Location: Between 5725 and 5751 SW 77th Terrace. PUBLIC HEARING #76-26 (Cont.) 2• Jenny L. Whistle, of Cousins Associates, appeared before the Board. She represents the owner of the ,property, Mr. Miser, who resides in Brazil. She stated the owner does not plan to return to this country to reside. Counsins recently acquired other property in the area and improved it. They would like to acquire this site and build a one-story building, office use and requiring law traffic use. Ms. Whistle did not submit the required signatures of surrounding neighbors. She stated she was out of town when the hearing was rescheduled and did not have proper time to acquire the signatures. Ed Corley appeared before the Board, opposing the request. He stated there are presently 13 horres on the street; that the property could be resold in the future thereby creating more traffic in the area; the area is residential. Mr. Gustafson appeared before the Board. He stated he lives across the street from the property; that the denial of the request would not create a hardship on the owner; that he helped pay for improvements in this area (sewers, etc.) to help keep it a residential neighborhood. Mr. Michelson stated that the RS-3 zoning served as a necessary buffer. MOTICN: By Mr. Fleischer, seconded by Mr. Coburn, recommending denial of the request as.there has been no change in the needs of the area since the application of. the Green Co. several years ago was also denied. VOTE IN FAVOR OF MOTION: Yes - 6 (Unanimous) MOTION CARRIED. PUBLIC HEARING #76-29 Alice Inman Request: Change of zoning from CO (Comrercial Office) to C-2 (Downtown Commercial) Legal Description: Lots 11 and 12, Block 2, ROSSWOOD SUBDIVISION, PB 13/62. Location: 7000 and 7020 SW 61st Avenue Mrs. Inman, owner of the property, appeared before the Board. She stated that she has been mobbed 3 times; that this is a dangerous, area to live; that she could sell the property with less difficulty if the zoning request was granted; that there are many offices in the imTediate area. Because of her error in interpreting what was required, she did not obtain the necessary signatures; however she did have the verbal consent from the few residential owners who appeared in her behalf during the hearing. Mrs. Masters suggested she would be willing to waive the signatures, as the area was obviously commercial in nature. Mr. Coburn advised Mrs. Inman it would be best to get the signatures before appearing before the Council. Discussion followed regarding the re-evaluation of this entire hearing in conjunction with assessing the Master Plan; that the study was presently underway and that the request be deferred until the study is complete. PUBLIC HEARING #76-27 (Cont.) 3. Mr. Tresize, a neighbor appeared before the Board. He stated that the request would improve the area; that there are only. 3 homes in that neighborhood. Mr. Logliss, of 7109 S.W. 61st Ct. appeared before the board. He stated that he is surrounded by the hospital, doctors' offices and insurance firms; that he is one of the few left residing there.; that he would not object to rezoning. Mr. Mike Carricarte, of the insurance firm located directly opposite the Inman property, stated the area needs help. There is much vandlism there and he would be pleased to have another commercial building nearby. MOTION: By Mr. Michelson, seconded by Mr. Fleischer, to table the request until . the entire area has been re-evaluated in relation to the master Plan; said evaluation is being conducted at the present time by members of the Planning Board. VOTE IN FAVOR OF MUTTON: Yes - 6 (Unanimous) MOTION CARRIED. Mrs. Inman was advised that the matter should take approximately 2 months. Executive Session: Vice-Mayor informed the Board of a zoning change on 57th Avenue, between 73rd and 74th Streets, which occurs in the middle of the block. Mrs. Masters recommended that the members take notice of this area before the next meeting, and discuss it then. Mr. Russe stated that the zoning book is being prepared and will be ready to give out within the next few weeks. The matter of Ordinance #14-76-894 was discussed, concerning meeting times for, =Lhe Board. Also Ordinance #14-76-894, concerning area of 500 ft. for notification of public hearings. MOTION: By Mr. Pierce, seconded by Mr. Coburn, to ammend Ordinance#14-76-894, Section 12.3.3 "Meetings", to read that the Planning Board will hold meetings on the 2nd and last Tuesday of each month; that Ordinance #14-76-894, Section 12.3.4, Sub-paragraph II, read that notice be mailed to property owners within 300 feet. VOTE IN FAVOR OF MOTION: Yes - 6 (Unanimous) MOTION CARRIED. Mr. Fleischer commented he was not aware of problems incurred with the previously required 300 feet, and that he see no reason to increase cost to taxpayers or waste of time- MOTION: By Mrs. Masters to have City consider raising application fee from $50 to $100. Mr. Russe stated he is compiling information on this matter and would bring this to the Board's attention at a later date. MOTION WITHDRAWN. Executive Session (Cont.) 4. Mr. Jaffe appeared before the Board regarding Special Use for health food restaurant at the old Allstate building. He stated that the parking space requirements have been fret. Mr. Russe. noted-that the Board was aware of a restaurant going in at this site when the property was previously rezoned. MOTION: By Mr. Pierce, seconded by Mr. Coburn, that the Special Use of the restaurant, as provided in C-2 zoning be approved. VOTE IN FAVOR OF MOTION: Yes - 6 (Unanimous) MOTION CARRIED. Discussion followed concerning the incomplete state of applications that com before. the Planning Board. MDTION: By Mr. Pierce, seconded by Mr. Michelson, that in the future all appli- cations, are to be completed before the applicant is given a date for public hearings. VOTE IN FAVOR OF MOTION: Yes - 6 (Unanimous) MOTION CARRIED. Mr. William Bayloga appeared before the Board. He represents a printing franchise company that is negotiating a transaction for operation at 7227 SW 57 Court, pending favorable approval of uses. MOTION By Mr. Fleischer, seconded by Mrs. Masters, to recommend a change in the C-2 Ordinance, paragraph 5.13.2, Uses Permitted, to ammend to include the following: Off-set duplicating and copy services (not utilizing movable type, or presses with a capacity. larger than 11 x 17) . VOTE IN FAVOR OF MOTION: Yes - 6 (Unanimous) Mr. Russe will check with Ed Moore regarding advertising and posting notices of hearings. Also, Mr. Russe will look into the matter of parking on the green right-of-way by Murai, and posting signs there. Regarding an oversized boat parked on 48th St. , between 63rd and 64th Avenue, Mr. Russe will see if there is any violation there. Publice Hearing #76-28, E]mear C. Chinn was heard first on the agenda, at the request of Mrs. Chinn, due to her failing health. PUBLIC HEARING #76-28 Elmear C. Chinn Request: Change of Zoning from RM-24 (Multiple Family Residence) to RO (Residential Office) . Legal Description: East 110 feet of the North 91 feet of Tract 2, LARKIN FOREST SUBDIVISION, PB 33/44. Location: 7400 S.W. 57th Court Mrs. Cathryn Shafer, 5801 S.W. 74th Terrace, friend of Mrs. Chinn, spoke in behalf of Mrs. Chinn. Mrs. Chinn was present in the chambers. She stated that Mrs. Chinn has owned the property since 1938 and resided there continuously since 1940. The property is surrounded by commercial sites, apartments and various business enterprises. The property has 10,010 square foot, not large enough to permit erection of multi-unit residential structure in accordance with zoning regulations. The necessary signatures of approval were submitted to the Board. This request represents a genuine case of hardship for Mrs. Chinn as the property cannot be built upon because of the small size and is no longer desireable as a single family residence because of the commercial i h:. PUBLIC HEARING #76-28 (Cont.) -2- character of the neighborhood. Mrs. Chinn has contracted to sell the property for office use. She then plans to trove to a retirement home in Virginia. The future owner of the site will not change the exterior of the structure, and provide ample parking spaces. Mr. Raul Garber, 5823 S.W. 74th Terrace, appeared before the Board. He stated it would be beneficial to grant Mrs. Chinn this change; that he was a concerned neighbor and supported her request to change the zoning. MOTION: By Mr. Fleischer, seconded by Messrs. Bowman and Michelson, to grant approval of request noting that the property as zoned for PM-24 cannot be utilized properly . on this site because of the small lot size and necessary frontage variances. VOTE IN FAVOR.OF NOTION: Yes - 6 (unanimous) NOTION CARRIED. PUBLIC HEARING #76-25 Goodyear Tire & Rubber Company Request: Variance to permit re-erection of pole sign. Legal Description: Lot 18, less beginning SW corner Northerly 35 feet of Southerly 64.12 feet west 100 feet to point of beginning and Lots 19 and 20, COOPERS SUBDIVISION, PB 4/152. Mr. .Neil Rollnick,Attorney, 2699 So. Bayshore •Drive, appeared before the Board, representing Goodyear. He stated that Claude Maintenance entered into a contract with Goodyear to replace antiquated signs in 1974. Prior to the .enactment of the new sign ordinance Claude removed the signs and attempted to attain a permit to re-erect the new signs. This permit was denied. At the time of removal, Claude was not. aware of the proposed revision of the sign ordinance and that .a new sign could not be put up. Before the sign ordinance was revised, the Board or Council had no power to grant a . variance regarding the pole sign and Goodyear remained without a sign and identification on the property it occupies. Goodyear intends to erect a new sign and in proper accordance with the sign ordinance. Goodyear is willing to enter into an agreement that would negate any paramount status or priority acquired by Goodyear through circumstances. It was noted that Goodyear does not own the property. They have another 10 years on the lease. Request cannot be returned to status quo as Goodyear wants to put up a new and modern sign. Mr. Russe stated that the Board cannot grant variance to a non- conforming sign; the variance has no period to time restriction, it goes with the land. However, Goodyear would agree to enter into an agreement voluntarily to specify a time limit in accordance with the ordinance. Mr. Fleischer stated he did not think the request qualifies as a variance; that the Board does not have the power to re-establish the status quo; this would create a president. NOTION: By Mr. Fleischer to deny request. No second. NOTION FAILS. PUBLSCE HEARING #76-25 (Cont.) -3- Discussion followed regarding Goodyear being caught inbetween changes in the ordinance and wanting to comply with City requirements. MOTICN: By Mr. Fleischer, seconded by Mr. Bowman, that the Board recognizes that the application as presented cannot be properly acted upon by the Board as a variance request; however, the Board recommends to the City Council that the administration return to Goodyear Tire and Rubber the use of a pole sign as set forth in the City Council minutes of September 7, 1976. It is further recommended by the Planning Board that a new sign be required in place of the old one, subject to the approval of the Building & Zoning Department ,and the City Council. 'v= IN FAVOR OF MCTION: Yes - 6 (unanimous) MDTION CARRIED. Mr. Michelson will attend the Council meeting to advise and further discuss the Boards decision. Location: Between Ludlam Road and SW 66th Ave. , and SW 74th Street and SW 74 Terrace. Mr. Coburn abstained from discussion' and voting in this request. Mr. Ortego, a surveyor, appeared on behalf of the owner, Mrs. Irene Galloway. Mr. Urbieta is under contract to purchase the property. He stated the present building on the property will be torn down or removed. - The 4 lots will meet the code requirements. p -4- PUBLIC HEARING #76-27 (ODnt.) Jose Urbieta Mr. Fleischer stated that he lives within 500 .feet of the property and .if in the future it is found that his comments are improper or out of line, he would wish his ccmments to be stricken. Mr. Ray Levin, a concerned.neighbor, asked .how water will be brought onto the property. Mr. Ortego stated the property will be serviced by General Waterworks, and will be approved by Dade County. The homes to be built will be approximately $65,000 price range. M:YrION: By Mr. Michelson, seconded by Mr. Bowman, to approve the request for approval. VOTE IN FAVOR OF I=ON: Yes - 5 . Abstain 1 (Mr. Coburn) MOTION CARRIED. Discussion followed regarding the proper amount of distance for notification (300 or 500 feet) . Mr. Russe will verify the amount. Plans to attend a Planning Workshop at FIU were discussed. Attention to this workshop was directed by Mrs. McCann. Workshop will be held October 30th, and members unanimously agreed to attend. Tuition will be paid with City funds. Mr. Michelson inquired if the City has received a recorded plat for the townhouses on Ludlam. Mr. Russe said he had been advised by the County proper applications and procedures for a condium has been filed with the County.
