SUBJECT: A Resolution authorizing a temporary change in the permitted hours of
construction operations of Florida Power & Light (FPL) to perform work on SW
62 Avenue, between SW 70th Street and South Dixie Highway.
BACKGROUND: Ordinance No. 5-15-2212 prohibits construction activity to take place during
night hours from 6:00 PM though 7:00 AM. FPL is transferring / replacing
existing transmission line concrete poles along the east side of SW 62 Avenue as
per the City's request to comply with ADA requirements to allow safe passage of
bicycles and pedestrians.

Due to Heavy traffic during daylight hours on SW 62 Avenue, and because the
electric transmission lines require traffic clearances during movement between
poles which are only available during the night for this area, FPL is requested a
waiver, to allow them to work during night hours.
The Resolution attached is to waive the limitation on hours of construction, as
authorized by the Ordinance . The work is anticipated to be completed within
the next two weeks.

7 WHEREAS, Pursuant to Section 7-16(g) of Code of the Ordinances, as amended by Ordinance
8 No. 5-15-2212, all construction sites shall comply with the city's noise code and it provides in pertinent
9 part as follows:

11 All construction sites shall comply with the city's noise code. Construction activity is limited to the hours
12 of 7:00 a.m. through-6:00 p.m. on the weekdays of Monday thru through Friday; and between the hours
13 of 9:00 a.m. through 5:00 p.m. on Saturday. No construction activity is permitted on Sunday.
14 Notwithstanding the above, no construction activities shall take place in, or within 500 feet of,
15 residentially zoned districts, other than those in the Hometown District, on either Saturday or Sunday
16 and, as to construction activities in non-residentially zoned districts and in the Hometown District, all
17 days of the week and hours of the day may be changed by resolution of the City Commission upon a
18 finding of extraordinary circumstances.

20 WHEREAS, FPL wishes to perform work along SW 62 Avenue, between SW 70th Street and South
21 Dixie Highway to replace existing transmission line concrete poles along the east side of SW 62 Avenue;
22 and

24 WHEREAS, the transmission line clearances are only available during the night and the type of
25 equipment being used will impact traffic due to a required lane closure. In addition, the FPL's operations
26 at night will cause minimal traffic impact; and
27
28 WHEREAS, allowing construction activities at night may be changed by resolution of the City
29 Commission upon its finding of extraordinary circumstances; and

31 WHEREAS, FPL is requesting authority to conduct transfer services during night hours; and
32
33 WHEREAS, approval of this request will not be detrimental or harmful to the surrounding area
34 ofthe community at large.

36 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
37 SOUTH MIAMI, FLORIDA THAT:

39 Section 1: The recitals set forth above have been found to be true and they are hereby
40 incorporated by reference as if fully set forth herein. The construction hours are hereby changed
41 temporarily for the current construction activities of FPL for three weeks, from the date of permit
42 issuance or until such time as the City Commission or the City Manager revokes these extended hours of
43 operation. The temporary hours of construction operations are limited to the hours of 9:00 PM to 6:00
44 AM. The contractor shall hire, at their own expense, an off duty City of South Miami Police officer for
45 these days and during these hours to insure that the FPL complies with the City's ordinances and this
46 resolution. The extended hours for construction activity authorized by this Resolution may also be
47 reduced or revoked upon determination of the City Manager in his sole and absolute discretion that a
48 violation of any of the City's ordinance or this Resolution has occurred and has not been resolved to his
49 satisfaction or that the noise level is otherwise excessive. This resolution may be revoked at any time in
50 the sole and absolute discretion ofthe City Commission.

Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity ofthe remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon adoption by
vote of the City Commission.

replacement poles, the removal of the replaced poles, and includes the restoration of the construction
areas and any sidewalks damaged. Traffic control will confOlm to FDOT's Roadway and Traffic
Control Standru.·ds. Construction is scheduled to begin as soon as the resolution is approved.

County, Florida.
The scope of work will entail the transfer of Distribution underbuilt facilities, the removal of the double
poles, and restoration of the sidewalk located along the east side of SW 62nd Avenue between SW 70 th
Street and S Dixie Highway due to maintenance requirements. Traffic control will conform to FDOT's
Roadway and Traffic Control Standards. This project will required night work. Construction is
scheduled to begin on March 8, 2017.

1. Permit for construction work shall be on project site at all times.
2. Permits are va l id for a period of six months from the date of issuance. If work is not complete before
permit expiration (six months), a permit extension can be applied for, before the permit expires .
Otherwise, a new permit application will be required for work on the r ight of way to be performed .
A new permit application will be required if the permit expires. It is the sole responsibility of the
contractor to apply for an extension at the PW office .
3. All materials and labor under the project shall be in strict accordance with the requirements of the City of
South Miami, Miami-Dade County, and all other local, state, and national codes, where applicable.
4. All construction shall be performed in a safe manner in accordance with the rules and regulations of the
Occupational Safety and Health Administration (OSHA).
5 . Contractor shall notify the City of South Miami Public Works Department (CSM PW) forty-eight hours (48)
prior to commencing work.
6. Contractor shall notify any affected property owners prior the permitted work starts.
a. In case when the work will disturb the traffic on the only accessing roadway, contractor is to
notify all property owners who have properties in between the access points on that roadway .
b. Egress and ingress shall remain accessible to each property .
7. During construction, the project site and all adjacent areas shall be secured and maintained in a neat and
clean manner.
8. Traffic shall be maintained in accordance with Florida Department of Transportation (FOOT) Maintenance
ofTraffic (MOT) standards, Miami-Dade County standards, Manual of Uniform Traffic Control Devices
(MUTCD) and any additional requirements by the CSM PW and Police Department.
a. If a full or partial road closure is required , a MOT must be submitted and approved by CSM PW
and City of South Miami Police Department (CSM PD). No street shall be closed without written
authorization .
b. Any pedestrian MOT shall be per FOOT Standard Index 660.
c. Applicant shall coordinate the schedule of the MOT with the CSM PD . Chief of Police and/or CSM
PD may be reached at 305-663-6301. Any directions by CSM PO, before, during and/or after the
work is being performed, shall be followed by the applicant, wor kers and/or any other involved
party.

d . Access for local traffic shall be maintained at all times .
9. If the work will obstruct parking of vehicles at the street paid parking spaces, the applicant shall pay the
daily parking fees for each of the obstructed paid street parking spaces.
10 . No material or equipment shall be staged in the public R/W overnight unless specifically authorized by the
Department.
11. All pavement open-cut during permitted work shall be temporarily restored with asphalt or steel plates at
the end of each workday. NO TRENCHES OR PITS SHALL BE LEFT OPEN OVERNIGHT . Permanent asphalt
restoration shall occur within 14 days of open-cut.
12 . Contractor shall conduct daily dust control and implement storm water erosion and sediment control
measures for pollution prevention.
13 . Any damage to private property shall be restored to its original condition or better and as accepted by the
owner.
14. Disturbed areas shall be restored to equal or better condition than they were before the work started .
The restoration shall include the following :
a. Road/pavement areas shall be restored at least 5' from the edges of disturbed areas and as per
the City of South Miami Standard Details for Pavement Restoration.
b . Sidewalk panels shall be replaced, i.e., the sidewalk shall be restored in full width.
c. Landscaped areas, including and not limited to grass, sod, shrubs and trees replacement, shall be
fully restored .
d. For intersections with pavers, the full intersection shall be restored regardless of the size of the
disturbed area .
15. If all restoration work is not performed within 30 days of work completion, the CSM PW may restore the
work area and charge the applicant for the cost of restoration plus a minimum of 15% for administrative
fee and any additional incidental fees.
16 . All utility location markings within the right-of-way shall be removed before project closeout.
17. All rims of manholes and water valves shall be at grade when repair is finished.
18. Work is not permitted on Saturdays, Sundays and Holidays. Work is only allowed from 8 am to 5 pm,
unless otherwise authorized.
