WHEREAS,the applicant,Sega GameWorks,L.L.C.,onbehalfof Bakery Associates,Ltd.,hasmade application,inorderto request a Special Use Permit to operate a "Restaurant,General,"tobe locatedinthe"SR"Specialty Retail/Residential districtandin the Hometown District,pursuant to Section 20-3.4 (B)(4)(b)and Section 20-7.12 (A)ofthe City's Land Development Code;and, WHEREAS,the property islocatedaspartof5701Sunset Drive, South Miami,Florida,33143,and is legally described ina document attached hereto and labeled as,"Exhibit 1;"and, WHEREAS,the property ownerhassubmittedaletterofintent authorizingthefutureuseproposedbytheapplicant;and, WHEREAS,Planning Division staffhas recommended approval of the application fora Special Use Permit,which recommendation is basedupon (a)themeritsofthe application and (b)consistency with the City's adopted Comprehensive Plan;and, WHEREAS,on July 8,1997,the Planning Board voted 4:1 to recommendapprovaloftheSpecialUse Permit;and, WHEREAS,the Mayor andCityCommissionoftheCityof South Miamidesiretoacceptthe recommendation ofthe Planning Board. NOW,THEREFORE,BEITRESOLVEDBYTHE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.The request submitted by Sega GameWorks,tenant, fora Special Use Permit to operate a "Restaurant,General,"which istobe located inthe"SR"Specialty Retail/Residential district and the Hometown District,pursuant to Section 20-3.4 (B)(4)(b)and Section 20-7.12 (A)of the Land Development Code,is hereby granted. Section 2.This approval is subject to and dependent upon the restriction and limitation of the "Restaurant,General"use to the project at 5701 Sunset Drive as indicated onthe submitted plans. Section 3.TheCityManagermayrevokethis approval upon a determinationthatanyotherportionoftheproperty,legally described herein,is being utilized for restaurant purposes, including storage,food preparation,deliveries orany services related to restaurant uses,which arenot authorized and licensed bytheCityofSouthMiamiforthe subject property.
