RESOLUTION NO.
A Resolution acknowledging Commissioner Harris' (Group Seat IV) re-
appointment of Sally Philips, as the representative of Group Seat IV, to
serve on the Board of TrusteeslPolice Officers Retirement Trust Fund, for a two-
year term ending July 11,2019.
WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that:
* * * When a Board or Committee is comprised of five members, each City
Commissioner shall appoint one person to serve as a representative on the
Board or Committee. When there are more than five (5) members on a
Board or Committee, each City Commissioner shall appoint one person to
serve as a representative on the Board or Committee, and all members of
such Board or Committee in excess of five (5) shall be appointed by three
(3) affirmative votes of the City Commission based on recommendations
submitted by any City Commissioner. When a Board or Committee has less
than five (5) members, then the selection of all members shall be by three (3)
affirmative votes of the City Commission from recommendations submitted
by any City Commissioner. (Amended2-09-10)
22 WHEREAS, the City Commission desires to acknowledge the appointment of Sally Philips, a
23 resident of the City of South Miami, to serve for a two-year term on the Board of Trustees/Police Officers
24 Retirement Fund. Appointment shall expire July II, 2019, or until removed or unless a successor is duly
25 appointed and qualified. However, notwithstanding anything contained herein to the contrary, the term
26 shall never exceed the term limits set forth in section 2-22 of the City's Code of ordinances; and
27.
28 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22
29 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2)
30 consecutive two-year terms of membership on a specific commission, board, or committee.
31 After serving a maximum of two (2) consecutive year terms, an appointee shall not be
32 reappointed to the same commission, board or committee unless at least one year has elapsed
33 between the term limited position and the effective date of commencement of the proposed
34 appointment for a new term; and

36 WHEREAS, Sec. 2-22 "Term Limits" of the Code of Ordinances, as amended by Ordinance No.
37 06-14-2184, dated April 15, 2014, provides that the appointer, or his or her successor in office, may extend
38 the term limits of his or her appointment with the advice and consent of a majority of the City Commission;

WHEREAS, this will be Ms. Philips' second, two-year term serving on this Board.
43 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
44 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

46 Section 1. The City Commission hereby acknowledges Commissioner Harris' right
47 to re-appoint Sally Philips to the Board of Trustees/Police Officers Retirement Fund as the
48 representative of Group Seat IV pursuant to the terms of the City Charter.
