Res No 160-17-14961RESOLUTION NO.: 160-17-14961 A Special Event Permit authorizing Historic St. John AME Church to host a Love in the Garden at their location 6461 SW 59th Place and the Madison Square Property/Site located at 59th PI~ce and 64th Street and to waive all special event fees and insurance requirements. WHEREAS, historic St. John AME Church (lithe applicant") has submitted a Special Event Application to host a Love in the Garden event on Saturday, August 5, 2017 at their location 6461 SW 59th Place and the Madison Square Property/Site located at 59th Place and 64th Street; and WHEREAS, the Love in the Garden event will focus on Stopping Gun Violence and will consist of a peace walk, guest speakers, music, food vendors, balloon toss, face painting, flag football and games; and WHEREAS, the event will be free to the public; food vendors will be selling food and beverages; and WHEREAS, the applicant is requesting a waiver for all Special Event fees in the amount of $720, as illustrated in the table below; and DEPARTMENT AMOUNT SPECIAL EVENT ApPLICATION FEE $60 SPECIAL EVENT ADMINISTRATIVE FEE $100 REFUNDABLE SECURITY DEPOSIT $500 EXPEDITING FEE $60 WHEREAS, the applicant is responsible to pay the City $150 for the rental of the Parks and Recreation stage; and WHEREAS, the applicant has completed the Special Event Application and has submitted the necessary Notification/Petition Form signed by homeowners that will be affected by the requested event. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The City Manager is hereby authorized to permit the applicate to hold its Love in the Garden event and to waive all special event fees and insurance requirements. Section 2. The City Manager is hereby authorized to waive all special event fees in the amount of $720. Section 3. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect Page 1 of2 Res. The applicant would like to host the Love on the Garden and extend their event into the Madison Square Property/Site located at 59 th Place and 64 th Street. According to the applicant, all streets and sidewalks will remain open to the public. The Love in the Garden event will focus on Stopping Gun Violence and will consist of a peace walk, guest speakers, music, food vendors, balloon toss, face painting, flag football and games. The event will be free to the public; food vendors will be selling food and beverages. All public property including sidewalks, street gutters, etc. shall be cleaned if used by the applicant. Department staff has informed the applicant, as per the City Ordinance 13-16-2246 amending Section 13A-22 of the Code of Ordinance; Balloon releases are prohibited within the City of South Miami. This event has an anticipated attendance of 100 persons and will be held .from 1:00 PM -6:00 PM. The Police Department will have on-duty officers periodically patrolling the event. The Police department has informed the applicant that the peace walk shall not block streets or interfere with the flow of traffic. The applicant has submitted the Notification/Petition form. However, the applicant has requested a waiver for the submission of the necessary General Liability Insurance Certificate. The applicant has paid the $150 stage rental fee. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami-Dade County standards and any additional requirements by the City 'of South Miami Public Works Department and Police Department. S. Event areas shall be restored to equal or better condition than they were before the event started. 6. Any damage to private property shall be restored to its original condition or better and as accepted by the Owner caused by applicant or any of its agents, servants or emp10yees, invitees and onlookers. 7. If all restoration work is not performed within 30 days of work completion, the City of South Miami Public Works Departmen~ may restore the event area and charge the applicant for the cost of restoration and additional incidental fees. 8. Applicant must pay all fees prior to the date of their event(s). 9. Applicants shall notify the City. of South Miami Special Event Coordinator at least forty-eight (48) hours prior to start of their event of any cancellations to be considered for any refunds.
