A .RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO A REQUEST FOR
A SPECIAL USE PERMIT FOR A "RESTAURANT,GENERAL",
PURSUANT TO SECTION 20-3.4 (B)(4)(b)OF THE LAND
DEVELOPMENT CODE,REGARDING THE PROPERTY LOCATED AT
5837 SUNSET DRIVE,SOUTH MIAMI,FLORIDA 33143;
PROVIDING FOR A LEGAL DESCRIPTION;AND,PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS,the potential tenants,Messrs.Kleinand Gordon,
as co-proprietors of the Epic Food Corporation (Jada Restaurant),
have submitted an application to request a Special Use Permit in
order to operate a "Restaurant,General,"as specified in the
provisions of Section 20-3.4 (B)(4)(b)of the Land Development Code,
located inthe WSR"Specialty Retail/Residential zoning district
and the Hometown District;and,
WHEREAS,subjectpropertyislocatedat5837Sunset Drive;
South Miami,Florida,33143,andis legally described asfollows:
Lots 5,6,8,9,and West2feetofLot 7,lessthe
south 4.18 feet,WW.A.LARKIN'S,"according to the
plat thereof as recorded in Plat Book3atPage198of
the Public Records of Dade County,Florida;and,
WHEREAS,the applicant has submitted a copy ofa signed
lease with the property owner ofthesubject property;and,
WHEREAS,Planning &Zoning Division staffhas recommended
approval ofthe application fora Special Use Permit,which
recommendation is based upon (a)themeritsofthe application and
(b)consistency with theCity's adopted Comprehensive Plan;and,
WHEREAS,on September 9,1997,the Planning Board voted 6:0
to recommend approval ofthe Special Use Permit;and,
WHEREAS,the Mayor and City Commission ofthe City of South
Miami desire to accept the recommendation ofthe Planning Board.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI,FLORIDA:

Section 1.The request submitted byEpic Food Corporation,
proposed tenant,foraSpecialUsePermitinordertooperatea
"Restaurant,General,"which istobe located in the "SR"
Specialty Retail/Residential zoning district and located in the
Hometown District,pursuant to Section 20-3.4 (B)(4)(b)and
Section 20-7.12(A)of the Land Development Code,is granted.
Section 2.This approval is subject to and dependent upon
the restriction and limitation ofthe "Restaurant,General"use
to5837 Sunset Drive and as indicated onthe submitted siteplan.
Section 3.TheCityManagermayrevokethisapprovalupona
determinationthatanyotherportionofthe property,legally
described herein,is being utilized for restaurant purposes,
including storage,food preparation,deliveries or any services
related to restaurant uses,which arenot authorized and licensed
bytheCityofSouthMiamiforthe subject property.
Section 4.TheCity Manager may revoke this approval upon a
determination thatanyother property is being utilized for
restaurant purposes,andsuchuseisrelatedtothesubject
property,butsuchuse has notbeen authorized and licensed by
theCityofSouth Miami,including storage,food preparation,
deliveries or any other services related tothis restaurant use.
Section 5.TheCity Manager shallhavefinal approval and
authorityoverallmattersregardingthe determination ofthe
applicant's compliance withthe intent ofthis resolution.
Section 6.This resolution shall take effect immediately
upon approval.

BACKGROUND &ANALYSIS:
The applicant,EpicFood Corporation (Jada Restaurant),is requesting a special usepermitin
ordertooperateageneralrestaurantat5837SunsetDrive.Theprevioususeatthislocationwas
LaposseCafeBakerywhichwasapprovedforaseatingcapacity of 38patrons.Theproposed
restaurantwillcontaintablesandchairstoaccommodate approximately 77customers,asshown
ontheproposedfloorplanpresentedaspart of this application.Theapplicantisplanningto
applyforoutdoorseatingwhentheSunsetDriveImprovementsprojecthasbeencompleted.
Thedefinition of GeneralRestaurant,specialuseconditionsforalluses,andspecificconditions
for General Restaurant are included below:

Restaurant,general.Shallmeananestablishmentwherethe principal businessisthesaleoffoodandbeverages
tothecustomerinaready-to-consumestateandwherethedesignorprincipalmethodofoperationconsistsof
either of the following:
Sit-down restaurants where customersarenormallyprovidedwithan individual menuandfoodand beverages are
generallyservedinnon-disposablecontainersbyarestaurantemployeeatthesametableorcounteratwhichsaid
items are consumed;or,

Cafeteria-typerestaurantswherefoodandbeveragesaregenerallyservedinnon-disposablecontainersand
consumedonthepremises.All suchcafeteria-typeestablishmentsshallprovideonlyinsideorpatioserviceon
private property.
CateringserviceshallbeallowedasanadditionaluseintheSRzoningdistrict.
Ineitherthecase of Sit-down orCafeteria-type restaurants,publicstreets,rights-of-way,andsidewalksmaynot
beusedforpatioorstreet-sideservices of anykind.Thisusemayincludetakeoutservice,butexcludeanyservice
toacustomerinamotorvehicle.Seatingmustbeprovidedforallpatronsdiningonthepremises.
The proposed useislocatedinthe "SR"Specialty Retail/Residentialzoning district andthe
HometownDistrict.A "restaurant,general"ispermittedasindicatedunderSection20-7.12(A)
of theLandDevelopmentCode [use listedon page 156];however,theuseisnotedbyan asterisk
whichisexplainedunderSection20-7.12(C)[found onpage 158],indicatingthat"usesmarked
withanasteriskrequireaspecialusepermit."Thus,suchusesmustmeetthe requirements for
special usescontainedunderSection20-3.4andSection20-5.8 of theLandDevelopmentCode.
TheserequirementsarethesamethroughouttheCity,andexcerptedsectionsareincludedbelow:
SPECIAL USE CONDITIONS
(A)General Requirements [fromSection20-3.4;foundonpage39 of the Land Development Code]
(1)Allsuchusesshall comply with allrequirementsestablishedintheappropriatezoningusedistrict,unless
additionalormore restrictive requirementsaresetforth below or by theCity Commission.
(2)All suchusesshall be determined tobe of acompatibleand complementary nature with any existing or
planned surrounding uses.
(3)ApublichearingshallbeheldbytheCityCommissiontodeterminetheoverall compatibility of theuse
with the surrounding neighborhood.
(B)Special Requirements [from Section 20-3.4;found onpage40 of the Land Development Code]

i.All such establishments shallprovideonlyinsideorpatioserviceonprivateproperty.Public
streets,rights-of-way,sidewalks andrequired setbacks may notbe used forpatioorstreet-side

ii.No services of a drive-in or of afastfoodnatureshallbe permitted.
iii.The City Commission shallreviewand recommend approval,disapprovalor modification of all
siteplansand project specifications forthisSpecialUsePermit.

ANALYSIS:
Staff believes thatthe requested special use complies withtheoverall requirements statedunder
Section20-5.8 of theLandDevelopmentCode[foundonpage 111],regardingtherequired
conditions for special use approval bytheCity Commission.Specifically,staff finds thattheuse
meets the conditional requirements setforthin Section 20-3.4andthattheuse:
a)Willnot adversely affectthehealthor safety of persons residing or working inthevicinityofthe
proposed use[Section20-5.8(B)(1)(a)];
b)Willnotbe detrimental tothepublic welfare or property or improvements inthe neighborhood
[Section 20-5.8 (B)(1)(b)];and,
c)Complies withallother applicable Code provisions [Section 20-5.8 (B)(1)(c)].
The Planning Board voted 6:0to recommend approval ofthe Special Use Permit,inorderto

cellophane shrimpspiders with scotch bonnet jam,and grilled skirt steak,chimichurri,and
plantain hash.As well,the restaurant will be serving a variety of sakes and California wines.
