AN ORDINANCE AMENDING CODE OF ORDINANCES',
CITY OF SOUTH MIAMI, FLORIDA, BY ADDING
THERETO AS SECTION 9 -9 PROVISION LIMITING
EXPENDITURES BY CANDIDATES IN CITY ELEC-
TIONS; PRESCRIBING PENALTIES FOR 'VIOLATIONS
THEREOF; EXPRESSING INTENT THAT SAME BE
INCLUDED IN CITY CODE; AND ESTABLISHING
EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida enacted
Chapter 70 -65 requiring candidates in municipal elections to file
reports of contributions and expenditures; and
WHEREAS, the Legislature enacted Chapter 70 -267 limiting
amount of expenditures of certain candidates and limiting expendi-
tures of municipal candidates to TWENTY FIVE THOUSAND AND N01100
($25,000.00) DOLLARS, unless a lessor amount is prescribed by the
municipality; and
WHEREAS, expenditures of $25,000.00 by candidates for
municipal office in South Miami elections is excessive in view
of the population of the City :.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF SOUTH MIAMI, FLORIDA:
Section 1. That Chapter 9, Code of ordinances, City of
South Miami, Florida, be amended by adding thereto as Section 9 -9
the following:
"Sec, 9 -9. Limitations on expenditures of candidates
for Mayer and council.
(a) No candidate for election to the office of Mayor
or city councilmen in the City of South Miami, .Florida,
or any person, etimpaiign treasurer or deputy campaign .
treasurer, oo ittee or organitAtidn acting on behalf
with the knowiedsje of such candidate shall expend or
inter any obligation or o ndi`turo of funds on tehalf
of his ele do in emedas of the fol lw4ings
(b) The limitations on expenditure provided
" ;hersin ;.nnly rn mnrrigg; materials, supplies,
goods, office or other rental space, and any other
thing of value except personal services rendered
by individuals on a' voluntary basis without compen-
sation therefor, by any person on behalf of the
candidate.
(c) In the event that contributions are made to
candidates in excess of the amount permitted to
be expended, such excess shall be paid over to the
City within 60 days after the election in question
and shall be deposited to the general fund of the
city.
(d) Violation of this ordinance shall be ,grounds;
for expulsion as provided in Article II Section 15.B
of the South Miami Charter."
Section 2. That any person, person, firm, partnership or
corporation violating any of the provisions of this ordinance
shall, upon conviction, be punished by a fine not to exceed
$500.00, or by imprisonment not to exceed six months, or by both
such fine and imprisonment in the discretion of the Municipal Judge.
.Each day that a violation is permitted to exist shall constitute a
separate offense.
Section 3. This ordinance shall take effect April 1, 1971,
and shall apply to all City elections, general or special, held
thereafter.
Section 4. By nature of the content hereof this ordinance
shall be included in the Code of ordinances, City of South Miami,
Plorida.
