WHEREAS, the City Manager and outside Counsel have negotiated a resolution of the action styled Michael Weissberg v. The City of South Miami, currently pending in the Eleventh Judicial Circuit in and for Miami-Dade, County, Florida, bearing the case number 14-018469-CA-30; and WHEREAS, in consideration for signing this Agreement and compliance with the promises made therein, the City and Weissberg have agreed, in part, as follows: City agrees to pay Weissberg the total sum of Three Hundred Thousand Dollars ($300,000.00) in one (1) installment, in full and final settlement, release, and resolution of all claims Weissberg has, had, or may have against City. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT Section 1. The City Manager is hereby authorized, in consideration of Mr. Weissberg signing an Agreement and compliance with the promises made therein, for a total settlement sum of Three Hundred Thousand Dollars ($300,000.00), to pay Weissberg the amount of the City's deductible, which is $61,994.63, from account numbers: 001-1330-513-4510; with the remainder of the settlement to be paid through the City's insurance carrier, in full and final settlement, release, and resolution of all claims Weissberg has, had, or may have against City in the action styled Michael Weissberg v. The City of South Miami, currently pending in the Eleventh Judicial Circuit in and for Miami-Dade, County, Florida, bearing the case number 14-018469-CA-30. Section 2. The settlement check will be made payable to the FairLaw Firm Trust Account. Section 3. This resolution shall take effect immediately upon adoption.
