The attached exhibit contains the plansfor both the East and West properties.Sheet AO.l illustrates the concept planfor both the Eastand the West properties;Sheets AO.l(W),A.l.l, Al.2.3 and Al.1.3 provides the site plan,floor lay-out for the second and third floors,and conceptual elevations for the West side. Requests: As proposed,the project requires the following approvals,whicharedescribedandanalyzed below: 1.ASpecialUse to allowa height of three-stories. 2.AVariance to allowa reduction in the number ofparking spaces provided. 3.A Unity of Title Analysis; 1.ASpecialUse to allow a height of three-stories. The SR zoning district allows aheightoffourstoriesor fifty (50)feet.This provision is limited, however,by Section 20-3.5(D)Properties Abutting Single-Family Zoning Districts ofthe Land Development Code which states: (1)Notwithstanding the dimensional requirements ofthe zoning use district in which a propertyislocated,ifthatpropertyisabutting (common borderorseparatedbyaright- of-way)toa single-family zoning district the maximum height of any new building or any verticaladditiontoan existing building on that propertyis limited totwostories, however,additionalheightmaybeobtainedviathespecialusepermitprocessas set forth in Section 20-5.8. Planning Board Action; Following a public hearingontheitemonMay30,2017,the Planning Board votedfive(5)ayes toone(1)naytorecommendapprovalofthespecialusewith staffs recommended conditions: Recommendation: Staff recommends that the City Commission approvethespecialuseapplicationwith the following conditions: 1.Thatthebuildingbelimitedto three (3)storiesinheight;and 2.Thattheprojectis developed in substantial compliance with the plans preparedby Fanjul &Associates,LLC and attached to this memo. Further,Staff recommends thatthe City Commission consider a longer approval period toensure the developer hasadequatetimetoobtainthemaster building permit. 2.Variance to allowareductioninthenumberof parking spacesprovided. Of the fifty-five(55)spaces available,twenty-two (22)will be allocated for the residential units (i.e.,one space per unitplus two visitorspaces);the remaining thirty-three (33)spaces willbe allocated for the commercial space.TheCityand CRA are negotiating with the nearby churches to provide additional parking for the project.However,since the negotiations have not been finalized,a variance approval is necessary. Pursuant to Section 20-5.9 of the LDC,a variance for off-street parking can be reviewed and permitted by the CityCommission at apublic hearing,after a recommendation by the Planning Board.Variance decisions shall be based onan affirmative finding as to each of the following criterion: 1.The variance is necessary to relieve particular extraordinary conditions relating to a specific property; Response:The site's smallsize,dimensions,and irregular shape,combined with the three street frontages andasingle-family residence to the south make this a particularly challenging site to develop. 2.Denial of the variance would result in hardship to the owner.Hardship results if the restriction of the zoning ordinance,when applied to a particular property,becomes arbitrary,confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; Response:Development of the property islimitedbyitssize,dimensions and irregular shape,code requirements that limit height and impervious coverage,and the setbacks required from the single-family residence.These factors combine to make itdifficult to comply with the parking requirements.Further,denial of the variance will impede the development of much needed affordable housing for South Miami and a commercial tenant that will offer essential goods within walking distance of many residents. JKT Z:\Commission ltems\2017\06-06-2017\Madison Square West\Madison Square WestCM Memo O6062017.docx Madison Square -West Parcel Special Use and Variance Applications 5978 SW 64 Street June 6,2017 Page8 of 9 3.The extraordinary conditions andcircumstancesdo not resultfrom the actions of the applicant; Response:The neighborhood was platted with small,narrow lots that make it difficult to assemble sites large enough to accommodate a mixed-use development that complies withall the current LDC requirements and meets the community's development objectives.Consequently,the extraordinary conditions and circumstances do not result from the actions of the applicant. 4.The requested variance is the minimum variance necessary to make possible the reasonable use of the land,building or structure; Response:The project is designed to accommodate the space needs ofa national retailer and the community's desire to provideasmany affordable unitsaspossible,whilestill being sensitive to the scaleof the surrounding neighborhood andlimitingimpactson the adjacent singlefamilyhomes.Whileaparking structure mightallowadditionalparking, it's unlikely that a structure wouldfitontheproperty3.Further,ifa structure was physically possible,thebuildingwouldbe disproportionate andoutofkeepingwith the character of the neighborhood.Consequently,the requested variance is the minimum necessary to make possible the reasonable use of the land. 5.Thattheapprovalofthevariancewillbeconsistentwith the general intent andpurpose of the Land DevelopmentCode,andwillnotbeinjuriousto the neighborhoodor otherwise detrimental to the public welfare. Ms.Fischer stated that the Boardis being asked to vote onan increase from two (2)stories to four(4)stories.She then asked whyis the Boardbeing asked to vote onthistype of change when all the backup provided proposes a height of three (3)stories. Mrs.Tompkins stated that the reason behind thisis that staff wanted to provide the City Commission with options for the height.She then pointed out that Staff is recommended that the building be limited to three (3)stories in height. Dr.Philips asked about the location of entry into the building.ArturoFanjul,the architect of record for the project explained the entrances intobuilding#2to the Board. Ms.Kahn askedif the plansprovidedarespecifically related to Family Dollar.Mr.Pepe explained the process bywhicha developer could propose a project to the South Miami Community Redevelopment Agency (SMCRA).He then stated that the project before the Boardistiedto Family Dollar.In returnfora Family Dollarbeingplacedin the project,the developerwillbuild the project.Ms.Kahn then responded that the vote on the items listedforreviewwouldbe tied tothe LLC that ownstheproposed Family Dollar that will beintheMadisonSquareproject,but there are options for other proposals.Mr.Pepe stated yesto the response fromMs.Kahn. Ms.Kahn Ms.Kahn stated that she understands the impetus to weigh on the side of aesthetics, but prefers to weigh her vote on needs of the people.She stated that there isa certain irony when the discussion on parking and discrimination is mentioned.She stated that the community has been fighting for this project foralong time.The areais pedestrian friendly,with the Metro Rail station nearby.Shealso stated that she would vote for the project tobefour(4)stories and stated that shehasheard the comments from the community regarding Family Dollar andisnotinfavor of the future tenant,but thinks that itis important to move forwardandset the parameters forit.After Dr.Philips spoke,Ms.Kahn added that that the discrimination liesin the fact that theareawas populated with its own businesses before.She then stated that part of this project is to put affordable housing while the other partistoput the Family Dollarasan anchor to stimulate business in the area.She closed with stating that she would like to see a rebirth of self-sustaining businesses in the community. Dr.Philips Dr.Philips recalleda different iterationoftheproject that wouldhavebeentallagainst theadjacentsingle family residences.Shethengaveanexampleofhowtheheightcould be managed so that the portions of the projecthadfour(4)stories that was set back furtherawayfromresidentialwiththeremainingportionsbeing set atthree(3)story with the portions closertotheresidencesbeing set at two (2)stories.Shealso stated that because the projectisnearpublic transportation,itisvery generous tothink that each of the familieslivingin the proposed residences willhave two (2)vehicles.People should beaskedif they wouldliketogiveup one (1)of the parkingspacesso that it could be used for the commercial uses.She then stated that she was for the project. Mr.Basu Mr.Basu stated that MadisonSquarehas been the topicofdiscussionforalong time and the best news is that the Cityhas someone that iswilling to finance the project.He then stated that hehasseveral issues with the project whichareasfollows: 1.Affordable Housing-How does the city safeguard the affordable housing so that itis available for South Miami residents.Mr.Pepe explained that the development agreement speaks to the requirements for obtaining housing in the project.Mr. Basu then asked if there will be a combination of market rate and affordable housing within the project,ofwhichMr.Pepe stated no.Itwillallbe affordable housing. 2.Parking-When it comes toparking,some of the residents will not have two (2) vehicles.The project is within walking distance to public transportation.He also feels that this isan opportunity where the community will come together and figure out how to resolve the parking issue. 3.SW64th Street -the street has a wide ROW with different uses that allows for multimodal transportation.Because of that,there should bea comprehensive look at the corridor. 4.Transitional Zoning-Thedesignis sensitive to the transitional zoning from commercial to residential.He then asked if the third (3)floor couldbe set back furthertoaidinthistransition.If notalong SW 64th Street,atleastalongthe SW 60th Avenue side.
