A Resolution of the City of South Miami requesting that most of the parks impact fees
generatedbydevelopmentinDowntown Dadeland,thatisdedicatedtopurchasepark
space,be spent purchasing the Ludlam Trail.
WHEREAS,anumberofnewapartmentbuildingsarebeingdevelopedaroundDowntown
Dadeland;and
WHEREAS,Miami-DadeCountycollectsimpactfeeswhicharepaidas pre-development coststo
helpfundtheadditionalexpensesrequiredfor services,suchasparks,fornewdevelopment;and
WHEREAS,whenthedevelopmentiscomplete,therewillbe approximately 15,000 unitsthatwill
beexpectedtogenerate$25,560,000inparkimpactfees;and
WHEREAS,thequietLudlamTrailwillbetheonlylinearparkdirectlyadjacenttothehousing
units of DowntownDadelandandwillprovideasafededicatedanddirectrouteforcyclistsandpedestrians
to schools,parks,work and shopping;and
WHEREAS,the Ludlam Trail will contain restored native habitats and,unlike the Underline,the
LudlamTrailwillnotbedirectly adjacent to noise-making elements which makesforasaferandmore
pleasant park environment.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSIONERS OF THE CITY OF SOUTH MIAMI,FLORIDA THAT:
Section 1.The City of South Miami requests Miami-Dade County that most of the parks impact
feegeneratedby development inDowntownDadeland,thatisdedicatedto purchase parkspace,bespent
purchasing the Ludlam Trail.
Section 2.Severability.If any section clause,sentence,or phrase of this resolution isforany
reasonheldinvalidor unconstitutional byacourt of competent jurisdiction,the holding shallnotaffectthe
validity of the remaining portions of this resolution.
Section 3.Effective Date.Thisresolutionshallbecomeeffective immediately uponadoption.
