SUBJECT: A Resolution authorizing the City Manager to negotiate and to enter into a
contract with Canyon Construction, Inc., for the installation of a new gateway
monument sign to be placed at Fuchs Park.
BACKGROUND: The Mayor and City Commission wish to provide a new gateway monument
sign to be placed at Fuchs Park. The project scope shall include and is not
limited to tree relocation, tree root pruning, tree protection; electrical work
related to sign and landscape lighting and an irrigation pump station; structural
work including reinforced concrete foundation and wall; rough and fine
grading; and fabrication and installation of an architectural sculptural sign
including City logo.
VENDOR &
BID AMOUNT:
The awarded contractor is responsible for furnishing all labor of Contractor and
the labor of all allowable subcontractors, and cost of disposal of materials as
well as all necessary machinery, tools, transportation, equipment rental and
permits, to perform the installation of the new gateway monument sign to be
placed at Fuchs Park.
Through the Procurement Division, the City's Public Works Department
submitted a Request for Proposal ("RFp") #PW2017-15 on Tuesday, June 18,
2017 for "Fuchs Park Gateway Sign Fabrication and Installation Project." The
City received two (2) proposals; Canyon Construction, Inc. is the second bidder
and is in compliance with the terms ofthe RFP.
The lowest vendor, IMF Estimating & Construction Corp. was established in
2012 and demonstrates no experience in signs construction comparison to its
competitor. This firm has not completed any jobs in the past five (5) years that.
requires the specialty and trades for this type of project.
Please see below a breakdown of all submitted bids.

A contingency amount of $10,000 will be included over the proposal amount of
$210,237.13 to address for unknown factors that may arise during the work.

25 WHEREAS, the City desires to provide a contingency of $10,000 over the proposal
26 amount to address for unknown factors that may arise during the work; and
27 WHEREAS, the Mayor and City Commission desire to authorize the City Manager to
28 negotiate and enter into a contract with Canyon Construction, Inc., for the installation of a new
29 gateway monument sign to be placed at Fuchs Park for a total amount not to exceed
30 $220,237.13.
31 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
32 CITY OF SOUTH MIAMI, FLORIDA;
33 Section 1. The City Manager is authorized to negotiate the price, terms and conditions
34 and to execute a contract with Canyon Construction, Inc. for the installation of a new gateway
35 monument sign to be placed at Fuchs Park for a total amount not to exceed $210,237.13. The

1 City Manager is authorized to expend up to $10,000 to address any condition that the
2 contractor, using reasonable diligence, could not have foreseen when formulating its bid. A
3 copy of the approved form of contract is attached. The expenditure shall be charged to the
4 Capital Improvement Program Fund account number 301-1790-519-6450, which has a balance
5 of $621,347 before this request was made.
6 Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
. 7 any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
8 shall not affect the validity ofthe remaining portions ofthis resolution
9 Section .3 •. Effective Date: This resolution shall take effect immediately upon adaption.

The CONTRACTOR agrees to bind specifically every Subcontractor to the applicable terms and
q,mditions ofthe Contract Documents for the benefit of the OWNER.
All Work periormedfor the CONTRACTOR by a Subcontractor shall be pursuant to an appropriate
agreemen~betweenthe CONTRACTOR and the Subcontractor.
The CONTRACTOR shall be responsible for the coordination of the trades, Subcontractors material· and
men Work.

CONTRACTOR due to negligence of the CONTRACTOR; or those acting by or through him or

I 1.8.2 Cost of aU materials and equipment furnished and incorporated in the Work, including tosts of
transportation and storage, and manufacturers' field services required in connection
thereWith. The CONTRACTOR shall notify the CITY of all cash discounts that are available and
offer the CITY the opportunity to deposit funds with the CONTRACTOR for the payment for
items that offer a.discount. Cash discounts shall accrue to CONTRACTOR unless the
CONTRACTOR fails to timely notify the CITY of the discounts or if the OWNER depOSits funds
with CONTRACTOR with which to make payments in which cases the cash discounts shall
accrue to the OWNER. AU trade discounts; rebates and refunds, and all returns from sale of
surpJusmateriars and eqUipment shaH accrue to OWNER, and CONTRACTOR shall nlake
provisions so that they maybe obtained.
11.8.3 Payments made by CONTRACTOR to the Subcontractors for Work pertormedby
Subcontractors. Ifrequired bytlTY, CONTRACTOR shall obtain competitive bids from
Subcontractorsa.cceptllb1e to him and shall deliver such bids to CITY who will then determine,
with the advice of the CONSULTANT, which Bids will be accepted. No subcontract shall bea.
cost plus contract; unless approved in writing by the CITY. If a Subcontract provides that the
