Res No 052-17-14853RESOLUTION NO. 052-17-14853 A Resolution acknowledging Commissioner Welsh's (Group Seat IV) re- appointment of Subrata Basu, as the representative of Group Seat IV, to serve on the Health Facilities Authority for a three-year term ending March 20,2020. WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that: * * * When a Board or Committee is comprised of five members, each City Commissioner shall appoint one person to serve as a representative on the Board or Committee. When there are more than five (5) members on a Board or Committee, each City Commissioner shall appoint one person to serve as a representative on the Board or Committee, and all members of such Board or Committee in excess of five (5) shall be appointed by three (3) affirmative votes of the City Commission based on recommendations submitted by any City Commissioner. When a Board or Committee has less than five (5) members, then the selection of all members shall be by three (3) affirmative votes of the City Commission from recommendations submitted by any City Commissioner. (Amended 2-09-10) WHEREAS, Ordinance No. 11-95-1584 creating the City of South Miami Health Facilities Authority, provides: Section 3 (b) "Members: Terms of Office. The Authority, unless otherwise provided by State law, shall be composed of five voting members. Members shall be residents of the City appointed by the Commission for terms of four years; provided that of the first members appointed, the Commission shall designate one member to serve for one year, one member to serve for two years, one member to serve for three years and two members to serve for four years, in each case until his or her successor is appointed and has qualified. Thereafter, all appointments by the Commission, except appointments to fill vacancies shall be for a term of four years. Vacancies during a term shall be filled for the unexpired term by the Commission. a member of the Authority shall be eligible for reappointment. Any member of the Authority mat be removed by the Commission for misfeasance, malfeasance, willful neglect of duty or such other cause authorized by law." WHEREAS, Commissioner Welsh now desires to re-appoint Subrata Basu to serve on the Health Facility Authority as his representative. Mr. Basu's appointment shall expire March 20, 2020, or upon his removal or until a successor is duly appointed and qualified. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: Section 1. The City Commission hereby acknowledges Commissioner Welsh's right to re-appoint Subrata Basu as the representative of Group Seat IV a three-year term and pursuant to the terms of the City Charter and Ordinance 11-95-1584, contingent upon that this Page 1 of2 Res. No. 052-17-14853 appointment will not be violating the dual office of Florida's Constitution. Section 2. The expiration date of this appointment shall be March 20, 2020, unless earlier removed or until a successor is duly appointed and qualified. Section 3. Effective Date.
