ORDINANCE 04-17-2274 An Ordinance amending Section 20-2.3 of the City of South Miami Land Development Code creating a definition for "Beauty/Barber Shop or Beauty Spa"uses;and amending Section 20-3.3(D)and Section 20-7.12 concerning permitted uses of Beauty Shops,Barber Shops and Beauty Spas and parking requirements. WHEREAS,theCity of SouthMiami(the "City")currently permits beauty orbarber shops within certain zoning districts within theCity;and WHEREAS,traditional beautyorbarbershopuseshave evolved overtheyearsto includerelated services andCity staff findsit appropriate tocreatea definition of suchuses;and WHEREAS,the City currently permits beauty or barber shops within the Hometown District Overlay Zone (HD)as Storefront Uses;and WHEREAS,City staff believes thatsuchuses have impacts similar to Office Uses and should be allowed to follow the regulations for Office Uses within the HD;and WHEREAS,on February 14,2017,the Planning Board considered the Ordinance,and following a public hearing recommended approval of the Ordinance byavote of sixayesandno nays;and WHEREAS,theCity Commission desiresto amend the Land Development Codeto create a definition of "Beauty/Barber Shopor Beauty Spa"andto treat them similarly toOffice uses inthe Hometown District Overlay Zone. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Section 20-2.3 of theCity of South Miami Land Development Code is hereby amended to read as follows: 20-2.3 -Definitions. Basement.Shall mean that portion of a building between thefloorand ceiling,which has at least one-half of its height below grade,andthe ceiling of which isnot more than four(4)feet, six(6)inches above grade. Beauty/Barber ShoporBeautySpa.Shallmeanaplace of business primarily engagedin providing services of a personal nature associated with appearance or grooming.Usesmay include nail salons,tanning salons and services such as massage,facials,hair removal and body treatments,but shall exclude body piercing and tattooing. Section 5.Severability.If anysection,clause,sentence,or phrase of this ordinance is forany reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnot affect the validity of the remaining portions of this ordinance. Section 6.Ordinances in Conflict.All ordinances or parts of ordinances andall sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However,itis not the intent of this section torepeal entire ordinances,or parts of ordinances, that givethe appearance of being in conflict when thetwo ordinances canbe harmonized or when only a portion of the ordinance in conflict needs tobe repealed to harmonize the ordinances.If the ordinance in conflict canbe harmonized by amending its terms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed to harmonize thetwo ordinances shallbe repealed. Background: "Beauty or barber shops''are allowed within all commercial and mixed-use districts.In the Hometown District Overlay (HD),however,they are permitted only as Storefront Uses,and not asanOfficeUse on upper floors.Furthermore,a specific definition of the term is not provided other than a parenthetical note saying that it includes nail/skin care asan accessory or separate establishment. Analysis: Personal service businesses have evolved over time and now frequently offer a wider range of services than the traditional hair care.For example,it's not uncommon to find one business offering massage along with hair,skinandnail care.The current language of the Land Development Code (LDC)doesn't accommodate these consolidations of services and hasled to confusion about where they canbe located andhow they should be licensed by the City.The proposed changes create a definition that encompasses a range of personal services. As the business models have changed,many now prefer a less public location than a storefront in order to create a quiet and relaxing environment.The proposed ordinance willalso amend the HD regulations to allow these uses the option of locating onan upper floor. Planning Board Recommendation: The Planning Boardhelda public hearing on the itemon February 14,2017 and voted unanimously to recommend approval.
