RESOLUTION NO.152-97-10122 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI #FLORIDA,RELATING TO A REQUEST FOR A SPECIAL USE PERMIT FOR A "GASOLINE SERVICE STATION" IN ORDER TO PERMIT ADDITIONAL SIGNAGE,PURSUANT TO SECTION 20-3.4(B)(5)OF THE LAND DEVELOPMENT CODE, REGARDING THE PROPERTY LOCATED AT 6350 SOUTH DIXIE HIGHWAY,SOUTH MIAMI,FLORIDA 33143;PROVIDING FOR A LEGAL DESCRIPTION;AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,theapplicant,Amoco OilCompany,represented by Petropac,Inc.,hasmadean application to request a special use permit for additional signage at a "Gasoline Service Station"in the UGR"General Retail zoning district,pursuant to provisions forthegrantingof exceptions bytheCityCommissioncontained in Section 20-3.4(B)(5)of the Land Development Code;and, WHEREAS,thepropertyislocatedat6350 South Dixie Highway South Miami,Florida,33143,and is legally described asfollows: Lots 8,9,and 10,Block 4,of "OAK HEIGHTS,"according totheplatthereofas recorded inPlat Book 46atPage 64of the Public Records of Dade County,Florida;and, WHEREAS,Petropac,Inc.,isthe recognized representative of the Amoco OilCompany,as evidenced bythe public record;and, WHEREAS,Planning Divisionstaffhas recommended rejection ofthe application fora Special Use Permit,which recommendation is based upon (a)review for compliance with Section 20-3.4(B)(5) oftheLand Development Codeand (b)reviewfor compliance withthe adoptedComprehensive Plan;and, WHEREAS,staffbelievesthattheapplicationdoesnotcomply with the provisions of Section 20-3.4 (B)(5),but does comply with the provisions of the City's adopted Comprehensive Plan;and, WHEREAS,on July 8,1997,the Planning Board voted 5:0to recommend approval ofthe Special Use Permit,withthecondition thatonly additional signage forthesouth elevation,shownas the "right side"elevation inthe drawings,be approved;and, AmocoSignageSpecialUse:PublicHearingJuly 29,1997 Page 2 of Res.#152-97-10122 WHEREAS,the Mayor and City Commission of the City of South Miami desire to accept the recommendation of the Planning Board. Location:6350SouthDixieHighway South Miami,Florida 33143 BACKGROUND In October of 1996,the applicant appealedan Environmental Review &Preservation Board decision before the City Commission.At that meeting the applicant was approved for specific elements of the project like design,color,signage and landscaping.Asa result of this appeal,the ERPB was charged withtheduty of creating new rulesand regulations for gasoline service stations.These new regulations were developed and approved by both the Planning BoardandtheCity Commission.The new regulations containguidelinesforoperation,design,signage,landscaping,etc.of gasoline service stations [see Exhibit A]. TheapplicantisnowrequestinganexceptionpursuanttoSection 20-3.4(B)(5)ii toplace additionalsignageonthepropertywhichdoesnotfollowtheguidelinessetforthinthe newregulationsandchangestheapprovalpreviouslygrantedbytheCity Commission. ANALYSIS Thenewservicestation regulations weredevelopedto promote design which is architecturally compatiblewiththesurroundingareaandthe design goals of the community.Staff findsitdifficulttorecommendapproval of an exception whenthe subject property currentlyhasexistingsignsonthesite including apolesignonSouth DixieHighwaywhichprovidesufficientidentificationforthe establishment andexceed thepermittedregulatorystandards.Staff hasreceivedanumber of positive comments regardingthecurrentaesthetics of theservicestationandbelievesthat additional signage will adversely effect the appearance of the property.,< COMPREHENSIVE PLAN This requested Special Use Permit does not conflict with the adopted Comprehensive Plan of the City of South Miami. APPLICABLE REGULATIONS Land Development Code •Section20-3.4(B)(5)(Special Use Conditions) RECOMMENDATION Staff recommends REJECTION ofthe special use permit. ...\SM01\Planning\PB\Reports\AmocoStaffReport it (5)Gasoline Service Station (a)Objectives of thissub-Section EXHIBIT A i.The following standards are established for service stations to ensure that such uses shall be compatible with other uses permitted in the same district and to protect the public health,safety and welfare of the community. ii.These standards are to promote design which is architecturally compatible with the surrounding area and the design goals of the community. (b)Applicability i.This section shall apply to all new service stations,additions or renovations in excess of 510,000 as determined by the City including tank removal or upgrades. ii.Exceptions to this section can be approved by the City Commission. (c)Appearance i.All structuresonthesiteshallcreatea unified architectural theme. ii.Service station roofs shall be pitched with generous overhangs.The roofing shall be incombustible materials such as shingle,claytile,cement tile,or metal. iii.The canopy shall be restricted to a clearance of 13 feet in height and shall be consistent withthemain building design.Thecanopycolumns shall be architecturally finished to match the building. iv.The useof flat steel or metal panels for the exterior wails of the service station shall notbe permitted. v.The rear and sides of buildings shall be finished with material that in texture and color resembles the front of the building. vi.Glass windows and doors must make up 35%of the primary elevation and 15%of the secondary elevation.This calculation is excluding areas designated asservicebays. Exhibit.i (ERPB Language Package/I /r vii.The adopted color palette and painting standards shall be applied;however the use of"earth tone"or light pastel colors shall be encouraced.The use of gray tone colors shall notbe permitted. viii.Perimeter walls of the site shall be architecturallv compatible with the principalstructure. (d)Landscaping The service station must comply with section 20-4.5 landscaping requirements as well as the items specified below: i.The service station site landscaping must be compatible with the existing landscaping of the surrounding community. ii.Street tree requirements shall be altered to require palm clusters on the ends of the landscape buffer parallel to the service pump canopy.The palm clusters shall consist of three palms with a minimum height of 13 feet. iii.The use of planters and window boxes shall be incorporated into the overall landscape design ofthe building and the site. iv.The service pump island shall contain planters on the ends equal to the width of the island. v.Where hedges are required,a tiered effectis required. vi.Landscaped areas shall be surrounded withasix-inch raised concrete curb. Grade within areas tobe landscaped shall be raised to curb-height. (e)Signage andLighting i.Landscape signs pursuant to section 20-4.3 (I)(5)shall be used in place of poleorpylonsigns. ii.Canopies shall not contain any signage,striping or super graphics. iii.Temporary window signage shall notbe permitted. iv.Lighting fixtures shall be baffled and arranged so that illumination is deflected away from adjacent properties and roadways. Exhibit A 'ERPB Language Package) nr (0 Ancillary Uses i.The sale of snack foods,soft drinks,candies,gum.cigarettes and related items,but not alcoholic beverages,is permitted within approved principle building structures.h»»««Pic ii.The sale of automotive service items such as motor oil,ami-freeze or allied products is permitted within approved principle building structures. iii.There shall be no storage or display of any merchandise including tires outside of the principle building structure. iv.On-site preparation of ready-to-consume food is only permitted via special use approval.r v.Automatic Teller Machines shall be permitted only within or as apart ofthe principal building. (g)Operationand Maintenance i.No sales,rentals,leasing of storage space,major engine,painting,body work,tire recapping or dismantling of any kind shall be permitted on the service station site.No vehicle may be parked on the site for more than 48 hours. ii.No storage of used auto parts or wrecked vehicles,including water craft and trailers,shall be located outside the principle structure. iii.At ail times the premises shall be maintained in a clean and orderly condition and landscaping must be maintained in a healthy and viable condition.
