ORDINANCE 931ORDINANCE NO. 14 -77 -931 AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA, GRANTING A VARIANCE TO ,JOSEPH R. BAGNY AND MARTHA G. BAGBY WAIVING THE CONSTRUCTION OF A WALL ON THE REAR PROPERTY LINE IN RO ZONING (RESIDENTIAL OFFICE DISTRICT) AS TO CERTAIN DESCRIBED PROPERTY' LOCATED AT 7799 SOUTHWEST 62ND AVENUE, SOUTH 01IAMI, FLORIDA, SAID VARIANCE SUBJECT TO CERTAIN TERMS AND CONDITIONS,. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SOUTH MIAMI, FLORIDA;: Section 1. That Joseph R. Bagby and Martha G. Bagby be, and they are hereby granted a variance to waive the construction of a wall on the rear property line in RO Zoning (Residential Office District) on the property located at 7799 Southwest 62nd Avenue, South Miami, Florida, and more particularly described as S 1/2 of Lot 11 and Lot 12, Block 3, LARKIN PINES SUBDIVISION, according to the Plat thereof as recorded in Plat Book 24, Page 20, of the Public Records of Dade County, Florida. Section 2. This variance shall be effective only so long as Joseph R. Bagby and Martha G. Bagby, his wife, their heirs and assigns, plant, keep, maintain, trim and care for a permanent hedge of not less than five (5) feet in height on the rear property line of the aforedescribed property, specifications of said hedge to be approved by the Environmental Review Board of the City of South Miami, Florida. However; should the Building Official of the City of South Miami determine that the hedge is not properly planted, maintained, trimmed and cared for, he ahall recommend to the City Council: that this variance be rescinded and/or rdvdkod4 Section_ 3.._ The City Council, shall have the power to revoke the above granted variance by A6,4ol€ttion, at which tine J096ph R. gagby afid Martha 0. gagby, his wife, their heirs and assigns, shall, on or before 4S days* eange to he built oar the rear property lane of the above aies�ri�� �i�dg rty� a wall in accordance with the law then existing'. Upon failure to do so within the aforedescribed time, the Building Official is authorized to revoke the Certificate of Occupancy of the above described property, and Joseoh R. Bagby and Martha G. Bagby, his wife, their heirs and assigns, shall be deemed to be in violation of the Zoning Laws of the City of South Miami and subject to all penalties and fines permitted by law.
