She stated that the signs are not pedestrian friendly nor do they reflect the intent of the Hometown District. Mr. Balli, Mr. Chandler, and Mr. Trautman agreed that the size, location, and overall proportions of the sign are not compatible with the existing conditions of the canopy. As an alternative the Board members suggested placing individual letters below the canopy. Motion: Mr. Trautman moved to defer the application to allow the applicant to come up with a different scheme for the signage. Mrs. Mark seconded the motion. Mr. Balli suggested some signage solutions to the applicant. Mrs. Mark suggested that the applicant present the Board with four or five different options including the electrical connections in order to decide on the signage. Vote: 8 Approved 0 Opposed 2) NEW CONSTRUCTION: FINAL:'[ ERPB-07-0071 Applicant: Mr. Luis Navarro Location: 6635 SW 76 Terrace Request: Applicant is requesting final approval for a new construction. Applicant Present: Mr. Esteban Lubiano Mrs. Cabrera read the item into the record. Action: Mr. Lubiano stated the proposed stucco siding would have to be supervised during construction in order to ensure craftsmanship. Mr. Fernandez expressed that craftsmanship might be costly. Staff recommended the four proposed (14 feet high) Tamarind trees be increased to a minimum of 18 feet in height, and the permit set of plans should reflect the height change. Mr. Lubiano agreed with staff's recommendation. Motion: Mr. Balli moved for final approval as presented. Mr. Chandler seconded the motion. Mrs. Mark stated that the driveway access was too wide therefore recommended the driveway be narrowed and that it include landscape areas at the front yard. The Board members agreed with Mrs. Mark. The Board members had no concerns with the relocation of the swimming pool in its final revision. Motion: Mr. Trautman moved for final approval of the pool's relocation and deferred the driveway in order to allow the applicant to integrate the landscaping scheme with the driveway. The driveway could have either, other one access driveway but no to exceed 16 feet in width or a two access driveway not to exceed a 12 feet width. Mr. Jude seconded the motion. Applicant Present: Mr. David Cabarrocas Mr. Lightfoot read the item into the record. Action: Mr. Cabarrocas explained that the revisions to the plan are as follows: 1. On the front (south) elevation, the columns have been changed from what was originally approved by the Board. 2. The shutters have been removed from both the right and left side elevation. Upon a site inspection conducted by staff, it was concluded that the shutters on the rear and front elevations have been installed. 3. The exterior walls were painted Benjamin Moore Navajo White, and the trim work was painted Benjamin Moore White 01. The Board approved Monroe Bisque HC-26 for the exterior walls and white for the trim. 4. The wall that faces SW 83 Street has been changed from what was originally approved. The Board required that the wall be coral rock veneer so that it matched the coral rock veneer used in the decorative columns. The decorative columns currently have Chicago brick caps. Mr. Cabarrocas stated that the shutters in the front and rear of the home will be installed. Mr. Lightfoot stated that the driveway will be narrowed due to an enlarged drain field located on SW 84 Street. Motion: Mr. Chandler moved for final approval as presented. Action: The applicant proposed painting the facades with Glidden #50YY (Natural White.) Mr. Jude suggested that the conduit running up the front elevation of the building should be painted to match with the color of the building. Mrs. Mark inquired about the removal of the temporary signs. She also stated that the window has some neon signage. Mrs. Cabrera-Hernandez recommended that the applicant should meet with staff. Mrs. Cabrera-Hernandez stated that neon and temporary signs need to be taken care of, otherwise it will become a Code Enforcement issue. Mrs. Cabrera-Hernandez recommended that the applicant should meet with staff regarding these signs. APPROVAL OF MINUTES: Minutes for regular meeting held on August 7, 2007. Action: Mr. Jude corrected a statement under item#4 in the Action section. Mr. Jude advised he had no recollection making that statement, he was informing the Board about the residents concerns during a City Commission meeting when this item was addressed. He advised it should be changed to read, "Mr. Jude informed the Board of the concerns that some residents had, concerning the flat roof design." REMARKS Mr. Balli inquired about the Land Development Code language regarding murals or applications applied to the wall. Mr. Balli stated that on the side of Miami Golf there are three huge advertisements. Mrs. Mark stated the advertisements need permits for murals, and she questioned if permits for the advertisements were approved. Mrs. Cabrera-Hernandez replied that no permits for Miami Golf's signage have been presented to her and that she would look into this issue because there is signage definition for murals. Mr. Fernandez questioned when the two-story ordinance will go before City Commission for first reading. Mr. Fernandez provided staff and the Board members with his observations regarding the e-mail that Mr. Perez circulated. 1) The addition of the new definition for front yard versus just front setback, which Mr. Trautman and Mr. Balli brought up in the meeting that we had with City Commission for 50% of the front yard setback. 2) The setback issues that Commissioner Beckman brought up, it was discussed but it was not agreed that it should be adopted in the draft and should be look at a bit closer and maybe there should be some input from the Board. ERPB Mins 8-21-2007 Pg 6 of 7 3) The possibility of giving credits for some reduced form of calculating certain areas such r as terraces and porches that way it promotes these items into the architecture at South Miami. Mr. Perez stated the comments were introduced to the Planning Board during the last Planning Board meeting and they asked the staff to incorporate these comments into the ordinance. The Planning Board did not recommend any revised language to what was already recommended by the ERPB. He added that the two-story ordinance will go before the City Commission for first reading on Tuesday, August 21, 2007. During second reading the Board's issues will be considered as part of the public hearing, which is where these discussions will be held. There was one two-story application that went before the City Commission for consideration. The Commission followed the landscaping requirements that are in the draft ordinance. Mr. Perez advised that the Green Task Force is an item in the agenda for the City Commission meeting and once approved a committee will be put together. Mrs. Mark questioned if round-a-bouts that are put in the City should be brought before the ERPB, considering that in the past the Board reviewed them for the planning and landscaping design. Several round-a-bouts previously constructed near 84 Street were not brought before the Board. She was concerned with the little landscaping that was provided on the round-a-bouts. Mr. Perez stated he will make the Assistant City Manager and the Director of the Public Works Department aware of the Board's concerns. Mrs. Mark stated that in the past, a charrette was proposed for the design of the landscaping including that specific street and she would like that to be followed closely. Mrs. Mark stated that on the window at the corner of Red Road and 73 Street there are large signage's designated for advertising an educational center. Mrs. Mark questioned how it will fit into the retail space. Mr. Perez responded that staff will look into this issue. VII. The proposed signage will be located on the southwestern and western elevations of the building facing Sunset Drive. The illuminated sign which is composed of plastic face channel letters will be mounted above both of the entrance doors. Ms. Mark said that the drive didn't need to be circular, and if it weren't it would help a lot with space. Ms. Mark also agreed that adding more landscaping would be great. Perez vPAk Planning Director From: Lourdes Cabrer -Hernandez Re: ERPB-07-007 Planner Applicant: Mr. Luis Navarro Location: 6635 SW 76 Terrace, South Miami Request: NEW CONSTRUCTION Review: Second Review STATUS REPORT: The Environmental Review and Preservation Board (ERPB) application was submitted to the Planning Department on January 18, 2007. The City Commission passed and adopted Ordinance No. 03-07-1904, on February 6, 2007, authorizing a study relating to the residential construction of two-story homes for a three month period, (a second story construction moratorium).'However, the proposed subject property, which is a two-story home (building) is vested. Please refer to the attached Ordinance No. 03-07-1904, which mandates that a single-family structure shall comply with the dimensional requirements contained in Section 20-3.5(E) of the Land Development Code. At the February 6, 2007, ERPB meeting the subject property received preliminary approval with staff's conditions. The attached ERPB minutes, dated February 6, 2007, outline those conditions. The ERPB application and report are included for reference. The Board was pleased with the building design of the two-story residence with a single access driveway on the west side of the sub1ect property. The Board's only concern was the proposed vinyl siding for the exterior wall finish. The Board questioned the architect if vinyl siding was the most suitable material in comparison to the other proposed exterior finishes. As a result, the architect and Board agreed that stucco siding would be the proposed material for the building's exterior wall finish. Mr. Chandler, ERPB member, motioned for preliminary approval with the following staff's conditions: 1. Meet the requirements set forth in the adopted stormwater ordinance. A copy attached of signed Stormwater Ordinance Number 06-07-1907. 2. Provide grading and irrigation plan prior to final ERPB. A signed and sealed irrigation plan, dated July 24, 2007, has been submitted for review and final approval; prepared by Jose Antonio Mendez, Professional Engineer, sheet SI-1. Additional documentation has been included for reference and consideration of the proposed new construction. These include copies of the Building Department's permit record search from the Land Master File Inquiry, Miami-Dade Property Appraiser Tax Records for subject and surrounding properties (totaling six properties), and photographs of surrounding properties (provided by applicant). Survey and Legal Description: See attached Sketch of Boundary Survey, signed and sealed by professional land surveyor Alberto R. Varas and dated June 6, 2006. Existing Conditions: The property as described in the sketch boundary survey is a one story residence with wooden decks and a detached structure (c.b.s. garage). This residence will be demolished and replaced with the proposed two story single-family residence. The property fronts SW 76 Terrace with a frontage of 107.59 feet in width which exceeds the 75 feet minimum frontage requirements set forth in the RS-3 Zoning District. Landscaping Plan: A tree removal permit has been submitted and approved with conditions. The landscape plan submitted to the City is consistent with the requirements set forth in Section 20-4.5, Land Development Code. The Plan includes a detailed description of the landscaping schedule (including tree names and pertinent information), information on the number of existing trees that will be protected; existing trees to be removed, and trees to be added as part of the proposed project; and landscaping data required by Section 20-4.5(D)(5)(b), Land Development Code. Pursuant to Section 204.5(D)(5)(b), Land Development Code the minimum number of trees required for RS-3 zoning district are three trees per lot. The landscape plan identifies a total of twenty-one trees (eighteen trees on private property and three trees on the swale area). The City's Public Works Department will determine whether the proposed off-site trees (swale area) will be allowed as recommended by the landscaping plan. The Public Works Department approval of street trees is guided by Section 20-4.5(D)(3), Land Development Code. Landscaping Plan Recommendation: On August 7, 2007, the City Commission approved a waiver of the second-story construction prohibition for a new residence located at 7631 SW 59 Avenue with the condition that if the existing trees that are to be relocated on the subject property do not survive, new trees shall be planted at a minimum of eighteen feet in height. The Planning Department has recommended that the architect revise the landscape plan by upgrading the proposed trees. The revision will be implemented on the building permit set of plans. Site Plan (Zoning District: "RS-3" Medium Lot Single-Family Residential District): The intent of this district is to provide for low—density residential development located in a moderately spacious setting which emphasizes the preservation of open space. The proposed site plan depicts a two story residence to be located on Track "A" of "Brewer Manor" subdivision. The proposed ground floor building side setbacks (west side 9'-5" and east side 24'-8") exceed the required cumulative widths for both side yards. Based on Sec 20-3.5E, Land Development Code the side setback shall not be less than 20% of the lot width. The proposed project cumulative width minimum interior side setback shall be not less than 20 percent (21'-6") of the total lot width (107.59 linear feet of lot frontage). The proposed second floor building side setbacks (west side 33'-0" and east side 24'-8") also exceeds the Land Development Code 15'-0" feet minimum requirement. The proposed building rear setback (34'-8") also exceeds the Land Development Code 25'-0" feet minimum requirement. This creates additional green space on the ground floor and a greater separation between the buildings on the adjacent property. The proposed building front setback is at 25-0", which complies with the Land Development Code front setback of 25'-0" minimum. In addition, Section 20- 4.5(D)(4), Land Development Code requires that all air conditioning units and swimming pool equipment be shaded by shrubs. The applicant has proposed a 4'-10" high low wall for screening the air conditioning. Furthermore, the applicant has proposed a new six (6) feet high wood fence and a wood gate with self-closer and latch, at both sides of the subject property. The height limit for a physical barrier at a residential zoning district is guided by Section 20-3.6(H)(2), Land Development Code. The building dimensional requirements are guided by Section 20-3.5E, Land Development Code. The proposed site plan indicates that the property's total area is 15,768 square feet which exceeds the minimum total area (10,000 square feet) required by the Land Development Code. The proposed building coverage (4,186 square feet or 26.5% of the maximum building coverage) does not exceed the maximum building coverage (4,730 square feet or 30%) allowed by the Land Development Code. The calculation in the site plan (zoning legend) for the second floor (2,124 square feet or 45% of the maximum building coverage allowed for the first floor) does not exceed the maximum allowable building coverage of 2,512 square feet at 60% of the first floor. The proposed impervious coverage includes the building, swimming pool and deck area, and driveway (proposed grass pavers). The calculation provided for impervious coverage (6,251 square feet or 39.6%) does not exceed the 40% maximum impervious coverage allowed (6,307 square feet or 40%) by the Land Development Code. Elevations: The building height dimensions, building finishes and materials are noted on the elevations. The front fagade illustrates the entry way roofed at the first floor level and the wide front porch with covered terrace above at a different plane than the remaining portion of the two story proposed building. This is clearly illustrated on the rendering, and barely noticeable on the south elevation, on sheet A-4. Revised Elevations: The building elevations have been revised as per the Board's comments from the ERPB preliminary approval on February 6, 2007. At such time, the proposed material was vinyl beaded siding for the exterior finish of the building. The Board members concluded that if wood siding would require too much maintenance, then the other alternative would be stucco. This revision required that the notes for the proposed elevations and sections be revised. The revised elevation are provided on sheet A-4 and A-5 and clouded to indicate the change, which reads "stucco siding typical where shown". The revised sections are provided on sheet A-9 and clouded to indicate the change, which reads "stucco siding". Site Plan Review Committee: On January 30, 2007 (Tuesday) the committee met to review the proposed site plan. In addition, to the site plan review there was a detailed discussion regarding the approved Stormwater Ordinance Number 06-07-1907, adopted by City Commission on February 6, 2007. The intent of the Ordinance is to "require all properties to retain stormwater drainage on site as to prevent development that would result in contributing to or causing recurrent ponding on adjoining properties or public right-of-way." RECOMMENDATION: Final Approval with the following conditions: 1. Meet the requirements set forth in the adopted Stormwater Ordinance; 2. NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH ML4,M1, FLORIDA; Section 1. No building permits shall be issued for the constructionof new, or for additions to existing single family residential structures, which construction shall result in the creation or addition of a second floor to the single family structure. Section 2. For a building permit to be issued for either a new, or for an addition/remodel to a single-family structure, the structure shall comply with the dimensional requirements contained in section 20-3.5 (E) of the South Miami Land Development Code. Section 3(A). The City Commission may waive the second story construction prohibition contained in this Interim Regulation if the proposed project, including site plan and specifications, is brought before the Environmental Review and Preservation Board (ERPB); the ERPB determines that the proposed structure complies with the applicable sections of the Land Development Code and the City Commission after public hearing determines that: Page 2 of 4 or No. 19-07-1920 (a) the interim regulation imposes undue hardship on the applicant; or (b) the development proposed by the applicant will not; (i) result in a material diminution of the privacy of adjoining residential properties; and, (ii) will not result in an obvious departure from the aesthetic character of the immediate vicinity taking into account existing structures and open space; and, (iii) the proposed structure will have no more than a de minimus impact on the use and enjoyment of the adjoining parcel; or (c) the applicant is proposing to mitigate the effect of the redevelopment by providing adequate safeguards which the Commission finds would adequately mitigate any detrimental impact to the neighborhood. Section 3 (B). The applicant for a waiver bears the burden of establishing sufficient evidence necessary to prove that the criteria contained in Section 3(A) have been satisfied. Section 3 (Q.An application for a waiver must be filed in conjunction with the ERPB application. The application for waiver shall be filed with the Planning Department on a form provided by the director and information: must include the following (a) the name and address of the applicant; (b) the address and legal description of the property; (c) evidence to support the criteria in Section 3(A); and (d) other information that the director may reasonably require to evaluate the waiver application. Section 3 (D). The director shall make a recommendation to the ERPB and City Commission on each application for waiver. Section 4. Section 20-6.1(C)(3)(f) is hereby amended, to temporarily expand the powers of the Environmental Review and Preservation Board (ERPB), to authorize the ERPB to review all single family residential additions/remodels or new construction, which propose the addition of the second floor. The property fronts SW 76th Terrace with a frontage of 107.59 feet in width which exceeds the 75 feet minimum frontage requirements set forth in the RS-3 Zoning District. Landscaping Plan: A tree removal permit has been submitted and approved with conditions. Refer to the attach tree removal application and landscape plan for additional information. The landscape plan submitted to the City is consistent with the requirements set forth in Section 20-4.5, Land Development Code. The Plan includes a detailed description of the landscaping schedule (including tree names and pertain information), information on the number of existing trees that will be protected; existing trees to be removed, and trees to be added as part of the proposed project; and landscaping data required by Section 204.5(D)(5)(b), Land Development Code. A grading and irrigation plan will be required from the applicant. Pursuant to Section 20-4.5(D)(5)(b), Land Development Code the minimum number or trees required for RS-3 zoning district are three trees per lot. The landscape plan identifies a total of twenty-one trees (eighteen trees on private property and three trees on the swale area). The City's Public Works Department will determine whether the proposed offsite trees (swale area) will be allowed as recommended by the,landscaping plan. The Public Works Department approval of street trees is guided by Section 20- 4.5(.)(3), Land Development Code. Site Plan (Zoning District: "RS-3" Medium Lot Single-Family Residential District): The intent of this district is to provide for low—density residential development located in a moderately spacious setting which emphasizes the preservation of open space. The proposed site plan depicts a two story residence to be located on Track "A" of "Brewer Manor" subdivision. The proposed building setbacks (west side 9'-3" and east side 24'- 8") exceed the required cumulative widths for both side yards. Based on Sec 20-3.5E, Land Development Code the side setback shall not be less than 20% of the lot width. The proposed building rear setback (34'-8") also exceeds the Land Development Code 25'- 0" feet minimum requirement. This creates additional green space on the ground floor and a greater separation between the buildings on the adjacent property. The building dimensional requirements are guided by Section 20-3.5E, Land Development Code. The proposed site plan indicates that the property's total area is 15,768 square feet which exceeds the minimum total area (10,000 square feet) required by the Land Development Code. The proposed building coverage (4,186 square feet or 26.5% of the maximum building coverage) does not exceed the maximum building coverage (4,730 square feet or 30%) allowed by the Land Development Code. The calculation in the site plan (zoning legend) for the second floor (2,124 square feet or 45% of the maximum building coverage allowed for the first floor) does not exceed the maximum allowable building coverage of 2,512 square feet at 60% of the first floor. The proposed impervious coverage includes the building, swimming pool and deck area, and driveway (grass block). The calculation provided for impervious coverage (6,251 square feet or 39.6%) does not exceed the 40% maximum impervious coverage allowed (6,307 square feet or 40%) by the Land Development Code. Elevations: The building height dimensions and building finishes and materials are noted on the elevations. The front fagade illustrates the entry way roofed at the first floor level and the wide front porch with covered terrace above at a different plane than the remaining portion of the two story proposed building. This is clearly illustrated on the rendering, and barely noticeable on the elevations. However, the recessed wall at a difference of twelve feet in plane is a positive solution to the way the two story homes are perceived. Site Plan Review Committee: On January 30, 2007 (Tuesday) the committee met to review the proposed site plan. In addition, to the site plan review there was a detailed discussion regarding the proposed stormwater ordinance under consideration by the City Commission (schedule for second reading at the February 6th 2007 meeting). The intent of the Ordinance is to "require all properties to retain stormwater drainage on site as to prevent development that would result in contributing to or causing recurrent ponding on adjoining properties or public right-of-way." RECOMMENDATION: Preliminary Approval with the following conditions: 1. Meet the requirements set forth in the adopted stormwater ordinance 2. Provide grading and irrigation plan prior to final ERPB. 3. Provide engineering plans prior to final ERPB. 4. Any comments and/or suggestions from the Board. Varas and dated June 6, 2006. Existing Conditions: The property as described in the sketch boundary survey in a one story residence with wooden decks and a detached structure (c.b.s. garage). This residence will be demolished and replaced with the proposed two story single-family residence. The property fronts SW 76th Terrace with a frontage of 107.59 feet in width which exceeds the 75 feet minimum frontage requirements set forth in the RS-3 Zoning District. Landscaping Plan: A tree removal permit has been submitted and approved with conditions. Refer to the attach tree removal application and landscape plan for additional information. The landscape plan submitted to the City is consistent with the requirements set forth in Section 20-4.5, Land Development Code. The Plan includes a detailed description of the landscaping schedule (including tree names and pertain information), information on the number of existing trees that will be protected; existing trees to be removed, and trees to be added as part of the proposed project; and landscaping data required by Section 20-4.5(D)(5)(b), Land Development Code. A grading and irrigation plan will be required from the applicant. Pursuant to Section 20-4.5(D)(5)(b), Land Development Code the minimum number or trees required for RS-3 zoning district are three trees per lot. The landscape plan identifies a total of twenty-one trees (eighteen trees on private property and three trees on the swale area). The City's Public Works Department will determine whether the proposed offsite trees (swale area) will be allowed as recommended by the landscaping plan. The Public Works Department approval of street trees is guided by Section 20 4.5(D)(3), Land Development Code. Site Plan (Zoning District: "RS-3" Medium Lot Single-Family Residential District): The intent of this district is to provide for low—density residential development located in a moderately spacious setting which emphasizes the preservation of open space. The proposed site plan depicts a two story residence to be located on Track "A" of "Brewer Manor" subdivision. The proposed building setbacks (west side 9'-3" and east side 24'- 8") exceed the required cumulative widths for both side yards. Based on Sec 20-3.5E, Land Development Code the side setback shall not be less than 20% of the lot width. The proposed building rear setback (34'-8") also exceeds the Land Development Code 25'- 0" feet minimum requirement. This creates additional green space on the ground floor and a greater separation between the buildings on the adjacent property. The building dimensional requirements are guided by Section 20-3.5E, Land Development Code. The proposed site plan indicates that the property's total area is 15,768 square feet which exceeds the minimum total area (10,000 square feet) required by the Land Development Code. The proposed building coverage (4,186 square feet or 26.5% of the maximum building coverage) does not exceed the maximum building coverage (4,730 square feet or 30%) allowed by the Land Development Code. The calculation in the site plan (zoning legend) for the second floor (2,124 square feet or 45% of the maximum building coverage allowed for the first floor) does not exceed the maximum allowable building coverage of 2,512 square feet at 60% of the first floor. The proposed impervious coverage includes the building, swimming pool and deck area, and driveway (grass block). The calculation provided for impervious coverage (6,251 square feet or 39.6%) does not exceed the 40% maximum impervious coverage allowed (6,307 square feet or 40%) by the Land Development Code. Elevations: The building height dimensions and building finishes and materials are noted on the elevations. The front fagade illustrates the entry way roofed at the first floor level and the wide front porch with covered terrace above at a different plane than the remaining portion of the two story proposed building. This is clearly illustrated on the rendering, and barely noticeable on the elevations. However, the recessed wall at a difference of twelve feet in plane is a positive solution to the way the two story homes are perceived. Site Plan Review Committee: On January 30, 2007 (Tuesday) the committee met to review the proposed site plan. In addition, to the site plan review there was a detailed discussion regarding the proposed stormwater ordinance under consideration by the City Commission (schedule for second reading at the February 6th 2007 meeting). The intent of the Ordinance is to "require all properties to retain stormwater drainage on site as to prevent development that would result in contributing to or causing recurrent ponding on adjoining properties or public right-of-way." RECOMMENDATION: Preliminary Approval with the following conditions: 1. Meet the requirements set forth in the adopted stormwater ordinance 2. Provide grading and irrigation plan prior to final ERPB. 3. Provide engineering plans prior to final ERPB. 4. Any comments and/or suggestions from the Board.
