At the September 16, 2014 City Commission meeting, the Mayor and Commission adopted a new fee schedule allowing funding which will cover the cost of services provided. Still photo and filming fees in the amount of $1,500 and $8,000 per day, respectively, were tentatively recommended by City staff and subsequently approved by the Commission. After thorough review and discussion with various municipalities and industry professionals, City staff recommends revising professional still photos and filming fees as follows: Professional Photos & Filming (8:30 a.m. -5:30 p.m.) Still photo fee: $100jday Filming fee (1-10 person crew): $200jday Filming fee (11-20 person crew): $300jday Filming fee (21+ person crew): $500jday City staff believes the proposed fee structure is competitive compared to other local municipalities in Miami-Dade County and reasonable for industry professionals. Furthermore, staff is confident that professional still photo and filming activity will rise due to the reduction of fees. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The Schedule of Fees and Fines, as approved in Ordinance 12-16-2245, is hereby amended to provide professional photos and filming fees for special events, as outlined below. Still photo fee: Filming fee (1-10 person crew): Filming fee (11-20 person crew): Filming fee (21+ person crew): $100jday $200jday $300jday $500jday Section 2. The most recently adopted Schedule of Fees Ordinance 12-16-2245, hereto attached, shall rema'in in full force and in effect and shall include the reduced professional photos and filming fees. Section 3. Any such fees may be waived or reduced by the Mayor and City Commission by way of Resolution. Section 4. Severability If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 Section 5. Ordinances in Conflict All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 6. Below is the recommended Fee schedule for the City of South Miami Filming and Still Photography Permit. Recommendation -City of South Miami Filming and Still Photography Permit Still photo fee: Filming fee (1-10 person crew): Filming fee (11-20 person crew): Filming fee (21+ person crew): $100/day $200/day $300/day $500/day ORDINANCE NO. 22-14-2200 An Ordinance relating to the fee schedule; amending ordinance 04-11-2077 to change the title to "Schedule of Fees and Fines" and to increase some fees, adding new fees, and deleting some fees from the schedule. WHEREAS, the Mayor and City Commission desires to adopt a new Fee Schedule allowing funding which will cover the cost of services provided; and, WHEREAS, the Mayor and City Commission desire to revise the adopted Fee Schedule allowing funding which will cover the cost of services provided; and, NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That Ordinance 04-11-2077 is hereby amended so as to change the title of the City's Fee Schedule and to increase some fees, adding new fees, and deleting some fees from the schedule all as set forth on the attached. Section 2. Any such fees may be waived or reduced by the Mayor and City Commission by way of resolution. Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity ofthe remaining portions ofthis ordinance. Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, that give the appearance of being in conflict when the two ordinances can be harmonized or when only a portion of the ordinance in conflict needs to be repealed to harmonize the ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby amended to harmonize the two ordinances. Therefore, only that portion that needs to be repealed to harmonize the two ordinances shall be repealed. Section 5. Effective Date. This ordinance shall become effective upon enactment.
