A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA,RELATING TO THE REQUEST
FOR SPECIAL USE PERMIT APPROVAL,IN ORDER TO OPERATE A
URESTAURANT,CONVENIENCE,"AS SPECIFIED IN SUB-SECTION
20-3.4 (B)(4)(a)OF THE LAND DEVELOPMENT CODE,LOCATED IN
THE WI"(INTENSIVE)ZONING DISTRICT AND,SPECIFICALLY,
LOCATED AT 5821 S.W.70 STREET,SOUTH MIAMI,FLORIDA,
33143;AND,PROVIDING FOR A LEGAL DESCRIPTION.
WHEREAS,subject property is located at 5821 Commerce Lane;
South Miami,Florida,33143,and is legally described as follows:
Lots 36,37,38 and 39,Block 9,"TOWNSITE OF LARKINS,"
according tothe plat thereof as recorded in Plat Book
2at Page 105ofthe Public Records of Dade County,
Florida;and,
WHEREAS,Mr.Juan Toral,tenant of the subject property,
submitted an application requesting a Special Use Permit,in
ordertooperatea "Restaurant,Convenience,"asspecifiedunder
sub-Section 20-3.4 (B)(4)(a)of the Land Development Code;and,
WHEREAS,subjectpropertyislocatedinthe UI"(Intensive)
zoningdistrictwhichpermits "Restaurant,Convenience"asa
specially permitted use,pursuant to applicable conditions;and,
WHEREAS,the tenant submitted a letter of consent from the
property owner authorizing the use,which letter ison file in
the Planning &Zoning Division;and,
WHEREAS,Planning staffhas recommended approval ofthe
application fora Special Use Permit,which recommendation is
basedupon (a)the merits ofthe application asit directly relates
to specific requirements in the Land Development Code and (b)
consistencywiththeCity'sadoptedComprehensive Plan;and,
WHEREAS,on January 14,1997,the Planning Board voted 5:0
to recommend approval ofthe Special UsePermit;and,
WHEREAS,the Mayor and City Commission ofthe City of South
Miami desire to accept the recommendation ofthe Planning Board.
NOW,THEREFORE,BE IT RESOLVED BYTHEMAYORAND CITY COMMISSION OF
THE CITY-OF SOUTH MIAMI,FLORIDA:

Section 1.The application submitted by Mr.Juan Toral,
property tenant,requesting a Special Use Permit to operate a
"Restaurant,Convenience"as specified in Section 20-3.4(B)(4)(a)
of the City's Land Development Code,is hereby granted.
Section 2.This approval is subject to and dependent upon
the restriction and limitation of the "Restaurant,Convenience"
use to 5821 Commerce Lane as indicated in submitted floor plan.
Section 3.The City Manager may revoke this approval upon a
determination that any other portion of the property,legally
described herein,is being utilized for restaurant purposes,
including storage,food preparation,deliveries or any services
related to restaurant uses,which are not authorized and licensed
bythe City of South Miami forthe subject property.
Section 4.The City Manager may revoke this approval upon a
determination that any other property is being utilized for
restaurant purposes,andsuchuseis related tothe subject
property,butsuchusehasnotbeenauthorizedandlicensedby
theCityofSouth Miami,including storage,foodpreparation,
deliveries or any other services related tothis restaurant use.
Section 5.The City Manager shall have final approval and
authority over all matters regarding the determination ofthe
applicant's compliancewiththe intent ofthese sections.
Section 6

BACKGROUND:
The applicant,Mr.Juan H.Toral of Toral Auto Care (existing tenant atthe subject property),is
requesting a special use permit inorderto operate a convenience-type restaurant onthe property
locatedat5821S.W.70Street.Theexistinguseforthislocationisan automotive repairshop.
Therestaurantisproposedasasmallcafeteria(noseating)whichwillserveready-to-consume
foodanddrink,suchasCubancoffee,hotandcoldsandwiches,sodasandpastries.Theservice
willbesolelyfor take-out.The proposed restaurant is150squarefeetinareaandwillnot
contain anytablesor chairs.The proposed floorplanis presented aspartofthis application.
Therestaurantwillbeopenforbothbreakfastand lunch.Thedefinitionofthe convenience
restaurant use,thespecialuse conditions forall uses,andthespecific conditions for "Restaurant,

service,whereordersaregenerallynottakenatthe customer's table,wherefoodisgenerally
served in disposable wrapping or containers,andwherefoodand beverages maybe served
directly tothe customer ina motor vehicle.This use may include delivery service withCity

ANALYSIS:
Staffbelievesthattherequestedspecialuse complies withtheoverallrequirementsstatedunder
Section20-5.8 of theLandDevelopmentCode[foundonpage 111],regardingtherequired
conditions for special use approval bythe City Commission.Specifically,staff finds thattheuse
meetstheconditionalrequirementssetforthinSection20-3.4andthattheuse:
a)Willnotadverselyaffectthehealthorsafetyofpersonsresidingorworkinginthevicinityofthe
proposed use[Section20-5.8(B)(1)(a)];
b)Willnotbe detrimental tothe public welfare or property or improvements inthe neighborhood

believesthatthe requested special use:
1)Willnot adversely affectthe health orsafetyofpersonsresidingorworkinginthe
vicinity of the proposed use;
2)Willnotbe detrimental tothepublicwelfareorpropertyor improvements inthe
neighborhood;and
3)ComplieswithallotherapplicableCodeprovisions.

The cafeteria will be solely for take out.The layout of the cafeteria will consist
of a refrigerator for sodas and prepackaged sandwiches,a cuban coffee machine,a

fortherecord.Mr.Toralstatedthathisproposalisforasmall,cafeteria-typeestablishmentin
whichfoodanddrink,suchassandwichesandCubancoffee,willbesoldsolelyfortakeout.
Mr.Toral explained thathewouldliketoprovidea "special oftheday"inadditiontoregular
menu items at the restaurant.
Staffnotedthataclarificationforthe record wasinorder.Staffexplainedthatthe proposal calls
foraconveniencerestaurantonlyandnotaconveniencestore.Stafffurtherexplainedthatfor
thisproperty,only ready-to-consume foodsaretobesold,asopposedtowheregoodsaretobe
marketed.
The Board andMr.Toral briefly discussed the size of the restaurant,which will be small and
likely incapable of accommodating athrong of customers.Mr.Toral responded thathedoesnot
anticipate a multitude of patrons,particularly atonetime,duetothe surrounding usesthatthe
facilitywillserve.In regard tothe Board's inquiries regarding cooking onthe premises,Mr.
Toral maintained thatsuch preparation of foodwillbe minimal and "limited".
Ms.Linda Tobin,a citizen of SouthMiami,signedinto speak before theBoard.MsTobin
askedtheCitytobe aware of theneedto consider economic concerns,in addition to zoning
determinations,in matters suchasthesewhereabusinessis attempting to diversify its offerings.
Ms.Tobin related that theCitymayneedtobeless "rigid"inits zoning decisions,particularly
asthey involve its businesses.
Public hearing was closed,andMr.Basucalledthequestion.
Motion:Mr.Oliveros moved approval of the application,as presented.Ms.Zeller seconded the
motion.
