ORDINANCE 903ORDINANCE NO. 23 -76 -903 .AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING SECTION 11 -10 OF CHAPTER 11 OF THE CITY CODE BY DELETING THE PROVISION FOR ANNUAL PAYMENT OF FEES, PROVIDING FOR SEMI - ANNUAL rAI.M.NT OF FEES ONLY, ELIMINATING ADDITIONAL CHARGES FOR PRO -RATED PAYMENTS, AND ELIMINATING THE PROVISION FOR DISCOUNTING PAYMENT OF FEES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1.. That Section 11 -10 of Chapter 11 of the City Code be, and the,same i:s hereby amended to read as follows:. "Sec. 11 -10. Billing,; payment; due dates. (a)` Billing for service: In all cases the bill for refuse service shall be the liability of and charged to and paid by the owner, tenant, user or occupant of the property for which the service is rendered. Several users on one premises may combine its refuse pick -up into one or more common containers supplied by the city and /or the owner of the premises. The fee for such combined users may be jointly charged to the users of such containers and /or the owner of the premises at the descretion of the city manager'. (b) Payment of fees: The fees prescribed in Section 11 -9 are payable in advance semi- annually on October first and April first at the semi- annual rate. Such fees shall become delinquent if not fully paid within thirty (30) days after due date. (c) Fractional billing: When services commence during a calendar month, no charge will be made . for periods of ten (10) clays or less in any one month, but eleven (11) days or more shall be interpreted to mean one month and shall be so charged. (d) Exemption from fees: There shall be no exemptions for the payment of fees, except that establishments employing' and using the services of a private refuse collector holding a. valid permit shall not be liable for the payment of waste fees as would otherwise be required hereunder so long as such employment and use continues. No vacancy allowances will be permitted." -I- Section 2. All Ordinances or parts of Ordinances in conflict herewith be;, and the same are hereby repealed. Section 3. This Ordinance shall take effect immediately upon its adoption. PASSED and ADOPTED this 17th day of August ,1976.
