WHEREAS,theCity of South Miami hasagrant award forthe purchase of three (3)ruggedized
laptop/tablet computers,three(3)covers,andthree(3)dockingstationsforPoliceOfficersinthe
amount of $5,410.00 fromthe Florida Department of Law Enforcement fromthe Edward Byrne
Memorial Justice Assistance Grant;and
WHEREAS,the Mayor andCity Commission desireto accomplish the purpose of the purchase
of three(3)ruggedized laptop/tablet computers,three(3)covers,and three (3)docking stations to
improvePolice Officers'responsetimesandcombatautotheft,asoutlinedintheattachedapplication
and Subgrant Award Certificate (contract number 2017-JAGD-DADE-11-F8-133)which are
incorporated herein by reference;and
WHEREAS,the Mayor andtheCity Commission wishto accept thegrant agreement withthe
Florida Department of Law Enforcement fortheEdwardByrne Memorial Justice Assistance Grant.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA THAT:
Section 1:TheCity Manager is hereby authorized to execute the grant agreement withthe
Florida Department of Law Enforcement,Office of Criminal Justice Grantsforthe Edward Byrne
Memorial Justice Assistance Grant forthe purchase of three (3)ruggedized laptop/tablet computers for
South Miami Police Officers inthe amount of $5,410.00.The grant agreement is attached tothis
resolution.
Section 2.Severability.If any section clause,sentence,or phrase of this resolution isforany
reasonheld invalid or unconstitutional byacourt of competent jurisdiction,the holding shallnotaffect
the validity of the remaining portions of this resolution.
Section 3.Effective Date.This resolution shallbecomeeffective immediately upon adoption
byvote of the City Commission.

The Florida Department ofLaw Enforcement by and through its
OfficeofCriminal Justice Grants awarded the Cityof South Miami
$5,410 for the project entitled "Rl -Records Improvement Project".
The Cityof South Miami will be allocating the funds for the purchase
of three (3)ruggedized laptop/tablet computers,three (3)covers,and
three (3)docking stations for South Miami Police Officers.
The City will purchase three (3)ruggedized laptop/tablet computers
for use by patrol officers,to be in contact with computer aided
dispatch for faster response times and to access the Superion OSSI
software crime reporting system.The laptop/tablet computers will
also supplement in-office outdated computers to ensure that officers
can better manage the auto theft and burglary occurrences by
tracking and accessing statistics.

Problem Identification
ThisProject will help South Miami Police Department converttoa paperless system forcriminal
justice reporting.The Department has been seeking fundingto support the purchase oflaptop
computers forpoliceofficers.These laptop computers will enable officerstoworkmoreefficiently
and accurately whenpreparing reports.Althoughthe department has been ableto secure some
fundingforthe conversion,nofunding has been allocated for updated computer equipment for
daily operations.Currentcomputingunitsareoutofwarranty,andnotfunctioningproperly.
Because thePolice Department has nothadthefundsforupgradingthe equipment,grant funds
have been identifiedto purchase new equipment.
Project Summary (Scope of Work)
Inanefforttoimprovethe management andmaintenanceof criminal justicedata,theSouth Miami
PoliceDepartment will utilize JAGD 1617 fundsto purchase three(3)laptopcomputers,three(3)
covers,andthree(3)docksforpoliceofficers.Theequipment will makeitpossibleto access
necessary data at higher speeds,therefore increasing productivity.Funding will allow the South
Miami PoliceDepartmenttocontinueitseffortstoupgradeequipmentusedto manage criminal
justicedata,thusincreasingefficiencyand effectiveness.Inaddition,the computers will allowthe
officerstoreducetime needed to store dataandmaintainrecordkeeping.The equipment will
enable the South MiamiPolice Department to share informationwith other law enforcement
agencies moreefficientlyinanefforttoimprovethe management and maintenance ofcriminal
justice data.
Thisproject requests federal grant fundingforalaw enforcement-criminal justice technology
related projectandmaybe subject toreviewandapprovalbythe State Information Technology
(IT)PointofContact.By utilizing fundsforthisproject,thesubrecipientandimplementingagency
agree toconformtoall State andnational standards fortechnologyandinformation sharing
systems that connect to,and/or interface with State andnational systems,and/or reside onthe
State Criminal Justice Network(CJNet).These standards include,butarenotlimitedto,the FBI
CJIS SecurityPolicyandrules,regulationsorguidance enacted bythe Criminal andJuvenile
Justice Information System (CJJIS)Council under F.S.943.06.
Copies ofrequisitions,purchase orders,invoices,and cancelled checks will beprovided as proof
of equipment purchase.
All funds will be expended in accordance withFederal,State andlocalguidelinesand
purchasing/procurement procedures.Unitandtotal costs forequipment will beobtainedby
surveying competitive vendors.

Edward Byrne Memorial Justice Assistance Grant (JAG)Program
STANDARD CONDITIONS
The State ofFlorida,Department ofLaw Enforcement (FDLEor Department)isa recipient offederalJAG funds.
FDLE,as the non-federal pass-through entity and State Administering Agency (SAA)forthis program,subawards
JAG funds toeligibleunitsof government.All subawards made byFDLEtounitsof government under this program
require compliance withthe agreement and Standard Conditionsupon signed acceptance ofthe subaward.
Thefollowing terms and conditions will become bindingupon approval ofthe application or subaward,and completion
ofthe Certificate of Acceptance by the subrecipient.Asaunitof government,the subrecipient will maintain required
state and federal registrations and certificationsfor eligibility under thisprogram.For JAG-Countywide subawards,
the designated County Coordinator forlocalunitsof government will submit documentation in accordance withFlorida
AdministrativeCode 11D-9 supporting the strategic planningforallocationof these funds.The subrecipient agrees to
submit required programmatic and financial reports supporting that eligible activities were completed in accordance
with the grant and program requirements.
The Department willonly reimburse subrecipients for authorized activities.The Department willnot reimburse for
costs incurred for any purpose other than those specified inthe agreement.Failuretocomplywith provisions ofthis
agreement,orfailuretoperform grant activities as specified inthe agreement,will result in required corrective action
uptoandincludingfinancial consequences.Afinancial consequence maybe imposed for non-compliance in
accordance with2 CF.R.§200 and these Standard Conditions,includingbutnotlimitedtoproject costs being
disallowed,withholdingoffederalfundsand/orterminationoftheproject.

Subgrantees are strongly encouraged to submit annual (ormore frequent)JAG success stories.These success
stories highlight projects that have demonstrated success or shown promise in reducing crime and positively
impacting communities.They are a valuable resource for states,localities,territories,tribes and criminal justice
professionals who seek toidentify and learn about JAG and other successful BJA-funded projects linkedto
innovation,crime reduction,and evidence-based practices.Submit all success stories to OCJG for review and
submission.
Disallowed costs means those charges toa Federal award that the Federal awarding agency or pass-through entity
determines to be unallowable,in accordance with the applicable Federal statutes,regulations,or the terms and
conditions of the Federal award.
Equipment means tangible personal property(includinginformation technology systems)havingausefullifeofmore
than one year andaper-unitacquisition cost which equals or exceeds the lesser ofthe capitalization level
established bythe non-Federal entityforfinancial statement purposes,or $5,000.See also §§200.12,"Capital
assets";200.20,"Computing devices";200.48,"General purpose equipment";200.58,"Information technology
systems;200.89,"Special purpose equipment";and 200.94,"Supplies."
Grant agreement means alegal instrument offinancial assistance between a Federal awarding agency or pass-
throughentityand a non-Federalentitythat,consistent with31U.S.C.§§6302,6304,is used to enter intoa
relationshiptheprincipal purpose ofwhichisto transfer anythingofvaluefromthe Federal awarding agency or pass-
throughentitytothe non-Federal entitytocarryoutapublicpurpose authorized byalawoftheUnited States (see 31
U.S.C.§6101(3));andnotto acquire propertyor services fortheFederalawarding agency or pass-through entity's
direct benefit or use;and is distinguished froma cooperative agreement in that it does notprovidefor substantial
involvement between the Federal awarding agency or pass-through entityandthe non-Federal entityin carrying out
theactivity contemplated bythe Federal award.
Improper payment means any payment thatshouldnothave been made orthat was made inan incorrect amount
(including overpayments and underpayments)under statutory,contractual,administrative,or other legally applicable
requirements and;Improper payment includes any payment toanineligibleparty,any payment foranineligiblegood
or service,any duplicate payment,any payment fora good or service not received (except for such payments where
authorizedbylaw),anypaymentthat does not account forcreditfor applicable discounts,andany payment where
insufficientorlackof documentation prevents a reviewer from discerning whether a payment was proper.
Micro-purchase means a purchase of supplies or services usingsimplifiedacquisition procedures,the aggregate
amount of which does not exceed the micro-purchase threshold.The non-Federal entity uses such procedures in
orderto expedite thecompletionofitslowest-dollarsmall purchase transactions andminimizethe associated
administrative burden andcost.The micro-purchase threshold is set bythe Federal Acquisition Regulation at48
CF.R.Subpart 2.1,"Definitions".Itis $3,000 except as otherwise discussed in Subpart 2.1ofthatregulation,butthis
threshold is periodically adjusted forinflation.
ModifiedTotalDirect Cost (MTDC)means alldirect salaries and wages,applicablefringebenefits,materialsand
supplies,services,travel,anduptothefirst$25,000of each subaward (regardless oftheperiodofperformanceof
the subawards under theaward).MTDC excludes equipment,capital expenditures,charges forpatient care,rental
costs,tuition remission,scholarships andfellowships,participant support costs andtheportionof each subaward in
excess of $25,000.Otheritemsmayonlybeexcludedwhen necessary toavoida serious inequityinthedistribution
ofindirect costs,and withthe approval of the cognizant agency for indirect costs.
Non-Federal entity isa state,local government,Indiantribe,institutionofhigher education (IHE),ornonprofit
organization that carries outa Federal award as a recipient or subrecipient.
Non-federal pass-through entity isa non-Federal entitythatprovidesa subaward toa subrecipient tocarryoutpart
ofa Federal program;the Florida Department ofLaw Enforcement (FDLE)isthe non-federal pass-through entity for
this agreement,also referred to as the State Administering Agency (SAA).

Performance goal means a target levelof performance expressed as a tangible,measurable objective,against
which actual achievement can be compared,includingagoal expressed as a quantitative standard,value,orrate.In
some instances (e.g.,discretionary research awards),thismaybelimitedtothe requirement to submit technical
performance reports(tobe evaluated in accordance withagencypolicy).
Period of performance means thetimeduringwhichthenon-Federalentitymayincurnewobligationstocarryout
thework authorized under the Federal award.The Federal awarding agency or pass-through entity must include start
and end dates oftheperiodof performance inthe Federal award (See 2 CF.R.§§200.210(aX5),"Information
contained ina Federal award"and200.331(a)(1)(iv),"Requirements for pass-through entities").
Protected Personally Identifiable Information (Pll)means anindividual'sfirst name orfirst initial andlast name in
combination with any one or more of types ofinformation,including,butnotlimitedto social security numbers;
passport numbers;credit card numbers;clearances;bank numbers;biometrics;date and place ofbirth;mother's
maiden name;criminal,medical,andfinancial records;and educational transcripts.This does notincludePll that is
requiredbylawtobe disclosed.(See 2 CF.R.§200.79PersonallyIdentifiableInformation(Pll)).
Questioned cost meansacostthatisquestionedbytheauditor because ofanaudit finding 1)thatresulted from a
violationorpossible violation ofa statute,regulation,orthetermsandconditionsofaFederalaward,includingfor
fundsusedtomatchFederalfunds;2)wherethecosts,atthetimeoftheaudit,arenot supported by adequate
documentation;or3)wherethe costs incurred appear unreasonable anddonotreflecttheactionsaprudentperson
would take in the circumstances.
Simplifiedacquisition threshold meansthedollaramount below which a non-Federal entitymaypurchase property
or services usingsmall purchase methods.Non-Federalentitiesadoptsmall purchase procedures in order to
expeditethe purchase ofitemscostinglessthanthe simplified acquisitionthreshold.The simplified acquisition
thresholdis set bytheFederal Acquisition Regulationat48 CF.R.Subpart2.1 (Definitions)andin accordance with
41U.S.C.§1908.Asofthe publication ofthispart,the simplified acquisitionthresholdis$150,000,butthisthreshold
is periodically adjustedfor inflation.(Also see definition of Micro-purchase,2 CF.R.§200.67)
Subaward/Subgrant meansanawardprovidedbyapass-throughentitytoasubrecipientforthesubrecipientto
carryoutpartofaFederalawardreceivedbythepass-throughentity.It does not include payments toa contractor or
payments toan individual thatisabeneficiaryofaFederalprogram.A subaward maybeprovidedthroughanyform
oflegal agreement,including an agreement thatthepass-throughentityconsidersacontract.
Subrecipient meansanon-Federalentitythatreceivesasubaward from apass-throughentitytocarryoutpartofa
Federal program;butdoesnotincludean individual thatisa beneficiary ofsuch program.Asubrecipientmayalsobe
arecipientofotherFederal awards directlyfromaFederalawardingagency.
Supplies means alltangiblepersonalpropertyotherthanthosedescribedin2 CF.R.§200.33,"Equipment".A
computing deviceisasupplyifthe acquisition costislessthanthelesserofthe capitalization levelestablishedbythe
non-Federalentityfor financial statement purposesor$5,000,regardlessofthelengthofitsuseful life.(See 2 CF.R.
§§200.20,"Computing devices"and200.33,"Equipment.")

The subrecipient agrees tobe bound by the following standard conditions:
1.0 Payment Contingent on Appropriation and Available Funds -The State ofFlorida's performance and
obligationtopayunderthis agreement iscontingentuponanannualappropriationbytheFloridaLegislature.
Furthermore,theobligationofthe State ofFloridatoreimburse subrecipients forincurred costs is subject to
available federal funds.
2.0 System for Award Management (SAM)-The subrecipient mustmaintain current informationinSAMuntilit
submits thefinalfinancial report required under this award or receives thefinal payment,whichever is later.
This requires thatthe subrecipient reviewand update theinformation at least annually after the initial
registration,and more frequently if required by changes inits information or another awardterm.
2.1The recipient mustcomplywithanyandall applicable requirements regarding reportingofinformation
oncivil,criminal,and administrative proceedings connected with(or connected tothe performance of)
either this OJP awardor any othergrant,cooperative agreement,or procurement contract from the
federal government.Under certain circumstances,recipients of OJP awards are required to report
information about such proceedings,through thefederal System forAward Management (known as
"SAM"),tothe designated federal integrity and performance system (currently,"FAPIIS").
3.0 General Appropriations Law Restrictions -The subrecipient must comply withall applicable restrictions on
the use of federal funds set out in federal appropriation statutes.Pertinent restrictions inthe Consolidated
Appropriations Act,2016 are set out at http://oip.gov/fundinq/Explore/FY2016-
AppropriationsLawRestrictions.htm.Subrecipients must contact the OfficeofCriminal Justice Grants for
guidance should a question arise whether a particular use of federal funds bya subrecipient wouldorightfall
within the scope of an appropriations-law restriction,and maynot proceed without the express prior written
approval from the Department and federal awarding agency.
4.0 Commencement of Project -Ifaprojectisnotoperationalwithin60 days oftheoriginalstartdateofthe
award period,the subrecipient must report by letter to the Department the steps taken to initiate the project,
the reasons for delay,and the expected start date
4.1 If a project isnot operational within90 days of the original start date of the award period,the
subrecipient must submit a second statement to the Department explaining the implementation delay.
4.2 Upon receipt of the ninety (90)day letter,the Department shall determine if the reason for delay is
justifiedorshall,atitsdiscretion,unilaterally terminate this agreement and re-obligate subaward funds
to other Department approved projects.The Department,where warranted by extenuating
circumstances,may extend the starting date oftheproject past theninety(90)day period,butonlyby
formal written adjustment tothis agreement.
5.0 Supplanting -The subrecipient agrees that funds received under this award will not be used to supplant state
or local funds,but will be used to increase the amounts of such funds that would,in the absence of federal
funds,be made available for law enforcement activities.
6.0 Personnel Changes -Upon implementation of the project,inthe event there isa change inChiefOfficialsfor
the Subrecipient or Implementing Agency or any contact information to include mailing address,phone
number,email ortitle change,project staff must notify the SIMON help desk to update the organizational
information inSIMON.Project director changes require a grant adjustment inSIMON.
7.0 Non-Procurement,Debarment and Suspension -The subrecipient agrees to comply with Executive Order
12549,Debarment and Suspension and 2 CF.R.§180,"OMB Guidelines to Agencies on Government wide
Debarment and Suspension (Non-procurement)".These procedures require the subrecipient tocertify that it
shall not enter into any lower tiered covered transaction witha person who is debarred,suspended,declared
ineligibleorisvoluntarily excluded from participating inthis covered transaction,unless authorized bythe
Department.
8.0 Federal Restrictions on Lobbying -Each subrecipient agrees to comply with28 CF.R.§69,"New
Restrictions on Lobbying"and shall file the most current edition of the Certification And Disclosure Form,if
applicable,with each submission that initiates consideration of such subrecipient for award of federal contract,
grant,or cooperative agreement.

9.0 State Restrictions on Lobbying -Inadditiontotheprovisionscontainedabove,the expenditure offundsfor
thepurposeof lobbying thelegislatureora state agencyis prohibited underthisagreement.
10.0AdditionalRestrictionsonLobbying -The subrecipient understandsandagreesthatitcannotuseany
federalfunds,either directly or indirectly,insupportoftheenactment,repeal,modification or adoption ofany
law,regulationor policy,atanylevelofgovernment,withoutthe express priorwrittenapprovaloftheOffice of
Justice Programs.
11.0 "Pay-to-Stay"-Funds from thisawardmaynotbeusedtooperatea "pay-to-stay"program inanylocal jail.
Furthermore,nofundsmaybegiventolocaljailsthat operate "pay-to-stay"programs."Local jail",as
referencedinthiscondition,means anadult facility ordetention center ownedand/oroperatedbycity,county,
or municipality.It does notincludejuveniledetentioncenters."Pay-to-stay*programsasreferencedinthis
condition,meansaprogrambywhichextraordinaryservices,amenitiesand/oraccommodations,nototherwise
availabletothegeneralinmate population,maybe provided,baseduponanoffender'sapparent ability topay,
suchthatdisparateconditionsofconfinementarecreatedforthe same orsimilaroffenders within a jurisdiction.
12.0TheCoastalBarrier Resources Act -Thesubrecipient will complyand assure thecomplianceofall
contractorswiththeprovisionsoftheCoastalBarrierResourcesAct(Pub..LNo.97-348)dated October 19,
1982 (16 U.S.C §§3501et seq.)whichprohibitstheexpenditureofmostnewfederalfunds within theunitsof
the Coastal Barrier Resources System.
13.0 Enhancement of Security -If fundsareusedforenhancingsecurity,thesubrecipient agrees to:
13.1 Havean adequate process to assess theimpactofany enhancement ofaschoolsecurity measure that
is undertaken onthe incidence ofcrimeinthe geographic area where the enhancement is undertaken.
13.2 Conductsuchan assessment with respect toeachsuch enhancement;andsubmittothe Department

14.0 Background Check -Whenever abackgroundscreeningforemploymentorabackgroundsecuritycheckis
requiredbylawforemployment,unless otherwiseprovidedbylaw,theprovisionsof§435Fla.Stat,shall
apply.
14.1 AH positionsin programs providing care tochildren,the developmentally disabled,or vulnerable adults
for15hoursormoreperweek;all permanent and temporary employee positionsofthecentral abuse
hotline;and all persons working under contract who have access to abuse records are deemed tobe
persons and positions of special trust or responsibility and require employment screening pursuant to§
435,Fla.Stat.,usingthelevel2 standards set forthinthat chapter.
14.2 All employees inpositions designated bylaw as positionsoftrustorresponsibilityshallbe required to
undergo security background investigations as aconditionof employment and continued employment.
Forthe purposes ofthe subsection,securitybackground investigations shallinclude,butnotbelimited
to,employment history checks,fingerprintingforall purposes and checks inthis subsection,statewide
criminalandjuvenilerecord checks through theFlorida Department ofLaw Enforcement,and federal
criminalrecord checks throughthe Federal BureauofInvestigation,andmayincludelocalcriminal
record checks through locallaw enforcement agencies.
14.2.1 Any person whoisrequiredtoundergosuchasecuritybackgroundinvestigation and who
refuses to cooperate in such investigationor refuses tosubmitfingerprintsshallbedisqualified
for employment in such positionor,ifemployed,shallbe dismissed.
14.2.2 Such background investigations shallbe conducted atthe expense ofthe employing agency or
employee.When fingerprintingisrequired,thefingerprintsofthe employee or applicant for
employment shallbe taken bytheemploying agency orbyan authorized law enforcement
officer and submitted to the Department ofLaw Enforcement for processing and forwarding,
when requested bythe employing agency,totheUnited States Department of Justice for
processing.The employing agency shall reimburse the Department ofLaw Enforcement for
any costs incurred byitin the processing ofthe fingerprints.

15.0 Privacy Certification -The subrecipient agrees tocomplywithallconfidentiality requirements of42 U.S.C §
3789g and 28 CF.R.§22 that are applicable tocollection,use,and revelation of data orinformation.The
subrecipient further agrees,as a condition of grant approval,to submit a Privacy Certificate that isin accord
with requirements of28 CF.R.§§22and,in particular,22.23.Privacy Certification forms must be signed by
the subrecipient orimplementing agency chiefofficialoranindividualwithformal,written signature authority
for the chief official.
16.0 Conferences and Inspection of Work -Conferences maybeheld at the request of any partytothis
agreement.At any time,a representative of the Department,of the U.S.Department of Justice,or the Auditor
General ofthe State ofFlorida,have therightofvisitingtheprojectsitetomonitor,inspect and assess work
performed under this agreement.
17.0 insurance for Real Property and Equipment -The subrecipient must,ataminimum,provide the equivalent
insurance coverage forreal property and equipment acquired or improved with Federal funds as provided to
property owned bythe non-Federal entity.
1.0 Federal lawsprohibit recipients offinancial assistance from discriminating on the basis of race,color,national
origin,religion,sex,disability,or age in funded programs or activities.All subrecipients,implementing
agencies,and contractors must complywith any applicable statutorily-imposed nondiscrimination

2.0FDLE does not discriminate on the basis of race,color,religion,national origin,sex,disability,or age inthe
deliveryof services or benefits orin employment.The subrecipient must notify program participants and

and age in the delivery of services or benefits orin employment practices.
3.0 Subrecipients are responsible for ensuring that contractors and agencies towhom they pass through funds are
in compliance withallCivil Rights requirements.
4.0 Equal Employment Opportunity Plans
4.1 A subrecipient orimplementing agency must develop anEEOPlanifit has 50ormore employees and
has received any single awardof $25,000 or mare fromthe Department of Justice.Theplanmustbe
prepared usingtheonlineshortformat www.oip.usdoi.gov/about/ocr/eeop complv.htm,mustbe
retainedbythe subrecipient orimplementingagency,andmustbeavailableforrevieworaudit.The
organization must also submit anEEO Certification toFDLE,
4.2Ifthe subrecipient orimplementing agency isrequiredto prepare anEEOPlanand has received any
single award of $500,000 ormorefromthe Department of Justice,itmust submit itsplantothe
Department of Justice forapproval.Acopyofthe Department of Justice approval lettermustbe
submitted toFDLE.Theapprovalletter expires two years fromthe date oftheletter.
4.3A subrecipient orimplementing agency is exempt fromtheEEOPlan requirement ifitishasfewerthan
50 employees orifit does notreceiveanysingleawardof $25,000 ormorefromthe Department of
Justice orifitisanonprofit organization,amedicalor educational institution,oranIndianTribe.If an
organization is exempt fromtheEEOPlanrequirement,itmustsubmitanEEOCertificationtoFDLE.
4.4 The subrecipient and implementing agency acknowledge that failureto comply withEEO requirements
within60 days ofthe project start date mayresultin suspension or termination offunding,until such
time as itisin compliance.

5.0In the event a federal or state court,ora federal or state administrative agency,makes afindingof
discriminationaftera due process hearing onthe grounds of race,color,religion,nationalorigin,sex,or
disability against a recipient of funds,the recipient will forwarda copy ofthefindingtoFDLE and to the Office
forCivilRights,Officeof Justice Programs.
6.0In accordance with federal civilrightslaws,the subrecipient shallnot retaliate against individualsfor taking
action or participating in action to secure rights protected by these laws.
7.0 Subrecipients mustinclude comprehensive Civil Rights/Nondiscrimination Provisions inail contracts funded by
the subgrant recipient.
8.0If the subrecipient or any ofits employees,contractors,vendors,orprogram beneficiaries has a discrimination
complaint,theymay file acomplaintwiththe subrecipient,withFDLE,orwiththeOfficefor Civil Rights.

10.0 Thesubrecipientmusthave written policiesorproceduresinplacefor notifying programbeneficiarieshowto
filecomplaintsallegingdiscriminationbythe subrecipient/implementing agency with FDLE ortheOCR.
11.0 AnydiscriminationcomplaintsfiledwithFDLE will bereviewedbyFDLE's Inspector Generalandreferredto
theOfficefor Civil Rights,theFloridaCommissiononHumanRelations,ortheEqualEmploymentOpportunity
Commission,based onthe nature ofthecomplaint.
12.0 Americans with Disabilities Act -Subrecipients mustcomplywiththe requirements oftheAmericanswith
DisabilitiesAct (ADA)(Pub.L.No.101-336),which prohibits discrimination bypublicandprivateentitiesonthe
basisof disability andrequirescertainaccommodationsbemade with regardtoemployment (Title I),state and

16.0Equal Treatment forFaith Based Organizations -The subrecipient agrees tocomplywiththe applicable
requirements of28 CF.R.§38,the Department of Justice regulation governing "Equal Treatment for Faith
Based Organizations"(the"Equal Treatment Regulation").TheEqual Treatment Regulation provides inpart
that Department of Justice grant awards ofdirectfundingmaynotbe used tofundanyinherently religious
activities,such as worship,religiousinstruction,orproselytization.Recipients ofdirect grants maystill engage
in inherently religious activities,but such activities must be separate intimeor place fromthe Department of
Justice funded program,and participationin such activitiesbyindividualsreceiving services fromthe recipient
ora subrecipient must be voluntary.TheEqual Treatment Regulation also makes clear that organizations
participating in programs directly funded by the Department of Justice are not permitted to discriminate in the
provisionof services on the basis ofa beneficiary's religion.The subrecipient also understands and agrees
that award funds maynotbe used to discriminate against or denigrate thereligiousormoralbeliefsof students
who participate in programs forwhichfinancial assistance is provided from the award,or the parent or legal
guardian of such students.Notwithstanding any other special condition ofthis award,faith-based organizations
may,in some circumstances,consider religion as a basis for employment.See

17.0 immigration and Nationality Act -Nopublic funds will intentionally be awarded to any contractor who
knowingly employs unauthorized alien workers,constituting a violation of the employment provisions contained
in8U.S.C.§1324a(e),Section 274A(e)of the ImmigrationandNationalityAct ("INA").The Department shall
consider the employment by any contractor of unauthorized aliens a violation of Section 274A(e)of the INA.
Such violationbythe subrecipient ofthe employment provisions contained in Section 274A(e)oftheINAshall
be grounds for unilateral cancellation ofthis contract by the Department.
1.0 Fiscal Control and Fund Accounting Procedures
1.1 All expenditures and cost accounting offundsshall conform to the Officeof Justice Programs Financial
Guide,the Common Rule,and OMBUniform Grant Guidance (2 CF.R §200)as applicable,intheir
entirety.
1.2 Subrecipients must have written procedures for procurement transactions.Procedures must ensure
that all solicitations follow2 CF.R.§§200.319 "Competition"and 200.320 "Methods of Procurement".
1.3The subrecipient is required to establish andmaintain adequate accounting systems andfinancial
records andto accurately account forfunds awarded tothem.Asa subrecipient,youmust have a
financial management system inplacethatisabletorecordandreportonthereceipt,obligation,and
expenditure ofgrantfunds.An adequate accounting system fora subrecipient mustbeableto
accommodate afund and account structure to separately track receipts,expenditures,assets,and
liabilities for awards,programs,and subrecipients.
1.4 All funds spent onthisprojectshallbe disbursed accordingtoprovisionsoftheprojectbudget as
approved by the Department.
1.5 All funds not spent in accordance withthis agreement shallbe subject to repayment bythe subrecipient.

I.ONiy:SUBA
1.0 Obligation of Subrecipient Funds -Subaward fundsshallnot under any circumstances be obligated priorto
the effective date,or subsequent tothe termination date,oftheperiodof performance.Only project costs
incurred onor after the effective date,and onorpriorto the termination date of the subrecipient's project are
eligiblefor reimbursement.All payments must be completed withinthirty(30)days oftheendofthe subaward
period of performance.
2.0 Advance Funding -Advance funding may be providedtoa subrecipient uponawritten request to the
Department.The request mustbe electronically signed bythe subrecipient or implementing agency's Chief
Financial Officeror the Chief FinancialOfficer designee.
3.0 Trust Funds
3.1 The unitoflocal government must establish atrustfundinwhichto deposit JAGfunds.The trust fund
may ormaynot be an interest bearing account.
3.2The account may earn interest,butany earned interest mustbe used forprogram purposes and
expended before thefederal grant periodenddate.Any unexpended interest remaining at the end of
the federal grant period must be submitted totheOfficeofCriminal Justice Grants for transmittal to the
Bureau of Justice Assistance.
4.0 Performance
4.1 Subaward Performance -The subrecipient mustcomplywith state andfederal requirements for
subaward performance under 2 CF.R.§§200.76-77.The subaward shall describe thetimingand
scope of expected performance as related tothe outcomes intended to be achieved by the program.
Where appropriate,the subaward should providespecific performance goals,indicators,milestones,or
expected outcomes (suchasoutputs,orservicesperformedorpublic impacts ofanyof these)withan
expected timelinefor accomplishment.Submitted programmatic reports must clearly articulate,where
appropriate,performance duringtheexecutionoftheaward has meta standard against whichthe
subrecipient'sperformancecanbemeasured.Theserequirementsshouldbealigned with agency
strategic goals,strategic objectives,orperformancegoalsthatarerelevanttotheprogram.
4.2 Performance of Agreement Provisions -Intheeventofdefault;non-compliance;or violation ofany
provisionofthis agreement bythesubrecipient,the subrecipient's consultants andsuppliers,orboth,
theDepartmentshallimpose sanctions it deems appropriateincludingwithholding payments and
cancellation,termination,or suspension ofthe agreement inwholeorinpart.Insuchevent,the
Department shallnotifythe subrecipient ofitsdecisionthirty(30)daysin advance oftheeffectivedate
ofsuchsanction.Thesubrecipientshallbepaidonlyforthoseservicessatisfactorilyperformedpriorto
the effective date of such sanction.
5.0Grant Adjustments -Subrecipientsmustsubmitagrantadjustmentthrough SIMON formajorsubstantive
changes suchas:scope modifications or changes toprojectactivities,targetpopulations,service providers,
implementationschedules,projectdirector,designsorresearchplanssetforthintheapproved agreement,
andforanybudgetchangesthat affect acost category thatwasnot included inthe original budget.
Adjustments arealsorequiredwhenthere will beatransferof10%ormoreofthetotalbudgetbetweenbudget
categories,orthereisanindirectcostrate category change.
5.1Subrecipientsmaytransferupto 10%ofthe total budgetbetweencurrent,approvedbudgetcategories
withoutpriorapprovalaslongasthefundsaretransferredtoanexistinglineitem.
5.2Undernocircumstancescantransfersoffundsincreasethetotalbudgetedaward.
5.3 Requests for changes tothesubawardagreementmustbe electronically signedbythesubrecipientor
implementing agency's chief official orthechiefofficial's designee.
5.4 All requestsfor changes mustbesubmittedin SIMON nolaterthanthirty(30)days prior to.grant
expiration date.
6.0 Required Reports -All reportsmustrelatefinancialdatatoperformance accomplishments.Subrecipients
mustsubmitbothreportsonthe same reportingcycle.

6.1 Financial Expenditure Report
6.1.1 The subrecipient shall have a choice ofsubmitting either aMonthlyora Quarterly Project
ExpenditureReporttothe Department.Project Expenditure Reports are due thirty(30)days
aftertheendofthereportingperiod.Inaddition,ifthe subaward periodis extended,additional
Project Expenditure Reports shallbe submitted.
6.1.2 All project expenditures for reimbursement of subrecipient costs shallbesubmittedon the
ProjectExpenditureReportFormsprescribedandprovidedbytheOfficeofCriminal Justice
Grants(OCJG)throughtheSIMON (Subgrant Information Management Online)system.
6.1.3 All Project Expenditure Reports shallbe submitted insufficientdetailfor proper pre-audit and
post-audit.
6.1.4 Beforethe "final"ProjectExpenditureReport will be processed,the subrecipient shall submit to
the Department alloutstandingprojectreportsandmusthavesatisfiedall special conditions.
Failuretocomplywiththeaboveprovisionsshallresultinforfeitureof reimbursement.
6.1.5Reportsshallsubmittedevenwhennoreimbursementisbeing requested.
6.1.6 Thereportshallbeelectronicallysignedbythe subrecipient orimplementing agency's Chief
Financial Officer or the Chief Financial Officer's designee.
6.2 Project Performance Reports
6.2.1 The subrecipient shallsubmit Monthly orQuarterlyProject Performance ReportsinSIMON,
hereafter known as the Department,withinfifteen (15)days aftertheendofthereporting
period.In addition,ifthesubawardperiodis extended beyond the"original"project period,
additionalQuarterlyProject Performance Reports shallbe submitted.
6.2.2 FailuretosubmitQuarterly Performance Reportsthat are complete,accurate,andtimelymay
resultin sanctions,as specifiedin Section IV 4.2,Performance of Agreement Provisions.
6.2.3 Performance Reports mustincludea response toall objectives includedinyour subaward.A
detailed response isrequiredinthenarrativeportionforyes/no performance objectives.The
narrative must also reflecton accomplishments forthe quarter andidentify problems with
projectimplementationand address actionsbeingtakentoresolvetheproblems.Additional
informationmayberequiredif necessary tocomplywith federal reporting requirements.
6.2.4 Performance Reports maybesubmittedbytheProjectDirector,ApplicationManager,or
Performance Contacts.
6.3Project Generated Income (PGI)-All incomegeneratedasadirectresultofa subgrant projectshall
bedeemedprogramincome.Programincomemustbe accounted forandreportedin SIMON in
accordance with the OJP FinancialGuide (Section 3.4).
6.3.1 The subrecipient shallsubmitQuarterly PGI Earningsand Expenditures Reports tothe
Department within thirty (30)daysaftertheendofthe reporting periodcoveringsubaward
projectgeneratedincomeandexpendituresduringthepreviousquarter.Ifany PGI remains
unspent afterthesubaward ends,thesubrecipientmustcontinuesubmittingquarterlyPGI
reports untilall funds are expended.
6.3.2 PGI Earnings andExpenditurereportsmustbe electronically signed bythe subrecipient or
implementing agency's ChiefFinancialOfficerortheChiefFinancialOfficer's designee.
6.3.3Programincomeshouldbeusedasearnedand expended assoonaspossibleandusedto
further the objects inwhichthe award was made.Any unexpended PGI remaining atthe end
ofthe federal grant period must be submitted to OCJG for transmittal to the Bureau of Justice
Assistance.

6.4Law Enforcement Training -Anylaw enforcement agency receivingJAGfundingmust submit
quarterly accountability metrics data related totraining that officers have received onthe use of force,
racialand ethnic bias,de-escalation ofconflictand constructive engagement withthepublic.
6.5 Other Reports-The subrecipient shallreporttotheUniformCrime Report and other reports as maybe
reasonably required bythe Department.
1.0 Access to Records -The Florida Department ofLaw Enforcement,theAuditor General ofthe State ofFlorida,
theU.S.DepartmentofJustice,theU.S.Comptroller Generaloranyoftheirdulyauthorized representatives,
shallhave access tobooks,documents,papers andrecordsofthesubrecipient,implementing agency and
contractors forthe purpose ofauditandexaminationaccordingtotheFinancialGuideandthe Common Rule.
The Department reserves therighttounilaterallyterminatethis agreement ifthesubrecipient,implementing
agency,or contractor refuses toallowpublic access toall documents,papers,letters,or other materials
subject toprovisionsof§119,Fla.Stat.,unless specifically exempted and/or made confidentialby operation of
§119,Fla.Stat.,andmadeorreceivedbythesubrecipientoritscontractorinconjunctionwiththis agreement.
The subrecipient will givetheawarding agency ortheGeneralAccountingOffice,throughany authorized
representative,access toandtherightto examine all paper or electronic records relatedtothefinancial
assistance.
2.0 Monitoring -Therecipient agrees tocomplywithFDLE'sgrant monitoring guidelines,protocols,and
procedures;andto cooperate with FDLE onallgrant monitoring requests,including requests relatedtodesk
reviews,enhanced programmaticdeskreviews,sitevisits,and/orFlorida Department ofFinancial Services
contract reviewsand Expanded Auditsof Payment (EAP).Therecipient agrees toprovideFDLEall
documentation necessary tocompletemonitoringoftheawardandverify expenditures in accordance with§
215.971,Fla.Stat.Further,therecipient agrees toabideby reasonable deadlines set by FDLE forproviding
requested documents.Failureto cooperate withgrant monitoring activitiesmayresultin sanctions affectingthe
recipient's award,including,butnotlimitedto:withholding and/or other restrictionsonthe recipient's access to
funds,referraltotheOfficeoftheInspectorGeneralforauditreview,designation oftherecipient as a FDLE
HighRisk grantee,orterminationofaward(s).
3.0 Property Management -Thesubrecipientshallestablishandadministera system toprotect,preserve,use,
maintain,and dispose ofanypropertyfurnishedtoitbythe Department or purchased pursuant tothis
agreement according tofederalproperty management standards set forthintheOfficeof Justice Programs
FinancialGuide,U.S.Departmentof Justice CommonRuleforStateandLocalGovernments,or2 CF.R.§
200,asapplicable.Thisobligationcontinuesaslongasthesubrecipientretainstheproperty,notwithstanding
expiration ofthis agreemen.
3.1 Property Use -ThesubrecipientmustuseequipmentacquiredunderaFederalawardforthe
authorized purposes oftheprojectduringtheperiodofperformance,oruntilthepropertyisnolonger
needed.Subrecipients mustuse,manage,and dispose ofequipmentacquiredunderaFederalawardin
accordance with§274,Fla.Stat,and2 CF.R.§200.313,"Equipment".
4.0 Subaward Closeout -A Financial Closeout Audit shallbesubmittedtotheDepartment within forty-five (45)
daysoftheenddateoftheperformanceperiod.The Financial Closeout Audit mustbe electronically signedby
thesubrecipientor implementing agency'sChief Financial Officer ortheChiefFinancialOfficer'sdesignee.
5.0High Risk Subrecipients -Thesubrecipient agrees tocomplywithanyadditionalrequirementsthatmaybe
imposed duringthegrant performance periodifFDLE'spre-awardrisk assessment ortheU.S.Department of
Justicedeterminesthesubrecipientisa high-risk grantee.(28 CF.R.§§66,70)
6.0 Reporting,Data Collection and Evaluation -The subrecipient agrees tocomplywithallreporting,data
collectionandevaluation requirements,as prescribedbytheBureauof Justice Assistance inthe program
guidance forthe Justice Assistance Grant(JAG).Compliancewith these requirements will bemonitoredby
FDLE.

7.0 Retention of Records -The subrecipient shall maintain all records and documents foraminimumof five (5)
years fromthe date ofthefinalfinancial statement andbe available for audit and public disclosure upon
request ofduly authorized persons.The subrecipient shall comply with State of Florida General Records

8.0 Disputes and Appeals -The Department shall make its decision inwriting when responding toany disputes,
disagreements,or questions offactarising under this agreement and shall distribute its response toall
concerned parties.The subrecipient shall proceed diligentlywith the performance ofthis agreement according
to the Department's decision.If the subrecipient appeals the Department's decision,the appeal also shall be
made inwritingwithin twenty-one (21)calendar days tothe Department's clerk (agency clerk).The
subrecipient's rightto appeal the Department's decision is contained in§120,Fla.Stat.,and in procedures set
forthinFla.Admin.Code R.28-106.104.Failure to appeal withinthistime frame constitutes awaiverof
proceedings under §120,Fla.Stat.
9.0 Single Annual Audit
9.1 Subrecipients that expend $750,000 ormoreinayearin federal awards shall have asingle audit or
program-specific audit conducted for that year.The audit shall be performed in accordance with2
CF.R.§200(F)Audit Requirements and other applicable federal law.The contract forthis agreement
shall be identified in the Schedule of Federal Financial Assistance in the subject audit.The contract
shall be identified as federal funds passed through theFlorida Department ofLaw Enforcement and
include the contract number,CFDA number,award amount,contract period,funds received,and funds
disbursed.When applicable,the subrecipient shall submit an annual financialauditthat meets the
requirements of 11.45 and 215.97 §§Fla.Stat.,"Definitions;duties;authorities;reports;rules,"and
"FloridaSingleAuditAct"and RulesoftheAuditor General:Chapters 10.550 and 10.650,"Local
Governmental Entity Audits"and"FloridaSingleAuditActAuditsNonprofit and For-Profit
Organizations."
9.2A complete auditreport that covers anyportionoftheeffective dates ofthis agreement mustbe
submitted within30 days afteritscompletion,butnolaterthannine(9)months after theauditperiod.In
order tobe complete,the submitted report shallinclude any management letters issued separately and
management's written response toallfindings,includingauditreportand management letterfindings.
Incomplete audit reports willnotbe accepted bythe Department.
9.3Auditsshallbe completed byan Independent Public Accountant (IPA)and according to Generally
Accepted Government Auditing Standards (GAGAS).The IPA shallbe either aCertifiedPublic
Accountant ora Licensed Public Accountant.Subrecipients shall procureaudit services according to§
200.509,and include clear objectives and scope ofthe audit inadditionto peer reviewreportsto
strengthen audit quality and ensure effective use ofaudit resources.
9.4The subrecipient shallpromptlyfollow-upandtake appropriate corrective actionforanyfindingsonthe
auditreportin instances of noncompliance withfederallawsand regulations,includingbutnotlimitedto
preparation ofa summary schedule ofpriorauditfindings and a corrective action plan.Subrecipient
follow-uptoauditfindingsmustabideby requirements in2 CF.R.§200.511.
9.5 Subrecipient understands and agrees thatfederalawardingand pass-through entitiesmaywithhold
awardfunds,ormay impose other related requirements,if (as determined bythefederalawarding
agency or pass-through entity,the subrecipient does notsatisfactorilyandpromptly address
outstanding issues from audits requiredby2 CF.R.§200or terms ofthis subaward,orother
outstanding issues that arise in connection withaudits,investigations orreviewsofDOJ awards or
subawards.
9.6 Auditees must make copies availableforpublic inspection and ensure respective parts ofthereporting
package donotinclude protected personally identifiableinformation.Records shallbe made available
upon request fora period of three (3)years fromthe date the audit report is issued,unless extended in
writingby the Department.

9.7 Subrecipients that expend less than $750,000 in federal awards duringafiscal year are exempt from
the audit requirements of2 CF.R.§200(F)for that fiscal year.Inthis case,writtennotification,which
can bein the formof the "CertificationofAudit Exemption"form,shall be provided to the Department by
the Chief Financial Officer,or designee,that the subrecipient is exempt.This notice shall be provided
tothe Department no later than June 30following the end ofthefiscal year.
9.8Ifthis agreement is closed withoutan audit,the Department reserves the rightto recover any disallowed
costs identified in an audit completed after such closeout.
9.9 The Federal Audit Clearinghouse isthe repository of record for2 CF.R.§200(F).Audits performed as
a result ofthis requirement must be completed and submitted to the Federal Audit Clearinghouse within
the earlier ofthirty(30)calendar days afterreceiptofthe auditor's report(s),ornine(9)months afterthe
end of the audit period.Submissions must include required elements described in2 CF.R.§200,
Appendix X,on the specified DataCollectionForm(FormSF-SAC),and be signed bya senior level
representative or chief officialof the auditee.A scanned copy of the completed audit reports oralinkto

2.0 Federal Procedures -All procedures employed intheuseoffederalfundsforany procurement shall also be
according to28 CF.R.§66,"Uniform Administrative Requirements for Grants and Cooperative Agreements to
State and Local Governments",2 CF.R.§200.318,"General procurement standards",and Floridalawtobe
eligible for reimbursement.
3.0 Cost Analysis -A cost analysis mustbe performed bythe subrecipient ifthe cost orpriceis above the
simplifiedacquisition threshold of $150,000.Costs orprices based on estimated costs for contracts are

4.0 Allowable Costs -Allowance for costs incurredunderthe subaward shallbe determined according tothe

Guide,28 CF.R.§66,"Uniform Administrative Requirements forGrantsand Cooperative Agreements to State

4.1 All procedures employedintheuseoffederalfundsforany procurement shallbeaccordingto28
CF.R.§66,"UniformAdministrative Requirements for Grants and Cooperative Agreements to State
and Local Governments",2 CF.R.§200.420,"Considerations for selected itemsofcost";and Florida
lawtobeeligiblefor reimbursement.
4.2 Subrecipients eligibletousethe"deminimis"indirect cost rate described in2 CF.R.§200.414(f),and
that elects to use the "de minimis"indirect cost rate,must advise FDLE Office of Criminal Justice Grants
inwritingofbothits eligibility andelection,andmustcomplywithall associated requirements inthe
OMBUniform Requirements.The"deminimis"ratemaybe applied onlytomodifiedtotal direct costs
(MTDC).
4.3 Indirect cost proposals forlocal and state unitsof government must comply with2 CF.R.§200,
Appendix VII.

5.0 Unallowable Costs -Payments made for costs determined to be unallowable by either the Federal awarding
agency or the Department,either as direct or indirect costs,must be refunded (including interest)to the
Federal Government in accordance with instructions fromthe Federal agency that determined the costs are
unallowable unless Federal statute or regulation directs otherwise.See also Subpart D—Post Federal Award
Requirements and 2 CF.R.§§200.300-309.
5.1 Prohibited Expenditure List -Subaward funds maynotbe used for items that are listedon the
Prohibited Expenditure Listat the timeof purchase or acquisition.Recipient understands and agrees
that failureto comply with conditions related toProhibitedor Controlled Expenditures may result ina
prohibition from further Controlled Expenditure approval under this or other federal awards.The listof
prohibited expenditures maybe amended fromtimetotimewithoutanypriornotice.Thelistof

6.0 Controlled Expenditure List -Requests for acquisition ofitemson the Controlled Expenditure List must
receive explicit priorwritten approval fromFDLE and BJA.If award funds are approved and used for the
purchase or acquisition of any itemonthe Controlled Purchase List,the subrecipient must collect and retain
for3 years certain information about the use of 1)thefederally grant funded controlled equipment and2)any
other controlled equipment in the same category as the federally-acquired controlled equipment inthe
agency's inventory,regardless of source;and make thatinformation available toFDLE and BJAupon request.
No equipment ontheControlled Expenditure listthatis purchased or acquired under thisawardmay be
transferred orsoldtoathirdpartywithouttheprior approval and guidance fromFDLE and BJA.Failureto
complywithconditions related toProhibitedorControlled Expenditures mayresultinprohibitionfrom further

6.1The recipient understands that,pursuant to recommendation 2.1of Executive Order 13688,law
enforcement agencies that acquire controlled equipment through Federal programs must adopt robust
and specific written policies and protocols governing General Policing Standards and Specific
Controlled Equipment Standards.General Policing Standards includes policies on(a)Community
Policing;(b)ConstitutionalPolicing;and(c)CommunityInput and Impact Considerations.Specific
ControlledEquipment Standards includespoliciesspecifically related to(a)Appropriate Useof
ControlledEquipment;(b)Supervision ofUse;(c)Effectiveness Evaluation;(d)Auditingand
Accountability;and(e)Transparency andNoticeConsiderations.Upon OJP's request,therecipient
agrees toprovidea copy of the General Policing Standards and Specific Controlled Equipment
Standards,and any related policies and protocols.
6.2 Recipient understands and agrees thatfailuretocomplywith conditions related toControlled
Expenditures may result inaprohibitionfromfurtherControlled Expenditure approval underthisor other
federal awards.
6.3Recipient understands and agrees that,notwithstanding2CFR§200.313,no equipment listedonthe
Controlled Expenditure Listthatis purchased underthis award maybe transferred orsoldtoathird
party,except as described below:
6.3.1Agenciesmay transfer orsellanycontrolled equipment,except riot helmets andriot shields,to
aLaw Enforcement Agency (LEA)after obtainingpriorwritten approval fromBJA.Asa
conditionof that approval,theacquiringLEAwill berequiredto submit informationand
certificationstoBJA as ifitwas requesting approvalto use awardfundforthe initial purchase
of items on the Controlled Expenditure List.
6.3.2 Agencies may not transfer orsell any riot helmets orriot shields purchased under this award.
6.3.3 Agencies maynot transfer orsellanyControlled Equipment purchased under thisawardto
non-LEAs,with the exception offixedwingaircraft,rotarywingaircraft,and command and
control vehicles.Before any such transfer or sale is finalized,the agency must obtainprior
writtenapprovalfromBJA.All law enforcement-related and other sensitive orpotentially
dangerous components,andalllaw enforcement insignias andidentifying markings must be
removed prior to transfer or sale.
6.4 Recipient further understands and agrees tonotifyBJA prior to the disposal of any items on the
Controlled Expenditure List purchased under this award,and to abide by any applicable laws and
regulations in such disposal.

6.5 Unmanned Aerial Vehicles -The recipient agrees that awarded fundsmaynotbe expended on
unmanned aircraft,unmanned aircraft systems,oraerialvehicles(US,UAS,or UAV)unless theBJA
Directorcertifies that extraordinary andexigent circumstances exist,makingthem essential to the
maintenance ofpublic safety and good order.Additionally,anyfunding approved forthis purpose would
be subject to additional reporting,whichwouldbe stipulated byFDLE post award.
7.0 Review priorto Procurement -Subrecipients are encouraged to enter into state andlocal intergovernmental
agreements orinter-entity agreements where appropriate for procurement or use ofcommonor shared
goods/services.Subrecipients arealso encouraged touse excess andsurpluspropertyinlieuofpurchasing
new equipment and property when thisis feasible.
8.0 Sole Source -Iftheprojectrequiresa purchase of services orequipmentfroma sole source,the subrecipient
must complete the Sole Source Justificationfor Services andEquipmentForm.If the subrecipient isa state
agency andthecostisatleast $150,000,thentheagencymustsubmitacopyoftheapprovalfromthe
Department of Management Services (§287.057(5),Fla.Stat.).Sole Source formmustbe signed bythe
subgrant recipientorimplementing agency chief official oran individual withformal,written signature authority
for the chief official.
9.0 Personal Services -Subrecipientsmayusegrantfundsfor eligible personal services (salaries/benefitsand
overtime)andmustmaintaininternalcontrolsoversalariesandwages.The following requirementsapplyto
personal services paidwith subgrant funds:
9.1 Timesheets -Timesheetsmustbekeptforall project staffwhosehours will bechargedtotheproject.
The timesheets mustbesigned by.the supervisorandclearlyindicatehours spent onprojectactivities.
9.2 Additional Documentation -In accordance with§215.971,Fla.Stat.,theFlorida Department of
FinancialServicesmayrequiredocumentation validation thatpersonnel services wereperformedon
project-relatedactivitiesin accordance withthecontract agreement.
9.3 Protected personally identifiable information -The subrecipient shall take reasonable measures to
safeguardprotectedpersonally identifiable information andother information thepass-throughentity
designates as sensitive orthe subrecipient considerssensitive consistent withapplicable Federal,state,
local,andtriballawsregardingprivacyandobligationsof confidentiality.
9.4 Overtime forLaw Enforcement Personnel -Priorto obligating fundsfromthisawardtosupport
overtimebylaw enforcement officers,theU.S.DepartmentofJustice encourages consultationwithall
allied components ofthe criminal justicesystemintheaffectedjurisdiction.Thepurposeofthis
consultationistoanticipateandplanforsystemicimpactssuchas increased courtdocketsandthe
need for detention space.
9.5 Employees Working Solely onaSingleFederalAward -Foranypositionthatworks 100%of its time
onasinglefederalaward,theemployeemust certify that 100%ofhisorhertimewasspent working on
thatfederalaward.Thisrequirementappliestoboth full timeandparttimepositions regardless ofthe
percentage oftheposition'ssalarythatischargedtothegrant.The certification mustbesignedbyboth
theemployeeandtheemployee'sdirectsupervisor having firsthand knowledgeoftheworkperformed
bytheemployee.Theformsmustbesubmittedsemi-annuallyandmaynotbesignedpriortotheend
ofthereportingperiod.Certifications mustbeprovidedtocovertheentiregrantperiod
9.6Maximum Allowable Salary -Noportionofthesefederalgrantfundsshallbeusedtowardsanypartof
theannual cash compensation ofanyemployeeofthesubrecipientwhosetotalannual cash
compensation exceeds 110%ofthe maximum salarypayabletoamemberoftheFederal government's
SeniorExecutiveServiceatanagency with a Certified SESPerformance Appraisal Systemforthat
year.(ThesalarytableforSESemployeesmaybefoundat https://www.opm.gov/policv-data-

compensate an employee ata higher rate,provided the amount in excess ofthis compensation

announcement under which this award is made.
9.7 Percentage of Salary Funded-ForanypositionpreviouslyfundedwithJAGfunds,the percentage of
thesalarytobepaidmustnot exceed priorfunding percentage.

10.0 Contractual Services -The subrecipient must maintain written standards of conduct covering conflicts of
interest and governing the actions ofits employees engaged in the selection,award and administration of
contracts as described in2 CF.R.§200.318,"General procurement".
10.1 Requirements for Contractors of Subrecipients -The subrecipient assures the compliance of all
contractors withthe applicable provisions ofTitle I of the Omnibus Crime Control and Safe Streets Act
of 1968,as amended 42U.S.C.§3711 ;the provisions ofthe current editionof the Officeof Justice
Programs Financial Guide (http://oip.gov/financialquide/DOJ/index.htm);andall other applicable federal
and state laws,orders,circulars,or regulations.The subrecipient must pass-through all requirements
and conditions applicable tothe federal grant award/subaward to any subcontract.The term
"contractor"is used rather than the term "vendor"and means anentity that receives a contract as
defined in2 CF.R.§200.22,the nature ofthe contractual relationship determines thetypeof
agreement.
10.2 Approval of Consultant Contracts -The Department shall review and approve inwritingall consultant
contracts priorto employment ofa consultant whenthe consultant's rate exceeds $650 (excluding travel
and subsistence costs)per eight-hour day,or $81.25 perhour.A detailed justificationmustbe
submitted to and approved byFDLEpriortoobligationor expenditures of such funds.Approvalshallbe
based uponthe contract's compliance with requirements foundintheFinancial Guide,the Common
Rule,and in applicable state statutes.The Department's approval of the subrecipient agreement does
not constitute approval of consultant contracts.If consultants are hired through a competitive bidding
process (not sole source),the $650 threshold does notapply.
11.0 Travel and Training -The cost ofalltravelshallbe reimbursed according tothe subrecipient's writtentravel
policy.Ifthe subrecipient does nothaveawrittentravelpolicy,cost ofalltravel will be reimbursed according
to State ofFloridaTravel Guidelines,§112.061,Fla.Stat.Any foreign travel must obtain priorwritten
approval.
11.1 BJA or FDLE Sponsored Events -The subrecipient agrees to participate inBJA-or FDLE-sponsored
training events,technical assistance events,or conference heldbyFDLEorBJAor their designees,
upon FDLE's or BJA's request.
11.2 Expenses Related to Conferences,Meetings,Trainings,and Other Events -The subrecipient
agrees tocomplywithall applicable laws,regulations,policies,and guidance (includingspecific cost
limits,prior approval and reporting requirements,where applicable)governing the use of federal funds
for expenses related to conferences,meetings,trainings,and other events,includingthe provision of
food and/or beverages at such events,and costs of attendance at such events.Information on pertinent

11.3 Training and Training Materials -Any training ortraining materials that has been developed or

12.0 Publications,Media and Patents
12.1 Ownership of Data and Creative Material -Ownership of material,discoveries,inventions,and results
developed,produced,or discovered subordinate tothis agreement is governed bythe terms of the
Officeof Justice Programs Financial Guide (as amended),and theU.S.Department of Justice Common
Rulefor State and Local Governments,and 2 CF.R.§200.315 "Intangible Property,"as applicable.
12.2 Copyright -The awarding agency reserves a royalty-free,non-exclusive,and irrevocable license to
reproduce,publish,or otherwise use,and authorize others to use,for federal government purposes:
12.2.1 The copyright in any work developed under an award or subaward,and
12.2.2 Any rights of copyright to which a subaward recipient or subrecipient purchases ownership with
support funded under this grant agreement.

•12.3 Publication or Printing of Reports -Thesubrecipientshallsubmitforreviewandapproval one copyof

targeted dissemination date.The subrecipient understands and agrees thatanytraining materials

13.0 Confidential Funds and Confidential Funds Certificate -AsignedcertificationthattheProjectDirectoror
ImplementingAgencyChief Official has read,understands,and agrees toabidebyallconditionsfor
confidentialfundsas set forthintheeffectiveeditionofthe Office ofJusticePrograms Financial Guideis
requiredforallprojectsthatinvolveconfidentialfunds.Thesignedcertificationmustbesubmittedatthetime
of grant application.Thiscertificatecertifies the ProjectDirectorhasread,understands,and agrees toabideby
the provisionin Section 3.12oftheOfficeof Justice Programs FinancialGuide.Thisformmustbe submitted
uponapplicationifapplicable.ConfidentialFundscertificationsmustbesignedbythe subrecipient or

14.0 Task ForceTraining Requirement -Thesubrecipient agrees thatwithin120 days ofaward,each member of
alaw enforcement taskforcefundedwith these fundswhoisataskforce commander,agencyexecutive,task
force officer,orothertaskforcememberofequivalentrank,will completerequiredonline(internet-based)task
force training.ThetrainingisprovidedfreeofchargeonlinethroughBJA'sCenterforTaskForce Integrity and
Leadership (www.ctfli.org).All currentandnewtaskforce members arerequiredtocompletethistrainingonce
duringthelifeoftheaward,oronceeveryfouryearsif multiple awardsincludethisrequirement.Thistraining
addresses task force effectiveness aswell as otherkey issues includingprivacyand civil liberties/rights,task
force performance measurement,personnelselection,andtaskforceoversightandaccountability.When
FDLE awards fundsto support ataskforce,the subrecipient mustcompileandmaintainataskforce personnel

15.0 Information Technology Projects
15.1 Criminal Intelligence Systems -The subrecipient agrees that any information technology system
funded or supported by the Officeof Justice Programs funds will comply with28 CF.R.§23,Criminal
Intelligence Systems Operating Policies,if the Officeof Justice Programs determines this regulation to
be applicable.Should the Officeof Justice Programs determine 28 CF.R.§23tobe applicable,the
Officeof Justice Programs may,atits discretion,perform audits of the system,as per28 CF.R.§
23.20(g).Should any violationof28 CF.R.§23 occur,the subrecipient may befined as per 42 U.S.C.
§3789g(c)-(d).The subrecipient maynot satisfy such afinewith federal funds.
The subrecipient understands and agrees that no awarded funds may be used to maintain or establish
a computer network unless such network blocks theviewing,downloading,and exchanging of
pornography.In doing so the subrecipient agrees that these restrictions will not limit the use of awarded
funds necessary for any federal,state,tribal,orlocallaw enforcement agency orany other entity

15.2 State Information Technology Point of Contact -The subrecipient agrees that the State Information
Technology Pointof Contact receives writtennotification regarding any information technology project
funded bythisgrantduringtheobligationand expenditures period.Thisistofacilitate communication
among localand state governmental entities regarding various information technology projects being
conducted with these grant funds.
15.2.1 In addition,the subrecipient agrees to maintain an administrative file documenting the meeting
of this requirement.Alistof State Information Technology Points of Contact may be found at
www.it.oip.qov/technoloqy-contacts.
15.2.2 Toavoid duplicating existing networks orIT systems in any initiatives funded bythe Bureau of
Justice Assistance forlaw enforcement information sharing systems whichinvolve interstate
connectivity between jurisdictions,such systems shall employ,to the extent possible,existing
networks as the communication backbone to achieve interstate connectivity,unless the
subrecipient can demonstrate to the satisfaction of the Bureau of Justice Assistance that this
requirement wouldnotbe cost effective orwould impair the functionality ofan existing or
proposed IT system.
15.3 ADP Justification -The subrecipient must complete an Automated Data Processing (ADP)Equipment
and Software and Criminal Justice Information and Communication Systems Request for Approval form
if the purchase of any ADP equipment istobe made.Thisform must be submitted upon application,if
applicable.ADP justification must be signed bythe subrecipient or implementing agency chief officialor
an individualwithformal,written signature authority for the chief official.
16.0 Interoperable Communications Guidance
16.1 Subrecipients that are using fundsto support emergency communications activities must comply with
the current SAFECOM Guidance for Emergency Communication Grants,including provisions on
technical standards that ensure and enhance interoperable communications.Emergency
communications activities include the purchase of Interoperable Communications Equipment and
technologies such as voice-over-intemet protocolbridgingor gateway devices,or equipment to support
thebuild out of wireless broadband networks inthe700MHzpublic safety band under the Federal
Communications Commission (FCC)Waiver Order.SAFECOM guidance may befoundat
www.dhs.qov/safecom.
16.2 Subrecipients interested in developing apublic safety broadband networkin the 700MHz band intheir
jurisdictions must adhere tothe technical standards set forthin the FCC Waiver Order,or any
succeeding FCC orders,rules,or regulations pertaining to broadband operations in the 700MHzpublic
safety band.The subrecipient shall also ensure projects support the Statewide Communication
interoperability Plan (SCIP)and are fully coordinated withthefull-time Statewide Interoperability
Coordinator (SWIC).Ifanyfutureregulatoryrequirement(fromtheFCCor other governmental entity)
results inamaterial technical orfinancial change intheproject,therecipient should submit associated
documentation,and other material,as applicable,for review by the SWIC to ensure coordination.
Subrecipients must provide alistingofall communications equipment purchased with grant award
funding(plusthe quantity purchased of each item)toFDLE once items are procured duringanyperiodic
programmatic progress reports.

must bein place forat least alluniformedofficersbeforefunding can be used by the agency forbody
armor.There are no requirements regarding the nature ofthepolicy other than itbeinga mandatory

1.2BVP Program -JAGfundsmaybe used to purchase armorforan agency,butmaynotbe used asthe

1.3 NIJ Compliance -Body armor purchased withJAGfundsmaybe purchased atany threat level,make,
ormodelfrom any distributor or manufacturer,as long as the vests have been tested and foundto
comply with applicable National Institute of Justice ballisticor stab standards and are listed on the NIJ
CompliantBodyArmorModelList (http://nii.gov).In addition,bodyarmor purchased mustbeAmerican-

1.4 Body Worn Camera Certification -Any subrecipient who wishes to use JAGfundsto purchase BWC
equipment,orto implement or enhance BWC programs,must certify that they orthelaw enforcement
agency receiving the BWCfunding have policiesand procedures in place related to equipment usage,
data storage,privacy,victims,access,disclosure,andtraining.FormoreinformationonBWC
requirements,example policies,and best practices,visit https://www.bia.gov/bwc/.
2.0 Environmental Protection Agency's (EPA)list of Violating Facilities -The subrecipient assures thatthe
facilities under its ownership,lease or supervision whichshallbeutilizedinthe accomplishment ofthe
Program Purpose are notlistedontheEPA'slistof Violating Facilitiesandthatit will notifythe Department of
the receipt of any communication from the DirectoroftheEPAOfficeof Federal Activitiesindicating that a
facilitytobeusedintheprojectisunderconsiderationfor listing bytheEPA.
3.0 National Environmental Policy Act (NEPA)
3.1 The subrecipient agrees to assist FDLEincomplyingwiththeNEPA,theNationalHistoric Preservation
Act,andotherrelatedfederalenvironmentalimpact analyses requirements inthe use of subaward
fundsbythe subrecipient.This applies tothe following newactivities whether ornotthey are being
specificallyfundedwith these subaward funds.Thatis,it applies as long as theactivityisbeing
conducted bythe subrecipient or any thirdpartyandtheactivity needs tobe undertaken in order to use
these subaward funds.Accordingly,thesubrecipient agrees tofirst determine ifanyofthe following
activities will befundedbythegrant,priortoobligatingfundsforanyof these purposes.Ifitis
determined thatanyofthe following activities will befundedbythegrant,therecipient agrees tocontact
FDLE OCJG.
1.1.1 New construction
1.1.2 Minor renovation orremodelingofaproperty either (a)listedonoreligibleforlistingonthe
National Register ofHistoric Places or(b)locatedwithina 100-year floodplain;a wetland,or
habitatfor endangered species,orapropertylistedonoreligibleforlistingontheNational
Register of Historic Places;
1.1.3 A renovation,lease,or any other proposed use ofabuildingorfacility that will either (a)result
ina change inits basic prior use or(b)significantly change its size;and
1.1.4 Implementation ofanew program involving the use of chemicals other than chemicals thatare
(a)purchased as anincidental component ofa funded activity and (b)traditionally used,for
example,in office,household,recreational,or educational environments.

1.1.5 Implementation ofaprogramrelatingto clandestine methamphetamine laboratory operations,
includingtheidentification,seizure,orclosureof clandestine methamphetamine laboratories.
3.2The subrecipient understands and agrees that complying withNEPAmayrequirethe preparation ofan
Environmental Assessment and/oran Environmental ImpactStatement,asdirectedbytheBureauof
Justice Assistance.The subrecipient further understands and agrees tothe requirements for
implementationofa Mitigation Plan,asdetailedbythe Department of Justice at
www.bia.gov/Fundinq/nepa.html,for programs relatingto methamphetamine laboratory operations.
3.3Foranyofa subrecipient's existing programs oractivitiesthat will befundedby these subawards,the
subrecipient,upon specific request fromthe Department and theU.S.Department of Justice,agrees to
cooperate withthe Department of Justice inany preparation by the Department of Justice ofa national
or program environmental assessment of that funded program oractivity.
4.0 Methamphetamine Plans:Mitigation of Health,Safety and Environmental risks dealing with
Clandestine Methamphetamine Laboratories -Ifanawardis made to support methamphetamine laboratory
operations the subrecipient must complywiththiscondition,which provides forindividualsite environmental
assessment/impact statements as required under theNational Environmental PolicyAct.
4.1 General Requirement:The subrecipient agrees tocomplywithfederal,state,andlocal environmental,
health and safety laws and regulations applicable tothe investigation and closure of clandestine
methamfShetamine laboratoriesandthe removal anddisposalofthechemicals,equipment,andwastes
used inor resulting from the operation of these laboratories.The subrecipient also agrees to complete
a Methamphetamine MitigationPlan(MMP)that includes the nine protective measures or components
required byBJA and submit theplantoFDLE'sOfficeofCriminal Justice Grants.
4.2 Specific Requirements:The subrecipient understands and agrees that any program orinitiative
involvingthe identification,seizure,or closure of clandestine methamphetamine laboratories can result
in adverse health,safety and environmental impacts to(1)thelaw enforcement and other governmental
personnel involved;(2)any residents,occupants,users,and neighbors of the site ofa seized
clandestine laboratory;(3)the seized laboratory site's immediate and surrounding environment ofthe
site(s)where any remaining chemicals,equipment,and waste froma seized laboratory's operations are
placed or come to rest.Therefore,the subrecipient further agrees that in order to avoid or mitigate the
possible adverse health,safety and environmental impactsfromanyof clandestine methamphetamine
operations funded under this award,itwill (1)include thenine,below listed protective measures or
components;(2)provide fortheir adequate fundingto include funding,as necessary,beyond that
providedbythis award;and (3)implement these protective measures directly throughout thelifeof the
subaward.In so doing,the subrecipient understands that it may implement these protective measures
directly through the use ofitsown resources and staff or may secure thequalified services of other
agencies,contractor or other qualifiedthirdparty.
4.2.1 Provide medical screeningofpersonnelassignedortobeassignedbythesubrecipienttothe
seizure or closure of clandestine methamphetamine laboratories;
4.2.2 Provide Occupational Safety and Health Administration (OSHA)required initial and refresher
trainingforlaw enforcement officialsand other personnel assigned by the subrecipient to either
the seizure or closure of clandestine methamphetamine laboratories;
4.2.3 As determined bytheir specific duties,equip personnel assigned tothe project withOSHA
required protective wear and other required safety equipment;
4.2.4 Assign properly trained personnel to prepare a comprehensive contamination reporton each
closed laboratory;
4.2.5 Employqualified disposal contractors toremoveall chemicals and associated glassware,
equipment,and contaminated materials and wastes from the site(s)of each seized clandestine
laboratory;
4.2.6 Dispose of the chemicals,equipment,and contaminated materials and wastes removed from
the sites of seized laboratories at properly licensed disposal facilitiesor,when allowable,
properly licensed recyclingfacilities;

4.2.7 Monitorthetransport,disposal,andrecycling components of subparagraphs 4.2.5and4.2.6
immediately above in order to ensure proper compliance;
4.2.8 Haveinplaceandimplementaninter-agency agreement orotherformofcommitmentwitha
responsible State environmental agency that providesforthat agency's 1)timely evaluation of
the environmental conditionsatandaroundthesiteofaclosed clandestine laboratory and2)
coordination with the responsible party,propertyowner,or others to ensure that any residual
contamination is remediated,if necessary,and in accordance with existing federal and state
requirements;and
4.2.9 Haveinplaceandimplementawritten agreement withthe responsible state orlocal service
agencies toproperly respond to any minor,as defined by state law,at the.site.This
agreement must ensure immediate response byqualified personnel who can 1)respond tothe
potentialhealth needs ofanyminoratthesite;2)takethatminorintoprotective custody unless
theminoris criminally involvedinthe m'eth labactivitiesoris subject to arrest for other criminal
violations;3)ensure immediate medicaltestingfor methamphetamine toxicity;and 4)arrange
for any follow-upmedical tests,examinations,orhealthcare made necessary as a result of
methamphetamine toxicity
5.0 National Historic Preservation Act -TheAct will assist the Department (if necessary)in assuring
compliance with section 106oftheNationalHistoric Preservation Actof1966(16 U.S.C §470),Executive
Order 11593 (identificationandprotectionofhistoric properties),theArcheologiealandHistorical Preservation
Actof1974(16U.S.C.§§469 a-1,et seq.),andtheNationalEnvironmentalPolicyActof1969(42U.S.C.§
4321).
6.0.Human Research Subjects -Subrecipient agrees tocomplywiththe requirements of28 CF.R.§46andall
Officeof JusticePrograms policiesand procedures regarding theprotectionof human research subjects,
including obtainment ofInstitutionalReviewBoard approval,if appropriate,and subject informed consent.
7.0 Trafficking in Persons -The subrecipient must complywith applicable requirements pertainingtoprohibited
conduct relatingto the traffickingof persons,whether onthepartof recipients,subrecipients or individuals
defined as "employees"ofthe subrecipient.Thedetailsof the recipientand subrecipient obligations related to
prohibited conduct related totraffickingin persons are incorporated by reference and posted at
www.oip.qov/fundinq/Explore/ProhibitedConduct-Traffickinq.htm.
8.0 Global Standards Package -In order to promote information sharing and enable interoperability among
disparate systems across the justice andpublic safety community,OJP requires the recipient to comply with
DOJ's GlobalJustice Information Sharing Initiative (DOJ'sGlobal)guidelinesandrecommendationsforthis
.particular grant.Recipient shallconformtotheGlobal Standards Package (GSP)and all constituent elements,
where applicable,as described at:www.it.oip.gov/qsp qrantcondition.Recipient shall document planned
approaches to information sharing and describe compliance to the GSP and appropriate privacypolicy that
protects shared information,orprovide detailed justificationforwhy an alternative approach is recommended.
9.0 Disclosures
9.1 Conflict of Interest -The subrecipient and implementing agency will establish safeguards toprohibit
employees from using their positions fora purpose that constitutes or presents the appearance of
personal or organizational conflictof interest,or personal gain.Subrecipients must disclose inwriting
any potential conflictof interest toFDLE(the non-federal pass-through entity).
9.2 Violations of Criminal Law -The subrecipient andimplementing agency must disclose allviolationsof
state or federal criminallawinvolvingfraud,briberyorgratuity violations potentially affecting the sub
award.
9.3 Sanctuary Cities -The subrecipient andimplementing agency mustcertify compliance with8 U.S.C §
1373.The subrecipient andimplementing agency must agree tonotifingFDLE(the non-federal pass-
through entity)inwritingof any potential violationsof8 U.S.C §1373.

10.0 Uniform Relocation Assistance and Real Property Acquisitions Act -The subrecipient will comply withthe
requirements ofthe Uniform Relocation Assistance andRealPropertyAcquisitionsActof1970(42 U.S.C.§§
4601,et seq.),which governs the treatment of persons displacedasaresultoffederaland federally-assisted
programs.
11.0 Limitations on Government Employees Financed by Federal Assistance -The subrecipient will comply
with requirements of5U.S.C.§§1501-08 and 7324-28,whichlimit certain political activities of State or local
government employees whose principal employment isin connection withanactivityfinancedinwholeorin
part by federal assistance.
12.0 Reporting Potential Fraud,Waste,Abuse,and Similar Misconduct -The subrecipient mustpromptlyrefer
toDOJOfficeofInspector General (OIG)andtheFloridaDepartmentofLawEnforcement,OfficeofCriminal
Justice Grants any credible evidence that aprincipal,employee,agent,contractor,subcontractor,or other
person has either 1)submitted aclaimfor grant funds that violates the False Claims Act;or2)committed a
criminalorcivilviolationof laws pertaining to fraud,conflictof interest,bribery,gratuity,or similar misconduct
involving grant funds.
13.0 Restrictions and certifications regarding non-disclosure agreements and related matters -
Subrecipients or contracts/subcontracts under this award may not require any employee or contractor to sign
aninternalconfidentiality agreement or statement thatprohibits,restricts or purports toprohibitor restrict,the
reporting of waste,fraudor abuse in accordance withlaw,toan investigative orlaw enforcement
representative ofa state or federal department or agency authorized to receive such information.
The subrecipient certifies that ifis informed ornotifiedif any subrecipient,or contractor/subcontractor has been
requiring their employees to executeagreements or statements that prohibit the reporting of fraud,waste,or
abuse that itwill immediately cease allfurther obligations of award funds to the entityand will immediately
notifythe awarding agency.The subrecipient will not resume obligations until expressively authorized todoso
from the awarding agency.
14.0 Funds to Association of Community Organizations for Reform Now (ACORN)Unallowable -
Subrecipient understands and agrees thatit cannot use any federal funds,either directlyorindirectly,in
support of any contract or subaward to either the Association of Community Organizations forReformNow
(ACORN)orits subsidiaries,withoutthe express priorwritten approval of OJP.
15.0 Text Messaging While Driving -Pursuant to Executive Order 13513,"Federal Leadership on Reducing Text
Messaging While Driving",74Fed.Reg.51225 (October 1,2009),and§316.305,Fla.Stat..,the subrecipient
is encouraged to adopt and enforce policies banning employees fromtext messaging whiledriving any vehicle
duringthe course ofperformingworkfundedbythis subaward and to establish workplace safety policies and
conduct education,awareness,and other outreach to decrease crashes caused by distracted drivers.
16.0 DNA Testing of Evidentiary Materials and Upload of DNA Profiles toa Database -If JAGprogramfunds
will be used for DNA testingofevidentiarymaterials,anyresultingeligibleDNAprofilesmustbe uploaded to
the Combined DNA Index System (CODIS),bya government DNAlabwith access to CODIS.Noprofiles
generated withJAGfundingmaybe entered into any other non-governmental DNA database withoutprior
express written approval fromBJA.In addition,funds maynotbe used for purchase ofDNA equipment and
supplies whentheresultingDNAprofilesfromsuchtechnology are not accepted forentryintoCODIS(the
NationalDNA Database operated bytheFBI).
17.0 Environmental Requirements and Energy -For subawards in excess of $100,000,the subrecipient must
complywithallapplicable standards,orders,orrequirementsissuedundersection306oftheCleanAirAct(42
U.S.C.§1857(h)),section508oftheCleanWaterAct(33U.S.C.§1368),ExecutiveOrder 11738,and
EnvironmentalProtectionAgencyregulations(40 CF.R.§15).The subrecipient mustcomplywith mandatory
standards andpoliciesrelatingtoenergyefficiencywhicharecontainedinthe state energy conservationplan
issuedincompliance with theEnergyPolicyandConservationAct(Pub.L94-163,89Stat.871),ifany.
18.0 Other Federal Funds -The subrecipient agrees thatifitcurrentlyhasanopenawardoffederalfundsorifit
receives anawardoffederalfundsotherthanthisaward,and those awards have been,arebeing,or are tobe
used,inwholeorinpart,foroneormoreofthe identical costitemsforwhichfundsarebeingprovidedunder
this award,the subrecipient will promptlynotify,inwritingthe grant manager forthis award,and,if so
requested byOCJGseekabudget modification orchangeofproject scope grantadjustment notice.(GAN)to
eliminateany inappropriate duplicationoffunding.
