A Resolution confirming the state of emergency due to Hurricane Irma.
WHEREAS, pursuant to its municipal home rule powers to prepare for and respond
to weather and other emergencies, the Mayor and City Commission of the City of South
Miami enacted Ordinance no. 11-93-1539,entitled "Emergency Management; and
WHEREAS, the Emergency Management ordinance provides for the City Manager or
designee to recommend a declaration of a weather emergency pursuant to sections 14-5 and 14-
12, and upon such declaration, to exercise powers relating to evacuation; curfew and designation
of restricted areas; suspension or regulation of the sale of alcoholic beverages; prohibition on
price gouging; water use restrictions; suspension oflocal building regulations; regulation of the
use and rationing of fuel, ice and other essential goods; and emergency procurement procedures;
and
WHEREAS, the State of Florida remains under a State of Emergency declared by the
Governor prior to Hurricane Irma, on September 4, 2016, which had been classified as a
category V hurricane, prompting the National Hurricane Center to post a hurricane warning for
the entire State of Florida; and
WHEREAS, the City Manager previously found that it was necessary to declare a
weather emergency and to organize all available City resources to prepare for, respond to and
recover from all threats to the security, safety and health of the people of South M i am i; and
WHEREAS, a weather emergency resulting from the threat of imminent damage from
Hurricane Irma was previously declared to exist; and
WHEREAS, the City Manager is authorized and directed to exercise all necessary and
appropriate powers under Ordinance no. 11-93-1539 to accomplish emergency management
during the duration of this emergency. The City Manager shall report to the Commission at its
next regularly scheduled meeting, unless a special meeting is called earlier, a preliminary
assessment of the damage caused by the hurricane, all actions taken in response to the
emergency, the effectiveness of the emergency management structure, the estimated cost of the
response, further actions which may be required, contracts which must be reviewed and ratified
by the Commission and any emergency budget appropriations which may be requested; and
WHEREAS, due to continuing debris removal issues and agreements that may yet
to be entered into, the City Manager is hereby certifying with this resolution that current
declaration of emergency shall be extended to remain in effect until the first Commission
meeting in November 2017; unless it is terminated earlier by the Commission or by
certification by the City Manager or designee; and
WHEREAS, as of the morning of September 19, the traffic lights in South Miami that
are still not functioning are listed below. We have contacted the county to advise them and they

have told us a work order was prepared to fix the problem.

The City has been advised that power should be restored to all residents in Dade County by
midnight tonight; and
WHEREAS, last week before during and after Hurricane Irma our Police were out in force
with lights running to help show their visibility and presence. This lead to a significant reduction
in crime in our area to the extent that during the week of9-11-17 to 9-17-17 we had no robberies,
auto thefts or burglaries and no violent crimes. This is outstanding and we are very proud of our
public safety record during this difficult period. (Irma hit on 9-10-17).
WHEREAS, City staff has surveyed the City for damage several times and are proud to
report that all of our roadways are clear and have been for days. However, we have suffered
damage to our infrastructure and our excellent Public Works staff will be addressing those issues
immediately. Some of those issues include:

WHEREAS, some have wondered why our Public Works staff is not fmishing the debris
clearing that they started. Our contracted hurricane debris removal specialists have fIrst hand
knowledge of the very complicated and ever-changing FEMA regulations and have larger FEMA
certifIed trucks and more crews so that we will get a faster cleanup and a much greater likelihood
of a fuller reimbursement of our funds from FEMA. Our Public Works crews will be assisting the
debris clean up by ensuring that the roadways are truly clear of hurricane debris after the main
crews have done their mass pickups. Additionally, our Public Works staff is responsible for
garbage pick up and that process needs to continue uninterrupted on its regular schedule. With the
combination of our Public Works staff addressing infrastructure repairs and regular garbage
services, and our task specifIc debris removal contractors vigorously attending to debris removal,
we have maximized our efforts to bring the City back to normal as soon as possible. We are using
this two -pronged approach to ensure the maximum refund from FEMA, which is our fIduciary
responsibility to the citizens of the City; and
WHEREAS, as a highlight of the diffIculty some Cities are having because they are not
as nimble as the City of South Miami, the following is an excerpt of an email from the Planning
Bureau Manager of the Office of Emergency Management for the County:
Subject: C oncerns with contracts for Debris Importance: High
I know some of you are having issues with the contractors honoring the contracts . I have
spoken to the FEMA rep we have here and they are reaching back to FEMA to fmd a P A

Debris specialist and maybe an attorney who can answer your questions directly. As soon
as I have any additional information I will pass this along. They may choose to do this as
a conference call. I want you to be able to speak to FEMA directly so there is no confusion
on the proper manner to handle this to avoid any issues with reimbursement in the future
WHEREAS, as of today the City Manager will present a token of the City's appreciation
to the City's fabulous Public Works staff that, in all likelihood cleared the City's streets for traffic
sooner than any other City due to their great leadership under Shari Kamali and John Reese. Since
then the City has been under clean up by a County contractor named G7 since virtually the day
after the Commission approved the MOU with the County for those services . G7 has been using
several loaders and several 100 ft. trucks to enable the fastest practical process . The City has
been responding to many citizen requests for information and assistance with debris related items
and City staff have been working hard to make sure that the City has a quick and efficient clean
up and that resident issues are resolved as rapidly as possible. The City's Public W ork s staffhas
been addressing normal garbage pickup schedules as well as cleaning up City streets after the
clean up contractor has passed by. The City expects this to go on for many more weeks due to
the volume of debris that is on City streets; and
WHEREAS, the City has established an email address for any questions , complaints or
requests relating to Hurricane Irma. Any resident who has such an interest should contact the
City at hurricaneirma@southmiamifl .gov . Any property owner who has damage from the debris
clearing process should call 311 as well as sending it to hurricaneirma@southmiamifl .gov. The
County is requesting this process to ensure that the City has the best chance of the largest
reimbursement from FEMA possible. G7 has agreed as early as last night that it will address
individual property damage caused as ancillary impacts from the debris clean up process. It is
the City 's goal that its residents will be compensated for most or all of the accidental impacts
caused by debris removal. It should be noted that storm related property damage, not caused by
the County contractor, should be addressed by the property owners directly through FEMA and
homeowners insurance. Although the City always strive to achieve 100 percent reimbursem ent,
it should be remember that it is typical for FEMA to only reimburse for a portion of the actual
expenses which results, sometimes, in the range of 75-90 percent payment; and
WHEREAS, the city is pursuing a piggyback agreement to have its trees cleaned of any
hanging branches as well as pruning to resolve leaning or misaligned trees. This will also include
stump grinding if possibl e and all of which should be fundable by FEMA; and
WHEREAS, contractors working on behalf of the City have, as of October 2, 2017,
cleared and hauled 28,429.6 cubic yards of debris from 594 load tickets; and
WHEREAS, the City Public Works staff has picked up some 50 loads at 25 cubic yards
each for an additional 1,250 cubic yards. Altogether that is approximately 30,000 cubic yards
and almost 650 truckloads.

NOW THEREFORE, BE IT RESOLVED BY THE MA YOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FL ORIDA:
Section 1. The City Commission hereby confirms that a state of emergency has existed
since September 6, 2017, and continues to exist as declared by the City Manager. Emergency
purchasing powers shall be related only to matters concerning the emergency .
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution .
Section 4. Effective Date. This resolution shall become effective immediately upon
adoption.

2017 EVACUATION CENTERS
Evacuating locally to the home of a friend or family member outside of the evacuation area is
highly recommended. Hurricane Evacuation Centers should be utilized when that alternative does
not exist. Remember, evacuation centers are not designed for comfort and not all accept pets.
NOT EVERY SITE WILL OPEN FOR EVERY EVACUATION!
Please monitor the local radio or television, or dial 3-1-1 (TOO (305) 468-5402) to find out which
centers are open when an evacuation order is announced. People who require special assistance
in evacuating can dial 3-1-1 to get information about specialized evacuation centers.
