We live adjacent to this property in question at 5712 S.W. 77 Terrace, Legal Description: The West 70 feet of Lot 1, Blk. 4, Fairglade Park, PB 4080. We have lived here approximately 16 years, and as the records in the Zoning Department and Council meetings will show, we have repeatedly appeared before the Zoning Board and the Council to protest changes in zoning from residential to office, commercial or otherwise which would be detrimental to the neighborhood. Introduction of a business of this nature will produce a volume -of unusual . traffic disrupting the tranquility of a wellestablished neighbor- hood. that has been consistently residential in character for many years. It will create unwelcomed and unnecessary noise and disturbances, dust and many other accompanying nuisances associated with this type of commercial enter- prise which would be intolerable to us and to the rest of the citizens resid- ing in the immediate vicinity. We, therefore, feel that approval of such a Special Use Permit in entirely out of line, and as the present zoning indicates, we would not be opposed to use of the property as presently zoned — RO (Res den bi 5;1 Office) zoning. Legal Description: The East 80.3 feet of Lot 1, Block 4, Fairglade Park, PB 40/80 Location: 5700 S.W. 77 Terrace Dr. William Glenn owner of the property spoke in favor of a day nursery at this location. He feels there is a great need for a nursery here, and that it would also enable the property to keep its residential home appearance. Mr. Edward Styes owner of the adjacent property opposes the nursery and had previously sent a petition signed by the immediate neighbors who also oppose the nursery. They claim the traffic involved in delivering and picking up the children would upset their peaceful neighborhood. MOTION: By Mr. Fleischer, seconded by Mr. Pierce for denial. VOTE IN FAVOR OF MOTION: Yes - (6) No - (0) Absent - (1) NOTION CARRIED. Public Hearing # 74-13 Thad Mark Request: Variance of side setback requirements 0 feet (15 feet required) to permit the continued use of an existing building from the side property line; variance of rear setback requirement 10 feet - (15 feet required); and variance of parking requirements to permit 49 (51 required) parking spaces for the afore mentioned building.
