ORDINANCE 952ORDINANCE NO. 35 -77 -952 AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING ARTICLE 'V OF SECTION 1 OF ORDINANCE NO. 20 -71 -724, HERETOFORE ADOPTED AS THE OFFICIAL ZONING ORDINANCE' OF THE CITY OF SOUTH MIAMI, FLORIDA, BY ADDING A NEW SECTION 5 -13R ENTITLED': "C -2 =R, DOWNTOWN COMMERCIAL DISTRICT, RESTRICTED ", CONTAINING PURPOSES, USES PERMITTED, SPECIAL USES PERMITTED, AND DISTRICT REGULATIONS FOR SAID NEW DISTRICT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH, AND PROVIDING WHEN THIS ORDINANCE SHALL TAKE EFFECT WHEREAS, the Planning Advisory Board of the City of South Miami has considered a proposed new District entitled: "C -2 -R, Downtown Commerical District, Restricted ", submitted by the City Council, and have made their recommendations thereon. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That Article V of Section l of Ordinance No,. 20 -71 -724, heretofore adopted as the Official Zoning Ordinance of the City of South Miami, Florida, be, and the same is hereby amended by adding immediately after Section 5 -13, the following new section, to- wit: 5 -13R C -2 -R DOWNTOWN COMMERCIAL DISTRICT RESTRICTED 5 -13 -1R Purpose The purpose of this district is to delineate a compact and centrally located area where commercial uses of a restricted retail and personal se vice nature are per- mitted along with professional and business office uses, to be developed in a pedestrian- orientdd manner. 5 -13 -2n JUses_ Pearmitted All Used permitted in the co and C -1 bi.stricts, Antique or curio shop 13ank beauty or barber shop book or stetionetyt gtor@ Broadcasting studio Business machine sales and service Ceramic and glassware store Clinic or laboratory; medical, dental or optical Clu :`,ing store (new only) Convalesent home Drug, pharmacy or sundry store Employment agency Film processing substation Florist Food store_ (convenience type only) Gift or card shop Hospital Hotel or motel Interior decorator Jewelry store Laundromat or dry cleaning substation Leather goods store Library Loan association or agency Luggage shop Messenger service Mimeograph and letter service Music, record or tape store Newstand Office, business or professional Office supplies Photo shop Shoe repair shop Shoe store Sporting goods Stock brokerage office Tobacco shop Travel agency Watch sales and service 5 -13 -3R Special Uses Permitted. .01 Eating establishment, such as a restaurant, cafeteria, delicatessen, confectionery or ice cream parlor; pro- vided that the use has only inside or pati, service and no walk -up or drive -in service. .02 Fraternal organization or private club; provided that it is on a site of no less than one (3,) acre, that no structure is less than fifty (50) feet from an adjacent more restrictive residential district, that there be adequate ingress and egress which will not create adverse traffic conditions, and that a public hearing be held by the council to determine the overall compatibility of the proposed use with the neighborhood. 03 Residential acc'omodatiobs; provided that they are only on the top floor of struetures of two (2) or store stories in height. „04 A planned unit daveloptdnt may be permitted on any Pareei wbich is two (2) or More gross acres its uige. 5 -13 -4R District Regulations .01 Minimum lot size shall be as follows: Area - 5,000 square feet Frontage - 50 feet .02 Minimum yard setbacks shall be as follows: Front - Ground floor only 10 feet Rear 1.5 feet Side None Side - corner, ground, floor only 10 feet (all other floors No setback) .03 No building shall exceed six (6) stories or sixty-five (65) feet in height, whichever is less, except where floors are used for off- street parking and service area purposes, in which case said floors maybe excluded from the height limitation. In no instance shall any structure exceed eight stories or eighty -five (85) feet in height, whichever is less.. .04 All proposed developments shall be accompanied by an overall site plan, as defined in Article XI, reflecting all significant aspects of the development,. Properties adjacent to the proposed development shall be taken into consideration and a reasonable portion of these areas shall also be reflected on the site plan.. Section 2 All Ordinances or parts of Ordinances in conflict herewith be, and the same are hereby repealed. Section 3. This ordinance shall take effect immediately at the t me of its passage.
