M. by Chairman Smith. The Pledge of Allegiance to the Flag of the United States of America was followed by the roll call . PRESENT: Edward H. Coburn Jean H. Smith ABSENT : Dwight Price Mr. Carter McDowell , Director , Building, Zoning and Community Development Department , was also present . Chairman Smith introduced Jean H. Evoy , a new member of the Board , and , to clarify any questions of conflict of interest , read into the Minutes a memorandum to Jean Evoy , Dade County Planning Dept . from Robert A. Ginsburg, County Attorney, dated February 22 , 1980 , subject "Conflict of Interest Opinion - regarding outside employment" , as follows : "You have requested an opinion as to whether you may accept a position on the South Miami Planning Board . You are presently employed by Metropolitan Dade County as an Environmental Planner and you are the Project Director for the Biscayne Bay Planning Project . As a member of the City of South Miami Planning Board , you will be responsible for land use decisions in that municipality and will receive no salary for your work on that board. I answer your question in the affirmative . In this regard , you have no financial interest , direct or indirect , as a result of your position on the City of South Miami Planning Board which would create a conflict of interest as same is defined in the Metropolitan Dade County Conflict of Interest and Code of Ethics Ordinance . However , in an abundance of caution and to avoid any appearance of impropriety , I strongly recommend that you disclose your relationship with Metropolitan Dade County at meetings of this board and abstain from voting on any issues in which the County is involved in any way . Additionally , I would recommend that you avoid involvement in any issues during your County employment which involve the City of South Miami . Accordingly, no conflict of interest appears to arise because of your membership on the City of South Miami Planning Board and your employment as an Environmental Planner with Metropolitan Dade County . " PUBLIC HEARING #80-4 C. M. Hartz Request : Change of zoning from RS-3 (Single Family Residential) to RO (Residential Office) . Legal Description : East 75 ' of West 90' of Lot 1 , FAIRGLADE PARK SUBDIVISION, PB 45/80 . Location : 5735 S . W. 77 Terrace. Chairman Smith announced the public hearing was in session and asked if there was any one present wishing to speak for the request of the applicant . Mr. C. M. Hartz addressed the Board stating he was the applicant , that he has a contract to purchase the property and Power of Attorney from the owner to act on his behalf for the purpose of applying for the change of zoning. He stated that if the zoning is granted he desires to build a residential office on the property to be used as a law office. He presented plans , pictures of the property and a model of the proposed building to the Board. Mr. Ron Mateo of 10943 S . W. 70 Avenue, and Mr. Otero of 3111 Cardena Avenue, Architects , addressed the Board explaining the design of the building, landscaping and parking. Chairman Smith asked if there was any one else present wishing to speak in favor of granting the request of the applicant . There ,was no one . Chairman Smith asked if there was any one present wishing to speak against granting the request of the applicant . Mr. John Barkett of 5751 S . W. 77 Terrace , Mr. Ed Corley of 5764 S . W. 77 Terrace, Richard Barkett of 5751 S . W. 77 Terrace, Claudia M. Hauri of 5752 S . W. 77 Terrace, Mr. W. Gilchrest of 7610 S . W. 58 Avenue, and Mr. John R. Gustafson of 5740 S . W. 77 Terrace, spoke against granting the request of the applicant . There being no one else caring to speak for or against granting the request , Chairman Smith deemed the public hearing closed . In response to the request of Chairman Smith, Mr . McDowell read into the minutes staff recommendations for Public Hearing #80-4 , as follows : "Staff recommends denial . This rezoning request can not be viewed solely in terms of the lot in question. It must be reviewed in the context of the surrounding uses and the existing zoning. This lot happens to be on the boundary between RO and RS-,3 zoning. In the past , the City has established the east boundary of the property in question, as the western limit of RO uses . If this property is rezoned that boundary will be violated and a new boundary will have to be established . The lot in question has RO zoning to the east , and RS-3 zoning on the other three sides , with a special use permit to allow a parking lot on the north side. The lot due south, across S . W. 77th Terrace, from the one requesting the change , has an identical situation. Therefore , there Page 2 - 2/26/80 jk would be no grounds to refuse RO zoning on that lot , if this request is granted . Further, it is possible that granting this 'rezoning request could increase pressure for rezoning requests on all of the property due south of this parcel to S . W. 80th Street . Hence, if this property is rezoned we will have to consider rezoning other properties as well . It is also interesting to note that in 1971 the Green Company made a request for a special use permit to allow parking on the lot in question. The Planning Board voted 5-0 against that request , which was then with- drawn. Further, on October 26 , 1976 Cousins Associates applied for the same rezoning to RO as the current request . Both the Planning Board and the City Commission voted to deny that request on the grounds the surrounding area had not changed , and that therefore there was no justi- fication for the rezoning . Mr. McDowell then addressed the Board stating that the team from Dade County Office of Transportation Administration (OTA) and the Kaiser Transit Group (KTG) who prepared the Station Area Design and Development (SADD) Plan, were here to present the work that had been done to date . Bill Reemtsen, former Administrative Assistant , had been involved in each of the citizen meetings to represent the City' s interest . He also stated that there was a great deal of information to be presented, therefore the discussion of the SADD plan would be continued to other Planning Board meetings . He then introduced Les Green of OTA to begin the presentation. The presentation included a general discussion of all the work done at and for the SADD citizens meetings . Persons making the presentation included Carolyn Reed of OTA and Mike Lambert , Mark Gillis and Ramon Alverez of KTG. After the presentation the Chairman thanked the presenters and the citizens attending for their interest and declared the meeting adjourned at 10 : 15 P. M. It is not the intention of the applicant to have any use of the property which would entail equipment storage, construc- tion equipment or other large vehicles which would be noisy and distracting to the neighborhood on the property.
