WHEREAS,theCity Attorney retained outside realestatecounselto perform title workforavarietyof matters,including lien foreclosures,Davis Gardens,andan unsafe structure;and, WHEREAS,theCity Attorney recommends payment oftheattached invoices for attorney's fees and costs received from Bailey &Jones in the total amount of $10,088.29 for services rendered in performing titlework. Unfortunately,theprojectturnedouttobe much more complicated than we initially believed.Thecomputer data basegoes backonlyto 1976 andinmany of these files,the properties had been acquired many years beforethen.Ultimately,wehadtoorder manualtitlesearchesformany of theproperties,some of which went back tothe 1940's inordertogetwhatiscalleda "base of title".The deliverytimeforthesebacksearcheswas several weeks. Due to the nature of the owners,most of the searches involved dozens of documents;we endedup receiving and examining nearly six thousandpages of information.In many cases,therewere probatedocumentstoexamine,aswellasjudgmentsfiled against the owners and individuals with similar names.In several cases,it wasnecessarytoconductanexamination of the Secretary of State's corporate records. APP.2 EarlG.Gallop,Esquire Tuesday,April 29,1997 Page2 We alreadyhavebilledtheCity for thecostsadvancedforthetitle information.Ihaveheld off billingtheCityforthelegal fees involvedinthe examinations until I knew thefull extent of the time involved.The total time involved exceeded sixtyhours for Charisse and twenty-twohours for me.Some of the files tooklesstime,sometookmore,butit averaged outtothreehours of paralegal time @ $75/hour and one hour of attorney time@ $250/hour for each of thetwenty files.Accordingly,the actual fees per file maybe stated as$475.00.This obviouslyismuchhigherthanyouandIinitiallyhadanticipated,soIwouldliketo reducetheperfilefeeto$250.
