A Resolution authorizing the City Manager to pay,out of City funds,the
attorney fees charged by Orlando Cabrera to review the South Miami
Community Redevelopment Agency Madison Square Development related
documents.
WHEREAS,the South Miami Community Redevelopment Agency
("SMCRA")BoardapprovedtheSMCRA2016-17FiscalYearbudgetonOctober 17,
2016;and
WHEREAS,theCity Commission approved the SMCRA 2016-17 Fiscal Year
budget on March 1,2017 ata special Commission meeting;and
WHEREAS,the budget has been submitted tothe County forthe approval of the
Miami-Dade County Board of County Commissioners pursuant to the terms of the
Interlocal agreement between the County,the City and the SMCRA;and
WHEREAS,the SMCRA general counsel was instructed to seek the opinion of an
expert inthe area of the Fair Housing Act,asit relates to affordable housing,such as
Orlando Cabrera;and
WHEREAS,the SMCRA general counsel has drafted certain documents
necessary forthe development of the Madison Square project which will need tobe
reviewed by an expert in the Fair Housing Act;and
WHEREAS,the Commission anticipates that the SMCRA will repay theCityfor
this expense oncethe SMCRA budget is approved bytheCounty.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT:
Section 1.The above recitals are statements of fact held to be true and are
incorporated into the body of this resolution.
Section 2.TheCityCommissionherebyauthorizestheCityManagertopay,
out of Cityfunds,the attorney fees charged byMr.Orlando Cabrera to review theSouth
MiamiCommunityRedevelopmentAgencyMadisonSquareDevelopmentrelated
documents.The amount shall not exceed $5,000.
Section 3.Itis hereby declared tobeinthebest interest of theCityto allow the
CityManagertomakethisexpressSMCRAexpenditureoutoftheCityAttorneylegal
accountswithalineitemnumberendingin 3410 forlanduseattorneyservices.
Section 4.If anysectionclause,sentence,orphrase of thisresolutionisfor
anyreasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,the
holdingshallnotaffectthevalidity of theremainingportions of thisresolution.

Section 5.Effective Date.This resolution shall become effective immediately
uponadoptionbyvote of theCityCommission.
