BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF SOUTH MIAMI, FLORIDA:
That the application of HAL 'H. RHEA, for a variance to
permit the alteration of an existing residence in an RU-5A zone
to a dental office with the following variance:
West interior side setback of 8. 5 '
instead of 15 ' as required,

Public hearing before the City Council was originally
scheduled in the above subject matter for June 15 1971.
It is my understanding that this hearing has now been
moved up to June 8, 1971.
This letter is written for the purpose of requesting
that the hearing be post-poned (not withdrawn) until
July 20 or July 27 meetings . This request is made so
that the effect of the new comprehensive zoning ordinance
being considered at the June 8 meeting can be evaluated
prior to our hearing.

Dear Sirs :
The applicant, Dr. Hal H. Rhea, is requesting permission to
use the existing single family home located at 5725 S.W. 77th
Terrace for a dental office. The RU-5A zoning permits such
a use but requires that the building be located not less than
fifteen feet from an inside side lot line . The existing
building is eight foot six inches from the West side line
and therefore fails to meet that requirement. We are
requesting that that requirement be waived so that the
'building may 'be converted without removing any portion of
it.
There is presently located on the rear portion of this
property an apartment. This building is detached and as
such fails to comply with Ordinance 568, which ordinance
prohibits accessory buildings . We are asking that the
building be allowed to remain. J
The RU-5A classification prohibits parking in front of the
front building line. The front building line for this
property is that line located twenty-five feet back of and
North of the Street line of S .W. 77th Terrace . We are
requesting that four of the eight automobiles to be parked
for this use be permitted to extend beyond the front building
line .
The applicant will comply- with the other conditions of RU-5A.
Because of the .present location of the existing building it
is impossible to comply with the required setback without
the variance sought. It is also more desirable to place the
parking in front of the building rather than putting- four cars
in front of the building and two cars in back of the building.

in no way detract from the present desirability of the
