Res No 133-17-14934RESOLUTION NO.: 133-17-14934 A Resolution authorizing the City Manager to negotiate and enter into a multi-year agreement with Printing Corp. of the Americas, Inc. to design, print, supply and mail program guides. WHEREAS, the Parks and Recreation Department desires to provide City residents with an all-inclusive program guide that features upcoming programs, activities and special events; and WHEREAS, the program guide covers October through March and April through September program cycles; and WHEREAS, a total of 3,200 guides will be printed per cycle (or 6,400 per year); 3,000 will be mailed to residents and the remaining 200 guides will be available at City facilities and manned- parks, for example, City Hall, Gibson-Bethel Community Center, Dante Fascell Park; and WHEREAS, through a formal competitive process, the City submitted an Invitation to Quote (lTQ) #PR2017-12 on Monday, May 8, 2017 for "Program Guide for Parks and Recreation Department./I Two (2) proposals were received; Printing Corp. of the Americas, Inc. ("PCA") was the lowest bidder ($26,356 over five years) and is in compliance with the terms of the ITQ; and WHEREAS, a contract will be awarded for a one (1) year period. At the discretion of the City Manager, the contract may be extended for four (4), one (1) year option-to-renew, for a total of five (5) consecutive years; and WHEREAS, per the agreement, the City will pay PCA $26,356 for services over a five (5) year period, excluding postage costs during years 2 through 5. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1: The City Manager is authorized to negotiate and enter into a multi-year agreement with Printing Corp. of the Americas, Inc. to design, print, supply and mail program guides for an amount not to exceed $26,356, excluding postage fees during years 2 through 5. Section 2: The total expenditure shall be charged to the Parks and Recreation Contractual Services, account number 001-2000-572-3450, which has a proposed FY-18 budget balance of $32,471 before this request was made. Section 3: If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. This provision supersedes and takes precedence over any contrary provisions for termination contained in the Contract Documents. 10) Applicable Law and Venue: Florida law shall apply to the interpretation and enforcement of this Contract. Venue for all proceedings shall be in Mlami-Dade County, Florida. 11) Duties and Responsibilities: CONTRACTOR shall comply with all applicable laws, ordinances, codes, rules, regulations, and health and safety standards of any governmental body having jurisdiction over any matter related to this Contract or the goods and/or services to be performed hereunder, and shall commit no trespass on any private property in performing any of the work embraced by this Contract.
