ORDINANCE OF THE CITY OF SOUTH MIAMI,
FLORIDA, CREATING A BOARD OF ARCHITECTS;
ESTABLISHING QUALIFICATIONS, METHOD OF
APPOINTMENT, IN TERMS OF ITS MEMBERS;
PRESCRIBING ITS DUTIES; PRESCRIBING
TIME AND MANNER OF APPEAL FROM DECISIONS
THEREOF; FURTHER PROVIDING FOR SUBMISSION'
OF SITE PLAN SETTING FORTH ARCHITECTURAL
STYIE, AND COLOR OF BUILDINGS, AND PROVID-
ING FOR APPROVAL THEREOF BY BOARD OF
ARCHITECTS PRIOR TO ISSUANCE OF BUILDING
PERMIT; PROVIDING PENALTIES FOR VIOLATIONS;
AND ESTABLISHING EFFECTIVE DATE
WHEREAS, it has been determined by the Mayor and City
Council to be in the best interest of the citizens and residents of
the City of South Miami that the exterior of buildings and structures
constructed or substantially altered within the City shall be of
such design and color as to be compatible with existing and surround-
ing buildings in the neighborhood so as not to be aesthetically
offensive;
NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CM COUNCIL
OF THE CITY OF SOUTH MIAMI, FLORIDA;
Section L There is hereby created a Board of Architects
of the City of South Miami, Florida; and such Board shall have not
less than one nor more than five members at any one time, the number
of members constituting such Board to be as from time to time desig-
nated by Resolution of the City Council. The members shall be
appointed by the Mayor with the approval of the City Council.

Section 4. The Boatu shall meet at the City Hall whenever
requested upon Five days notice from the City Manager of matters re-
quiring their consideration, The Board shall keep a permanent record
of its proceedings -. Notices of meetings Of the Board ,shall be posted .
at the City Hall not less that 72 hours prior to any meeting_
Section 5. The Board shall elect one of its members as
Chairman who shall preside at all meetings. The Board may ele:t a
Vice- Chairman to preside at any meeting not attended by the Chairman.
A majority of the members of the Board shall constitute a quorum and
all actions of the Board shall require a majority vote of those present
and constituting a quorum. If the Board shall fail to act on any Site
plan shall be deemed to have been approved by the Board.
Section 6. The Board of Architects shall review all site
plans to determine that ,same comply with the Zoning Code and Ordinances
of the City of South Miami.
Section 7. All decisions of the Board shall be considered
final unless within 5 days therefrom an appeal shall be taken to the
Planning Board by the filing of a written Notice Of Appeal with the
City Clerk upon form prescribed therefor by the City Manager. Appeals
may be taken by the applicant,, interested citizens, and member' of
the administration.
Section 8.. All decisions of the Planning Board shall be con-
sidered final unless within 15 days therefrom an appeal shall be taken
to the City Council by the filing Of a written Notice of Appeal
with the City Clerk upon form prescribed therefor by the City Manager.

for any building, buildings or structures or for any material altera-
tions to the exterior of any existing building, buildings, or
structures, a site plan must be submitted for approval by the Board'
of Architects showing the dimensions, the lot lines, the building,
buildings, or structures, the location thereon on the lot, the type
of construction, and the architectural style and color of the pro-
posed improvements;.
Section 10, The Board of Architects shall review the site
plan and if they determine that the architectural style, color and
type of construction of the proposed improvements to be harmonious
with the premises and with other buildings in the same neighborhood
and otherwise comply with the Building and Zoning Code of the City,
the Board, of Architects shall approve the site plan and authorize
issuance of the Building Permit conditioned upon the proposed improve-
ments complying with all other applicable governmental regulations,.
No Building Permit for.new construction or for substantial alteration's
to the exterior of any building shall be issued without the written
approval of the Board of Architects signified on the plans by the
signature of the Chairman, Vice - Chairman or Acting Chairman of the
Board of Architects,.
Section 11 If any section, sentence, clause, phrase, or
word of this ordinance is for any reason held or declarers to be un-
tonstitutional, inoperative or void, such holding or invalidity
shall not affect the remaining portions of this ordinance; and it
shall be constrtied to have been the intent of the Council of the

Section 12_ That any pFrson, persons, firm, partnership,
or corporation violating any of the provisions hereof shall, upon
conviction, be punished by a fine not to exceed '$500.00 , or by
imprisonment not to exceed six months, or by both such fine and
imprisonment in the discretion of the 'Municipal Judge. Each day
a violation is permitted to exist shall constitute a separate
Offense.
Section 13. This ordinance shall take effect March 1, 1911
Section 14. It is intended that this Ordinance be permanent
in nature and shall be included in the Code of Ordinances, City of
South Miami, Florida.
