Dixie Highway. BACKGROUND: Located in the General Retail ((GR" zoning district, the applicant is proposing to expand the existing animal hospital in the commercial building located at 6394-6396 S. Dixie Highway. Previously, the applicant applied for and was granted special use approval via Resolution #016- 16-14571 to operate an animal hospital at 6396 S. Dixie Highway which was previously occupied by a car rental agency. This special use approval was extended on January 17, 2017 via Resolution #005-17-14806. At this time, the applicant is requesting special use approval for a second expansion that would increase the size of the hospital. Pursuant to the regulations listed in the Permitted Uses, Section 20-3.3(D) of the Land Development Code (LDC), a special use permit is required for the operation of an animal hospital/veterinarian in the GR zoning district. REQUEST: South Veterinary Referral Center, the applicant, is requesting approval to expand an existing animal hospital/veterinarian use at 6394-6396 S. Dixie Highway. ANALYSIS: Pursuant to the Special Use Conditions, Section 20-3.4 of the LDC, a special use may be approved and permitted by the City Commission at a public hearing, after a recommendation by the Planning Board, provided that such use complies with the general requirements, special requirements, and any other conditions that the City Commission may consider appropriate and necessary. When reviewing the project, the following items are noted: • Resolution #04-07-12389 originally granted approval of the animal hospital/veterinarian at 6394 S. Dixie Highway . • The uses surrounding the property are as follows: o North -Banking Institution o South -Banking Institution/Retail o East -Multi-Family Residential o West (Across US-1) -Single Family Residential Special Use -Animal Hospital 6394-6396 S. Dixie Highway April 4, 2017 Page 2 0/5 • Resolution #016-16-14571 approved the expansion of the animal hospital into the tenant space located at 6396 S. Dixie Highway . • Pursuant to the attached plans, the proposed expansion consists of the extension of the ground floor space at the rear of the property as well as a second floor addition. The sizes of the different spaces are as follows: o Existing Ground Floor Space: 3,361 S.F. o Proposed Ground Floor Addition: 800 S.F. o Proposed Second Floor Addition: 947 S.F. o Proposed 2nd Floor Open Terrace: 181 S.F. Because the building was constructed in 1953, it is considered to be a legal-nonconforming structure. Pursuant to Section 20-4.8(B) ofthe LDC, Special Use -Animal Hospital 6394-6396 S. Dixie Highway April 4, 2017 Page 3 0/5 1. A structure which was erected in conformance with the applicable dimensional requirements in effect at the time of erection but which at a subsequent date fails to conform to applicable dimensional requirements due to a change in the zoning map, in the dimensional requirements table or in the text of this Code, may continue to be used for any use permitted in the district in which it is located, subject to the requirements of this section. 2. The following requirements shall apply to such structures: a. Use of such structures shall be consistent with parking standards applicable on the first date of such use; and b. In the event of any remodeling or rebuilding, the remodeling or rebuilding shall not increase the extent of nonconformity with any dimensional requirement. Because the proposed addition does not increase the extent of the nonconformity, it is considered acceptable and does not prevent the expansion or require any further zoning action. As shown on the attached Ground Floor Plan, sheet A-2, the applicant is proposing to expand from the rear of the building so that new procedure rooms can be created. All administrative offices will be relocated to the second floor area, thereby making room for additional procedures. Last, a new open terrace at the second floor will be constructed. This terrace is partly due to requirements from Miami-Dade County Fire Department. PARKING SPACE ANALYSIS Pursuant to Section 20-3.3(D} and Section 20-4.4(B)(12} ofthe LDC, the parking condition for an animal hospital/veterinarian is as follows: • One (1) space per four hundred (400) square feet of gross floor area. Animal Hospital/Veterinarian Use Parking Space Requirement 5,108 S-.F-. 1 Parking Space 1 x = 12.77 Parking Spaces ~ 13 Parking Spaces 400 S-.F-. Based on the calculations listed above, thirteen (13) parking spaces will be required for both the existing animal hospital and its proposed addition. As shown on the attached site plan, sheet A-1, twenty-four (24) parking spaces are available for the exclusive use of the animal hospital. Therefore, the parking requirement for the animal hospital will be satisfied. Special Use -Animal Hospital 6394-6396 S. Dixie Highway April 4, 2017 Page 4 0/5 SPECIAL USE ApPROVAL After review of the project, the proposed animal hospital use complies with both the general and special requirements listed in both Section 20-3.4(A} and Section 20-3.4(B)(21} of the LDC, respectively, in that the use: • Is compatible and complementary to the existing uses within the surrounding areas; • All such uses shall be located within a fully enclosed, air-conditioned, soundproof structure. • There shall be no overnight boarding of animals except for medical purposes. • The hours of operation for visits and treatment will be 7:00 a.m. to 9:00 p.m. Monday through Saturday; hours of operation shall not prevent emergency medical treatment. Furthermore, the requested special use does not conflict with the Comprehensive Plan and complies with the LDC requirements set forth in Section 20-5.8(B)(1} ofthe LDC in that the use: a. Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, b. Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c. Complies with all other applicable Code provisions. Last, if the special use is, in the future, determined by the Director of Planning to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental to the public welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the special use approval may be modified or revoked by the City Commission upon notification and public hearing. STAFF RECOMMENDATION: Staff recommends approval of the Special Use Permit application by the City Commission. This approval should be subject to the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations: 1. Adhere to the Special Conditions applicable in Section 20-3.4(B)(21} Animal Hospital/Veterinarian and Section 20-5.8 Special Use Approval of the Land Development Code; 2. The approved special use shall lapse after six (6) months if no master building permit which implements the special use or certificate of occupancy has been issued for such use and if the City Commission has not specified a longer approval period for good cause. 3. If required by the Code, any and all exterior renovations or modifications for the new establishment are subject to approval by the ERPB. Special Use -Animal Hospital 6394.6396 S. If the subject animal hospital/veterinarian is, in the future, determined by the Director of Planning, to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental to the pUblic welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the special use approval may be modified or revoked by the City Commission upon notification and public hearing. PLANNING BOARD ACTION: After the public hearing held at the Planning Board's March 14, 2017 meeting, the Board unanimously recommended approval ofthe application, subject to Staff's terms and conditions.
