No. 041-97-10012RESOLUTION NO.41-97-10012 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,RELATING TO INSTALLATION OF THREE NEWSRACK DEVICES BY THE CORAL GABLES GAZETTE, PURSUANT TO ORDINANCE NO.12-90-1451;AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,on August 21,1990,the City Commission adopted Ordinance No.12-90-1451,which regulates the placement,design, location and licensing of newsracks in City of South Miami;and, WHEREAS,on Monday,October 28,1996,an application was submitted by Coral Gables Gazette forthe location of newsracks as described in the attached application;and, WHEREAS,two newsrack locations have met the criteria set forth in Ordinance No.12-90-1451 and have been installed;and, WHEREAS,three additional locations now meet the criteria set forth in Ordinance No.12-90-1451;and, WHEREAS,the City Commission desires to approve installation of three newsracks at the those locations which conform to the requirementsofsaidOrdinance No.12-90-1451,andspecifically located next to the existing newsracks at 5898 Sunset Drive (in front Lee's Pharmacy),at7222 Red Road (previous location of Goody Bakery),andat5730 Sunset Drive (in frontof Moseley's). NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Three conforming locations for placement of newsrack devices at 5898 Sunset Drive,at 7222 Red Road and at 5730 Sunset Drive,as contained in the application submitted by Coral Gables Gazette,are approved,per Ordinance No.12-90-1541, Section 2.This resolution shall take effect immediately upon approval. BACKGROUND &ANALYSIS: ThefollowingresolutionispresentedpursuanttoOrdinanceNo.12-90-1451,whichrequiresthe approval oftheMayorandCity Commission for placement of newsracks withinthe boundaries ofthe City.Ordinance 12-90-1451 establishes standards andan application process.Applicants mustmeetalloftherequired standards for color,placement,design,locationandlicensingfor newsrackspriortoapprovalbytheCity Commission. InOctober,1996,CoralGablesGazetteappliedforsixlocationswithintheCity of SouthMiami. Staffvisitedthe proposed sitesto confirm compliance with Ordinance No.12-90-1451.Only twoofthesixofthe proposed locations metthecriteriafor location inthe ordinance.Thesetwo locations were approved atthattime. Three additional sitesnow meet criteria setforthinthe ordinance.Staff is requesting approval forthesethree locations.The applicant will return with revised locations forthe remaining site.
