Res No 057-17-14858RESOLUTION NO.057-17-14858 A Resolution relating to the review and acceptance of the Annual Development Agreement Report of the SCG Atlas Red Road Commons, L.L.C.[Red Road Commons]. WHEREAS,on April 9,2005,theCity Commission approved Ordinance No.12-05-1834 allowing the then property owner to construct a project located at 6600-6630 SW 57th Avenue that included 404 residential units and retail space.The approval included a zoning map amendment granting a PUD-M zoning district,an approval of a master site plan,and the approval of a Development Agreement;and WHEREAS,the Development Agreement forthe mixed use development project was fully executed andwas recorded inthe County registry of deedson March 30,2007as required by Section 30 of the Agreement;and WHEREAS,the Development Agreement includes the requirement (Section 12)thatthe Applicant orits assign submit anannual report totheCityatleast30days prior totheannual review date which provides a status report showing that obligations have been met and that there has been compliance with the provisions of the Agreement;and WHEREAS,the property is now owned bySCGAtlas Red Road Commons,L.L.C;and WHEREAS,the annual report was submitted totheCityon February 24,2017 fromthe owner's attorney,JerryProctor,andconcludedthatall of theobligationssetforthinthe Development Agreementare met;and WHEREAS,theannualreport,inaccordancewiththe Development Agreement,mustbe reviewedbytheCityCommissionatapublicmeetingandtheCityCommissionmayacceptthe reportor,if thereisafindingbythe Commission thattherehasbeenafailuretocomplywiththe terms of the Development Agreement,mayrevokeormodifythe Agreement. Background: OnApril9,2005,the City Commission approved Ordinance No.12-05-1834 allowing the construction of a mixed-use project known asRedRoad Commons at 6600-6630 SW 57th Avenue.The Ordinance also approved a Development Agreement for the project which was executed and recorded with MiamiDade County on March 30,2007.Since that time,the property has been sold and the new owner is SCG AtlasRedRoad Commons,L.L.C.("Owner"). The Agreement includes a requirement that the Owner or itsassign submit an annual report providing a status of the various obligations contained in the Agreement.Pursuant to that requirement,the Owner submitted the annual report on February 26,2016. Analysis: The burdens and benefits of the Development Agreement inure to the Owner as successor in interest.As provided in the attached letter fromMr.Jerry Proctor,attorney for the Owner, below isa summary of how the Development Agreement conditions have been met. 1.Permitted Uses,Densities,and Intensities In accordance with the provisions of Section 1of the Agreement,the Property was developed with a total of 404 residential units,whereas the maximum allowable number of units permitted by the Agreement was407.By developing the property in accordance with the revised adopted master planas approved by the City,the owner satisfied the condition of providing retail space,a management office,and constructing buildings that donot exceed five(5)stories in height. 2.Public Facilities In accordance with Section 2 of the Agreement,water and sewer services,solid waste services,and drainage services complied withall applicable requirements ofMiami-Dade Countyand the FloridaBuildingCodepriorto the issuance ofafinal Certificate ofOccupancy of such buildings.The previous property Owner satisfied the traffic conditions listed in RedRoad Commons Development Agreement AnnualReport March 21,2017 Page 2 of 3 Section2(e)oftheAgreementbyobtainingpermitsfromthe Florida Departmentof Transportationforroadwayimprovementson Red Road from US-1 to SW 66th Street and trafficsignal replacement for the intersectionlocatedat Red RoadandLevanteAvenue;both ofwhich have been completed. Therequiredannualhousingreportwassubmittedtothe City by letter datedJanuary24, 2017.As indicated in the letter,the project meets the 10%requirement that units be rented to "individuals or families inthemoderate income segmentoftheaffordablehousing group/'Additionally,thepreviouspropertyOwnermadea$100,000 payments the City priortooccupancyof the development onthe property toassistinlowincomehousing development in the CRA area. 3.Taxes Pursuant toSection3of the Agreement,the Ownerpaid taxes totheCityinan amount equal to the annual Operating Millage Rate and will continue to dosoin the future.The Owner paid2016ad valorem taxes to Miami-DadeCountyin the amount of $1,222,134.13 on November 28,2016. 4.Work Force In accordance with the provisionsofSection4of the Agreement,the prior property Owner gavea preference tojob applicants residing in the City.Theprior property Owner provided those applicants with jobs during both the demolition and construction portions of development. 5.Site Plan The Owner has abided byallsiteplan conditions as set forth inSection5of the Agreement. In addition,the prior property Owner participated ina joint working group with the First Methodist Churchof South Miami regarding traffic improvements and committed toan improvement planfor the portion ofRedRoad located between the Property and the First United Methodist Church of South Miami. 6.Security OnMay5,2014,as part of the approval of the 2014 Annual Report,the City Commission directed staff to review security measures and security reports provided by management at RedRoad Commons,to address security concerns.As part of the review of the 2016Annual Report,the new Owner agreed to employ a security firmto patrol the premises between 8:00 p.m.and3:00 a.m.,seven (7)nights per week.Any change to this time frame must be approved by the City Manager.These provisions were included in the resolution approving the 2016 Annual Report,which was approved on November 1,2016. 7.Schools The previous property Owner donated $34,800 to the Miami-Dade CountySchoolBoardon September 27,2007. In satisfaction of the traffic conditions listed in Section 2(e)of the Agreement,the previous Property Owner obtained permits from the Florida Department of Transportation for roadway improvements on Red Road from US-1 to SW 66th Street and traffic signal replacement for the intersection located at Red Road and Levante Avenue.Both projects have been completed.A previous Property Owner completed the remainder of the traffic improvements listed in the Agreement.
