No. 245-97-10215RESOLUTION NO.245-97-10215 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE APPROVAL OF A "MAJOR CHANGE"TO A PLANNED UNIT DEVELOPMENT- HOSPITAL AS SPECIFIED IN §20-5.12 (F)OF THE SOUTH MIAMI LAND DEVELOPMENT CODE,ALLOWING FOR THE REDISTRIBUTION OF APPROVED SQUARE FOOTAGE IN ORDER TO CONSTRUCT A MEDICAL OFFICE BUILDING AND PARKING GARAGE; PROVIDING FOR A LEGAL DESCRIPTION;PROVIDING FOR CONDITIONS;AND,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,on June 4,1985,the City Commission voted to adopt Resolution No.54-85-7019 which granted a special use permit for Application #84-19(with addendum)foraPlannedDevelopment- Hospital District (PD-HD)knownasSouthMiamiHospital;and, WHEREAS,said Planned Development-Hospital District (PD-HD) has been amended,from time totime,by the City Commission;and, WHEREAS,South Miami Hospital,located 6200 S.W.73 Street, South Miami,Florida 33143,is legally described in the legal description attached hereto and entitled as "Exhibit 1;"and, WHEREAS,pursuant to Section 20-5.12 (F)entitled "Changes to Final Plans and Reports"under sub-Section (1)"Major Changes" of the adopted Land Development Code of the City of South Miami, a major change is defined under sub-section (a)as follows: *Any proposed change which would have the effect of increasing densities or redistributing square footage or altering the height or use of a development is a major change;"and, WHEREAS,pursuant to the aforesaid Section 20-5.12 (F), South Miami Hospital has made formal application to amend the final plans approved by the above referenced resolution,and as amended from time to time by City Commission action;and, WHEREAS,on October 21,1997,the Environmental Review and Preservation Board [ERPB]voted 4:0 for preliminary site plan approval of the proposed major change to the approved PUD;and, SMH PUD Amendment:Public Hearing November 18,1997 WHEREAS,on October 28,1997,the Planning Board voted 7:0 to recommend approval oftheapplication,as presented;and, WHEREAS,the Mayor and City Commission desire to accept the recommendations of the Planning Board and the decision of the Environmental Review &Preservation Board [ERPB]. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1. A.FINDINGS OF FACT 1.The recitals in the Whereas clauses are incorporated and made a part of these findings of fact; 2.The application proposes redistribution of approved building area,in order to allow for construction of a four-story medical office building addition to the existing three-story North Tower on the eastern side of the Main Entrance and a nine-level parking garage on the western side of the Main Entrance;and, 3.The staff report by Mr.Gregory J.Oravec,Planner, which is dated October 23,1997,is incorporated and made a part of these findings of fact. B.CONCLUSIONS OF LAW 1.The application is consistent with the provisions and limitations of the approved Planned Unit Development; 2.The application is consistent with the City's adopted Land Development Code;and, 3.The application is consistent with the City's adopted Comprehensive Plan. Section 2.The application to amend the final plans for the South Miami Hospital Planned Development-Hospital District is hereby approved,as detailed in the submitted plans,which are attached hereto and entitled as "Exhibit 2." SMH PUD Amendment:Public Hearing November 18,1997 Section 3.The oral representations made by the applicant at the City Commission Meeting of November 18,1997,are hereby made conditions for approval,unless otherwise waived or modified xn writing by the City Manager or his designee. Section 4.Section 4,Item 3,of Resolution No.2-97-9973 is amended to insert the words "as amended"immediately following the words "1985 PD-HD;"and,Section 5 is amended to insert the words "as amended"immediately following the words "1985 PD-HD." Section 5.The City Manager shall have final approval and authority over all matters regarding the determination of the applicant's compliance with the intent of these sections. Section 6.The sections contained herein arean amendment to the approved South Miami Hospital Planned Development-Hospital District.The applicable sections and provisions of all previous approvals and amendments are hereby incorporated and preserved. Section 7.Thesectionabovedoesnotrestrictthisorany other applicant from making application(s)for further amendments orother modifications underthe provisions ofSection 20-5.12 or any other applicable section(s)of the Land Development Code. OnJune4,1991,theCity Commission adopted Resolution No.82-91-9146,which approved an increase of 2,100 square feet ±to house a permanent magnetic resonance imaging operation,which ><*H wastoreplacetheexistingtemporaryfacility(atrailerunit)onthecampus. OnMay 4,1993,theCityCommissionadoptedResolutionNo.75-93-9819,whichapprovedthe reductioninheight of theproposedMedicalOfficeBuildingfromeight(8)storiestothree(3) stories,relocation of theparkingfacilitysouth of SW73Streetintheform of afive-levelgarage, inclusion of 6200SW72Streetand6250SW72Streetintheplannedunitdevelopmentcampus, increase of thesouthparkinggaragebyonelevelforfutureneeds,and deletion oftheprevious MRI approval. OnJanuary7,1997,theCity Commission adoptedResolutionNo.2-97-9973,which approved the construction of a2,225squarefootchapelandacoveredpatio area,anddeniedahelistop. OnOctober7,1997,pursuanttoSection20-5.12(F)oftheadoptedLandDevelopmentCode, SouthMiamiHospitalsubmittedanapplicationfora"MajorChange." On October 21,1997,the Environmental Review and Preservation Board (ERPB)voted 4:0 to approvetheapplication. Theapplicantisrequestingtoredistributeapprovedsquarefootage,allowingfortheconstruction of amedicaloffice building andparkinggarage.The applicant proposes tobuildthemedical officebuildingasa4-storyadditiontotheexisting 3-story NorthTowerlocatedontheeastern side of theMainEntrance Mall.Theproposednine-levelparkinggaragewouldtaketheplace of theexisting surface parking lotonthe west side of theMainEntrance Mall (seeattachments). ANALYSIS Theissuesinvolvingthisapplicationincludebuildingintensity,parking,andimpactonthe surroundingproperties. Building Intensity TheSouthMiamiHospitalCampusiscurrentlyapprovedforatotal building area of 1,175,109 squarefeet.Currently,existingandapprovedbuildingstotal879,833squarefeetinarea. Therefore,the Hospital hasan additional permitted building area of 295,276 square feet.The applicantisseekingtoredistributeaportion of the additional permitted squarefootageintoa 69,700squarefoot medical officebuildinganda197,300squarefoot parking garage.The combined square footage of the proposed additions totals 267,000 square feetand would leave the Hospital an additional permitted building area of 28,276 square feet. The intensity of development isgaugedby comparing theratio of building areatototallandarea. As previously stated,the applicant is redistributing squarefootage,not increasing it.Therefore, thereisno increase inthe intensity of development. Parking The proposed parking garage would provide atotal of 687 parking spaces.Asa result of the proposed medical office building*andthefactthatthe garage would replace an existing surface parkinglot of 80spaces,thegaragewouldprovideanet increase of 247 parking spaces. ♦Medical office buildings arerequiredtoprovideonespaceperevery200squarefeet.Thus,theproposed72,000squarefoot office building would require360 of the687parkingspaces(72,000sq.ft./200sq.ft.perspace). Impact on Surrounding Properties The proposed seven-story medical office building and nine-level parking garage are both 85 feet tail.The structures would not negatively affect the surrounding properties because the properties to the north,east,and west are zoned MU-5,a subdesignation of TODD,which allows eight- story development to 100 feet in height;and,the Hospital is bordered tothe south by South Dixie Highway. Since the hospital is not exceeding the approved building intensity,there will not be any uncalculated increaseindemandonpublic infrastructure. The 4-story medical office building addition will notbe classified as "hospital"use.Therefore,it willnotbepropertytaxexempt. COMPREHENSIVE PLAN The requested changes to a Planned Unit Development do not conflict with the adopted ComprehensivePlan of theCity of South Miami. APPLICABLE REGULATIONS Land Development Code •Section20-5.12(Major Changes inaPUD) CONCLUSION South Miami Hospital's proposal does not exceed the adopted intensity of the development,and ifdoes noTputim RECOMMENDATION Staffrecommends APPROVAL ofthe application. With the merger of South Miami Hospital into Baptist Health Systems of South Florida in 1995, we reviewed thiskey project inorderto validate thatit should be built,when to build and where to build both the Medical Office Building and related parking to serve the new physician's offices as well asthe Hospital campus in general.This review led tobea different siting for both the office building and for the parking deck than had been previously anticipated. South Miami Hospital wishes to construct the medical offices ina four-story addition tothe existing three story North Tower at the East side of the Main Entrance Mall.The parking garage would thenbe constructed onthecurrent surface parking lotattheWestside of theMain Entrance Mall.Whenthe North Tower was constructed intheearly 1990*s,foundationsand structure were included for an additional four floors. Further information on this proposed project includes the following: -Medical Offices tobe housed ina4-story addition tothe existing 3-story North Tower.
