCKY ACORNS IS FOR: PARENTS This training is for parents who care enough to "go the extra mile". Many are already outstanding parents. All want to be better. (Please see reverse) i t KIDS WHO EXCEL; KIDS AT RISK* *(Sometimes that's the same child!) The training works equally well for above average kids, and kids in trouble or "at risk". To understand how, think of it this way: - This training is like a high quality "fuel", and each child is like a large or small "engine". - The same fuel in either size engine yields the greatest work that engine can produce. So! Children with learning disabilities use this training to reach their potential And: Children with high achievement capabilities use this training to soar ahead. WHERE THE TRAINING IS HELD: The training. is FREE of charge. Classes are scheduled only for 4th, 5th, and 6th graders in selected public schools throughout Dade County. Children's classes meet twice a week in the afternoon; parents' classes meet once a week at night. This program lasts nine weeks. Pa.rent9l elasees and Children's classes all meet in the same building the child attends during regular school hours. (Parenting classes are taught in Spanish and English.) IMPORTANT: Parents must enroll for the parenting classes at the same time the child is enrolled in the children's classes. Parents must attend. (One parent is sufficient, both are preferred.)
