Ord No 05-17-2275ORDINANCE NO.05-1 7-2275 An Ordinance amending Chapter 2,Article I,Section 2-2.1 of the Code of Ordinances to add subsection (P)and for the purpose of providing a procedure for approving the South Miami Community Redevelopment Agency budget. WHEREAS,there currently isno procedure for the approval of the South Miami Community Redevelopment Agency ("SMCRA")budget;and WHEREAS,the City desires to amend Chapter 2,Article I,Section 2-2.1,of the Code of Ordinances to add subsection (P)and to provide a procedure for the review and approval of the SMCRA annual budget. NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR AND CITY COMMISSION OFTHE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Chapter 2,Article I,Section 2-2.1 of the City of South Miami,Florida, Code of Ordinances,is hereby amended to add subsection (P)and shall read as follows: Sec.2-2.1.-Rules of procedure of City Commission. The following rules of procedure shall govern all meetings of the City Commission, namely: (P)South Miami Community Redevelopment Agency Budget. (1)Within 5 days after the South Miami Community Redevelopment Agency ("SMCRA") approves the SMCRA budget,the City Commission shall hold a special City Commission meeting ("SMCRA special budget meeting")for the purpose of reviewing and approving the SMCRA budget. (2)If the Commission approves of the budget,it shall be transmitted,by the City Clerk or the SMCRA director,to Miami-Dade County for approval by the Board of County Commissioners. (3)If the Commission does not approve of the SMCRA budget,the Commission may make recommendations for amendments to the SMCRA budget. (4)If the Commission makes any recommendations and: (a)if the SMCRA approves the City Commission revised budget,the budget shall be deemed approved by the City Commission and it shall be transmitted,by the City Clerk or the SMCRA director,to Miami-Dade County for approval by the Board of County Commissioners;or (b)if the SMCRA Board make any further amendments,within 24 hours of receipt of the SMCRA revised budget by the City Clerk's office,the City Clerk shall transmit Page 1 of2 Ord.No.05-17-2275 a copy to the members of the City Commission.Within 5 days of the City Clerk's receipt of the SMCA revised budget,a second SMCRA special budget meeting of the City Commission shall be held. (5)If the City Commission fails to approve the SMCRA revised budget at the second SMCRA special budget meeting,or if for any reason the budget is not approved by October 1st,the prior year's SMCRA budget shallbe deemed approved,and adopted,by the City Commission.If there is not sufficient funding for the SMCRA budget expenditures,all line items shall be reduced by an equal percentage,rounding down if necessary,so as to balance the SMCRA budget expenditure with the SMCRA revenue.The budget that is deemed approved in accordance with this subsection shall be transmitted,by the City Clerk or the SMCRA Director,to Miami-Dade County for approval by the Board of County Commissioners. Section 2.Codification.The provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of South Miami as amended. Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance isforany reason heldinvalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
