WHEREAS,theSouthMiami Community Redevelopment Agency ("SMCRA")initiated an
application(number PB-17-010)requesting avariancefromSection20-4.4 of theLand Development
Code (LDC)inconjunctionwithaMixed-UseProjectlocatedat5944SW 64th Street(folio 09-4025-010-
0270),6401SW59Place(folio 09-4025-010-0280),6411 SW59Place(folio 09-4025-010-0290),6415
SW 59th Place(folio 09-4025-010-0300),avacantlotwithafolionumberof 09-4025-010-0310,and6443
SW59Place(folio 09-4025-010-0320)(collectively referredtoas "East Madison Square");and
WHEREAS,the Mixed-Use Project will consist of approximately 3,566 squarefeet of ground
floor commercial spaceand twenty (20)residentialunits;and
WHEREAS,pursuant toSection20-4.4 of theLDC,the project is required toprovideatotal of
fifty-four(54)parking spaces;and
WHEREAS,the proposed project providestwenty-six(26)parking spaceson-siteandmaybe
givencreditforfive(5)on-street spacespursuanttoSection20-4.4 of theLDCforatotal of thirty-one
(31)parking spaces;and
WHEREAS,theSMCRAisrequestingavariancetoallowareductioninthenumber of required
parking spaces;and
WHEREAS,theapproval of avariancerequiresareviewbythe Planning Boardanda
recommendationtoapprove,denyorapprovewithconditions,aswellastheapproval of theCity
Commission afterapublichearing;and
WHEREAS,atspecial meeting onMay30,2017,the Planning Board heldapublichearingon
the application,considered each of the variance criterion listedin Section 20-5.9 of theLDCand voted
five(5)ayestoone(1)naytorecommendapproval of thevariancerequested;and
WHEREAS,the Mayor andCity Commission of theCity of SouthMiami,having considered
each of thevariancecriterionlistedinSection20-5.9 of theLDCandhavingfoundthatthoseconditions
havebeenmet,desiretoapprovetheapplicationforthevariance.
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA THAT:
Section 1.The recitals setforthinthisresolutionaretrueandtheyare supported by competent
substantialevidenceandtheyareincorporatedintothisresolutionbyreferenceas if setforthinfull
herein.
Section 2.The application (number PB-17-010)submitted by the South Miami Community
RedevelopmentAgency ("SMCRA")requestingavariancetoreducethenumber of requiredparking

Background:
The South Miami Community Redevelopment Agency (CRA)owns approximately 1.2 acres of
property onthesouth side of SW 64th Street generally referred toas Madison Square.The
CRA's planning document designates the area fora mixed-use redevelopment proposal that will
createan anchor forthenorthendof SW 59th Place and help stimulate revitalization efforts in
the area.
For the purposes ofthe development review,the property is described aseither East orWest
Madison Square,with SW 59th Place serving asthe divider.This memo focuses on the zoning
requests for East Madison Square;the West Madison Square requests are addressed in a
separate memo.The East property consists ofsix (6)parcels onthesouthsideof SW 64th Street
and theeast side of SW 59th Place as shown in the highlighted area below:

five (5)spaceson SW 64th Street canbecreditedtotheprojectforatotalofthirty-one(31)spaces.
Abusstoplocatedon SW 59th Place prohibitsthedevelopmentofadditional on-street spaces.
A landscape buffer separates the parking lotfrom the properties to the south and east.The site
plan complies with the setback,FAR and impervious coverage standards of the LDC.
The attached exhibit contains the plans for both the East and the West properties.Sheet AO.l
illustrates the concept planforboth the Eastand the West properties.Sheets A0.2(E),Al.2.1,
and Al.2.2 provide the site plan,floor lay-out and conceptual elevations for the East side.
Request;
As proposed,the project requires the following approvals,which are described and analyzed
below:
1.ASpecialUse to allow a height of three-stories.

The SR zoningdistrict allows aheightoffourstoriesorfifty (50)feet.This provision islimited,
however,bySection 20-3.5(D)Properties Abutting Single-Family Zoning Districts of the LDC
which states:
(1)Notwithstanding the dimensional requirements of the zoning use district in which a
property is located,ifthat property is abutting (common border orseparatedbya right-
of-way)toa single-family zoning district the maximum height ofanynew building or any
vertical addition toan existing building onthat property is limited totwostories,
however,additional heightmaybe obtained via the special use permit process asset
forth in Section 20-5.8.
As noted above,the project abuts asingle-familyzoningdistricton three sides(north,east and
south)andis designed at three (3)stories.

(b)Will notbedetrimentaltothepublicwelfareorpropertyorimprovementsinthe
neighborhood;and
(c)Complieswithall other applicableCodeprovisions.
(2)Additional Conditions.The citycommissionmay designate suchadditionalconditionsin
connection witha special useaswill,initsopinion,assure that suchusewill conform to
the foregoing requirements.
The conditional requirements of Section 20-3.4 includegeneral requirements that apply to all
applications aswellasspecial requirements that apply to specific types of specialuses.There
areno special requirements for allowing additional stories,so only the general requirements
apply:
(1)Allsuchusesshall comply withall requirements established in the appropriate zone use
district,unless additional or more restrictive requirements are set forth below or by the
City Commission.
(2)Allsuch uses shall be determined to be of a compatible and complementary nature with
anyexisting,planned or anticipated surroundinguses.
(3)ApublichearingshallbeheldbytheCity Commission to determine theoverall
compatibility of the usewiththesurrounding neighborhood.
(4)Ifaspecialuseis,inthefuture,determinedbytheDirector of the Planning and Zoning
Department ortheCity Commission,tobeadverselyaffectingthehealth,safety or
welfare,including quietenjoyment,ofpersons residing or working inthe vicinity of the
proposed use,or otherwise tobedetrimentaltothepublicwelfareor property or
improvementsinthe surrounding neighborhood,ortobenotincompliancewithany
other applicable Code provisions,thespecialuseapprovalmaybe modified,with
conditions ofapprovalrevisedoraddedtoalleviate such adverseeffect,orrevokedby

Staff Response:
Afterreview of the project,the proposedbuildingcomplieswithconditionsand requirements
listedin both Section 20-5.8(B)and 20-3.4(A)of the LDC in that:
o Increasing the heightof the building fromtwo (2)storiestothree (3)shouldnotadversely
affect the healthor safety of personsresidingorworkingin the area,norwillitbe
detrimental to the public welfare or property or improvements in the neighborhood;
oTheproposed building complieswithother applicable Code provisions regarding sizeand
setbacks;
oWhile most buildingsin the areaaresingle-story,the nearby churches have elements or
architectural features that are comparable in height to the proposed building;

oThe proposed building isofa compatible and complimentary nature with the existing,
planned or anticipated surrounding uses.
Finally,Section 20-5.8(C)of the LDC provides that an approval shall lapse after six(6)months if
not master building permit which implements the special use has been issued for such use.The
City Commission may specify a longer approval period for good cause.
Punning Board Acton:
Followingapublic hearing onMay 30,2017,the PlanningBoard voted five(5)ayes to one (1)
nay to recommend approval of the special use with StafPs recommended conditions.
Recommendation:
Staff recommends that the CityCommission approve the specialuseapplicationwith the
following conditions:
1.That the buildingbelimitedto three (3)stories inheight;and
2.Thattheprojectisdevelopedinsubstantial compliance withtheplanspreparedby Fanjul
&Associates,LLC and attached to this memo.
Further,Staff recommends thatthe City Commission consider a longer approval period toensure
thedeveloperadequatetimetoobtainthemaster building permit.

Thirty-one(31)spaces are shown on the proposed siteplan,fora shortage of twenty-three (23)
spaces.Of the thirty-one (31)spaces available,twenty-two (22)willbe allocated for the
residential units(i.e.,one space per unitplus two visitor spaces);the remaining nine(9)spaces
will be allocated for the commercial tenant(s).The City and CRA are negotiating with the nearby
churches to provide additional parking for the project.However,since the negotiations have not
been finalizeda variance approval is necessary.
Pursuant to Section 20-5.9 of the LDC,a variance for off-street parking canbe reviewed and
permitted by the CityCommission at apublichearing,after a recommendation by the Planning
Board.Variance decisions shall be based onan affirmative findingas to each of the following
criterion:
1.The variance is necessary to relieve particular extraordinary conditions relating to a
specific property;
Response:The site's smallsizeanddimensionsmakethisaparticularlychallengingsite
to develop.
2.Denial of the variance would result inhardship to the owner.Hardship results if the
restriction of the zoningordinance,when appliedtoaparticularproperty,becomes
arbitrary,confiscatoryorundulyoppressivebecauseofconditionsof the property that
distinguish itfrom other properties under similar zoning restrictions;
Response:Developmentofthepropertyis limited byits size,dimensions,andthecode
requirementsthatlimitheightand impervious coverage.Thesefactorscombinetomake
it difficult tocomplywith the parkingrequirements.Further,denialofthevariance will
impedethedevelopmentofmuchneededaffordablehousingforSouth Miami and
commercial tenants that will offer essential goods and services withinwalking distance of
many residents.
3.Theextraordinary conditions andcircumstancesdo not resultfrom the actions of the
applicant;
Response:Theneighborhoodwasplattedwithsmall,narrowlots that makeit difficult to
assemble siteslarge enough to accommodate amixed-use development that complies

with all the current LDC requirements and meets the community's objectives.
Consequently,the extraordinary conditions and circumstances do not result from the
actions of the applicant.
4.The requested variance is the minimum variance necessary to make possible the
reasonable use of the land,building or structure;
Response:The project isdesignedtohelpachieve the community's goalofprovidingas
many affordable units as possible,whilestill being sensitive to the scale of the
surrounding neighborhood andlimiting impacts on the nearby neighborhood.Whilea
parking structure might allow additional parking,it'sunlikely that a structure would fiton
the property2.Further,ifastructurewas physically possible,the building wouldbe
disproportionate and out ofkeepingwith the character of the neighborhood.
Consequently,the requested variance is the minimum necessary tomake possible the
reasonable use of the land.
5.Thatthe approval ofthe variance willbeconsistentwiththe general intentandpurpose
of the Land Development Code,andwillnotbeinjuriousto the neighborhood or
otherwise detrimental to the public welfare.
Response:The purpose ofthe SR districtis"tomaintain the basicspecialtyretail character
oftheSunset Drive commercial areaby encouraging comparison retail usesatthe
pedestrian-orientedgrade level and office and residential usesontheupperfloorsof all
buildings"(Sec.20-3.1(14)).All otherproperties with an SR designation are in the
Hometown District Overlay and,assuch,are allowed a twenty-five percent (25%)parking
reductionfor mixed-use buildings.Parking reductions for mixed-use buildings arenot
uncommon.If that reduction were applied tothis project,only forty-one (41)spaces
wouldberequired.Consequently,approvalof the variance will be consistent withthe
generalintentand purpose ofthe LDC and will notbe injurious tothe neighborhood or
otherwise detrimental to the publicwelfare.
Finally,Section 20-5.9(A),Expiration of Variance Approvals ofthe LDC provides that variances
shall lapseafterone (1)yearifno building permithasbeen applied for in accordance with the
requestandifthe City Commission hasnot specified a longer approval period forgoodcause
shown.
Planning Board Recommendation:
Following a public hearing on May 30,2017,the Planning Board voted five (5)ayes toone (1)nay
to recommend approval of the requested variance.

recommended that the items be grouped together between the Eastand West projects and
reviewed accordingly.Mr.Basu recommended that the presentation befor the entire project and
then hold separate discussions on the items for both the east project and the west project.Mr.
Basu then questioned how the vote on the items would be performed.Mr.Pepe stated that the
items would need to be voted on separately but could be discussed asa group.

Ms.Fischer stated that the Board isbeing asked to vote onan increase from two (2)stories to
four (4)stories.She then asked whyis the Boardbeing asked to vote on this type of change
when all the backup provided proposes a height of three (3)stories.
Mrs.Tompkins stated that the reason behind thisis that staff wanted to provide the City
Commission with options for the height.She then pointed out that Staffis recommended that
the buildingbelimitedto three (3)stories inheight.
Dr.Philips asked about the location of entry into the building.Arturo Fanjul,the architect of
record for the project explained the entrances intobuilding#2to the Board.
Ms.Kahn askedif the plans provided arespecificallyrelated to FamilyDollar.Mr.Pepe explained
the processbywhicha developer could propose a project to the SouthMiami Community
Redevelopment Agency (SMCRA).Hethen stated that the project before the Boardis tied to
Family Dollar.Inreturnfora Family Dollar beingplacedin the project,the developer willbuild

tothe LLC that ownstheproposed Family Dollar that will beintheMadisonSquareproject,but

project.She stated that tolimit the parkingin this type of areais considered
discrimination.If parking isgoing to be limited,then it should be limited across the
boardforall multi-family buildings.Shealso mentioned that shehas been hearing talk
about sharing parking spaces with the churches near the Madison Square project but
nothing has materialized yet.LastMs.Fischer stated that for the betterment of the
community that we do get a Madison Square,she willbe voting Noon the four(4)
stories for Madison Square.

Ms.Kahn stated that she understands the impetus to weigh on the side of aesthetics,
but prefers to weigh her vote on needs of the people.She stated that there isa certain
irony when the discussiononparkinganddiscriminationis mentioned.She stated that
the community has been fightingfor this projectforalong time.Theareais pedestrian
friendly,withtheMetro Rail stationnearby.Shealso stated thatshewouldvotefor the
projecttobefour(4)storiesandstatedthatshehasheardthe comments from the
community regarding Family Dollar andisnotinfavor of thefuture tenant,butthinks
that it is important to move forwardandsetthe parameters forit.After Dr.Philips
spoke,Ms.Kahn added that that the discriminationliesin the fact that the areawas
populated with its own businesses before.Shethen stated that part of thisprojectisto
put affordablehousingwhilethe other partistoputthe Family Dollar asananchorto
stimulate business in the area.She closed with stating that she would liketo see a
rebirth of self-sustaining businesses in the community.

Dr.Philips recalled adifferent iteration oftheprojectthatwouldhavebeen tall against
theadjacent single family residences.Shethengaveanexampleofhowtheheightcould
bemanagedso that theportionsoftheprojecthadfour(4)stories that wassetback
furtherawayfromresidentialwiththe remaining portionsbeingsetatthree (3)story
with the portionsclosertotheresidencesbeing set attwo(2)stories.Shealsostated
thatbecausetheprojectisnear public transportation,itisverygeneroustothinkthat
eachof the familieslivingintheproposedresidenceswillhavetwo(2)vehicles.People
shouldbeaskedif they wouldliketogiveupone(1)oftheparkingspacesso that it
could be used for the commercial uses.She then stated that she was for the project.

Mr.Basu stated that MadisonSquarehasbeenthetopicofdiscussionforalong time
and the best news is that the Cityhas someone that iswillingtofinance the project.He
then stated that hehasseveralissueswith the project whichareasfollows:
1.Affordable Housing-How does the city safeguard the affordable housing so that itis
available for South Miami residents.Mr.Pepe explained that the development
agreement speaks to the requirements for obtaining housing in the project.Mr.
Basu then asked if there will be a combination of market rate and affordable
housing within the project,of which Mr.Pepe stated no.Itwillall be affordable
housing.
2.Parking-When it comes toparking,some of the residents will not have two (2)
vehicles.The project is withinwalking distance to public transportation.He also
feels that thisisan opportunity where the community willcome together andfigure
out how to resolve the parking issue.
3.SW64th Street -the street hasa wide ROW with different uses that allows for
multimodal transportation.Becauseof that,there should bea comprehensive look
at the corridor.
4.Transitional Zoning-Thedesignis sensitive to the transitional zoningfrom
commercial to residential.He then askedif the third (3)floor could be set back
further toaidinthistransition.If notalong SW 64th Street,atleastalong the SW 60th
Avenue side.
