A landscape buffer separates the parkinglotfrom the properties to the south and east.Thesite plancomplieswith the setback,FAR andimperviouscoverage standards of the LDC. The SR zoning district allows a height offourstoriesor fifty (50)feet.This provision is limited, however,by Section 20-3.5(D)Properties Abutting Single-Family Zoning Districts ofthe LDC which states: (1)Notwithstanding the dimensional requirements ofthe zoning use district in which a property is located,ifthatproperty is abutting (common border orseparated bya right- of-way)toa single-family zoning district the maximum height of any new building or any vertical addition toan existing building onthat property is limited totwo stories, however,additional height may be obtained via the special use permit process asset forth in Section 20-5.8. As notedabove,theprojectabutsa single-family zoning districtonthreesides(north,eastand south)andisdesignedat three (3)stories. (2)Additional Conditions.The city commission maydesignatesuchadditionalconditionsin connectionwithaspecialuseaswill,initsopinion,assure that suchusewillconformto the foregoing requirements. The conditional requirements of Section 20-3.4includegeneral requirements that apply to all applications aswellasspecial requirements that apply to specific types of specialuses.There areno special requirements for allowing additional stories,so only the general requirements apply: (1)Allsuch uses shall comply withall requirements established inthe appropriate zone use district,unless additional or more restrictive requirements are set forth below or by the City Commission. (2)Allsuch uses shall be determined to be of a compatible and complementary nature with any existing,planned or anticipated surrounding uses. (3)Apublic hearing shall be held by theCityCommission to determine the overall compatibility of theusewiththesurroundingneighborhood. (4)Ifaspecialuseis,inthefuture,determined bytheDirector of the Planning and Zoning Departmentorthe City Commission,tobeadverselyaffectingthehealth,safety or welfare,including quietenjoyment,ofpersons residing or working inthe vicinity ofthe proposed use,or otherwise to be detrimental tothepublicwelfareor property or improvements inthesurroundingneighborhood,ortobe not incompliancewithany other applicableCodeprovisions,thespecialuseapproval may bemodified,with conditions of approvalrevisedoraddedtoalleviatesuchadverseeffect,orrevokedby the CityCommissionupon notification and publichearing. Finally,Section20-5.8(C)of the LDC provides that anapprovalshalllapse after six(6)months if not master building permit which implements the specialusehas been issuedforsuch use.The City Commission may specify a longer approval period for good cause. Punning Board Action: Following apublichearingonMay 30,2017,the Planning Boardvotedfive(5)ayesto one (1) nay to recommend approval of the special use with Staff's recommended conditions. Recommendation: Staffrecommends that the City Commission approvethespecialuseapplicationwiththe following conditions: 1.That the buildingbelimitedto three (3)storiesinheight;and 2.Thattheprojectis developed in substantial compliance withtheplanspreparedby Fanjul &Associates,LLC and attached to this memo. Further,Staffrecommends thatthe City Commission consider a longer approval period toensure thedeveloperadequatetimetoobtainthemaster building permit. 2.Variance to allowareductionin the numberof parking spacesprovided. Pursuant to Section 20-5.9 of the LDC,a variance for off-street parking can be reviewed and permitted by the CityCommission at apublichearing,after a recommendation by the Planning Board.Variance decisions shall be based onan affirmative finding asto each of the following criterion: 1.The variance is necessary to relieve particular extraordinary conditions relating to a specific property; Response:The site's smallsizeanddimensionsmakethisaparticularlychallengingsite to develop. 2.Denial of the variance would result in hardship to the owner.Hardship results if the restriction of the zoningordinance,when applied to aparticular property,becomes arbitrary,confiscatoryorundulyoppressivebecause of conditionsof the property that distinguish it from other properties under similar zoning restrictions; Response:Developmentofthepropertyis limited byitssize,dimensions,andthecode requirements that limit heightand impervious coverage.Thesefactorscombinetomake it difficult tocomplywiththe parking requirements.Further,denialofthevariance will impede the development ofmuch needed affordablehousingforSouth Miami and commercial tenants that will offer essential goodsandserviceswithinwalking distance of many residents. 3.The extraordinary conditions and circumstances do not result from the actions of the applicant; Response:Theneighborhoodwasplattedwith small,narrowlots that makeit difficult to assemble sites largeenoughto accommodate amixed-use development that complies »2 Visitor Parking Spaces JKT Z:\Commission ltems\2017\06-06-2017\Madison Square East\MadisonSquareEastCMMemoO6062017.docx Madison Square -EastParcel Special Use and Variance Applications 5944 SW 64 Street June 6,2017 Page 8of9 with all the current LDC requirements and meets the community's objectives. Consequently,the extraordinary conditions and circumstances do not result from the actions of the applicant. 4.The requested variance is the minimum variance necessary to make possible the reasonable use of the land,building or structure; Response:Theprojectis designed tohelpachieve the community's goalofprovidingas many affordable unitsaspossible,whilestillbeing sensitive to the scaleof the surrounding neighborhood andlimitingimpactson the nearby neighborhood.Whilea parking structure mightallow additional parking,it'sunlikely that a structure wouldfiton the property2.Further,ifastructurewas physically possible,thebuildingwouldbe disproportionate and out ofkeepingwiththe character of the neighborhood. Consequently,the requested varianceis the minimumnecessarytomakepossible the reasonable use of the land. 5.Thattheapprovalofthevariance will beconsistentwith the general intent andpurpose of the Land Development Code,andwillnotbeinjuriousto the neighborhood or otherwise detrimental to the public welfare. Response:Thepurposeof the SR districtis"tomaintain the basicspecialtyretail character oftheSunset Drive commercialareabyencouragingcomparisonretailusesatthe pedestrian-oriented gradelevelandofficeandresidentialuseson the upperfloorsofall buildings"(Sec.20-3.1(14)).All other properties with an SR designation areinthe Hometown District Overlay and,assuch,are allowed a twenty-five percent (25%)parking reductionformixed-use buildings.Parking reductionsformixed-use buildings arenot uncommon.If that reductionwereappliedtothisproject,onlyforty-one (41)spaces wouldberequired.Consequently,approvalofthevariance will be consistent withthe generalintentandpurposeofthe LDC and will notbe injurious tothe neighborhood or otherwise detrimental to the public welfare. Finally,Section 20-5.9(A),Expiration of Variance Approvals ofthe LDC provides that variances shall lapseafterone (1)yearifno building permithasbeen applied for in accordance with the requestandifthe City Commission hasnotspecifiedalongerapprovalperiodforgoodcause shown.
