AResolution of theMayorandCityCommission of the City of
South Miami,Florida,urging Florida'sU.S.Senatorsto vote against
the "Reducing Regulatory Burdens Act of 2017".
WHEREAS,theU.S.Houseof Representatives hasapprovedthe "Reducing
Regulatory Burdens Actof 2017"(HR953)reverses the 2009 rulingin National Cotton
Council v.EPA thatrequires Clean Water Act permitsforpesticideuserswhosprayover
waterways;and
WHEREAS,theU.S.Senate willsoonvoteonthisbill;and
WHEREAS,thisbill reverses a2009 decision issued bythe6th Circuit Court of
Appeals,inthecase of NationalCottonCounciletal.v.EPA,whichheldthatpesticides
appliedtowaterwaysshouldbeconsideredpollutantsunderfederallawandshouldbe
regulated under the Clean Water Act(CWA)throughpermits issued under the National
Pollutant Discharge Elimination System (NPDES);and
WHEREAS,this bill effectively undermines federal authority to protect U.S.
waters under the Clean WaterAct;and
WHEREAS,this bill allows spraying of toxic chemicals into waterways without
local and state oversight;and
WHEREAS,this bill does not reduce claimed burdens to farmers since there is no
burdenasthereisno significant economic costand agricultural activitiesarealready
exempt;and
WHEREAS,if signed into law,this bill would foster further contamination of
drinkingwatersourcesandwouldcausefurtherharmtoaquaticlife.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT:
Section 1.TheCity Commission herebyurges Florida's dulyelectedU.S.
Senators,SenatorBillNelsonandSenatorMarcoRubiotovoteagainstthe"Reducing
Regulatory Burdens Act of 2017".
Section 2.TheCity Clerk shallsendthis signed resolution to Senator Rubio
andSenator Nelson,aswellas municipal officials throughout theState.
Section 3.If any section clause,sentence,orphrase of this resolution isfor
any reason heldinvalidor unconstitutional byacourt of competent jurisdiction,the
holdingshallnotaffectthe validity of theremainingportions of thisresolution.
Section 4.This resolution shalltakeeffect immediately uponadoption.
