The commissioners, with respect to property under their control may in their own discretion, and of their own motion, or upon the request of any agency of the state, or of the federal government, or upon petition of any person or persons, are hereby authorized and empowered to: a. St ROW Abandonment October 5,2016 Page 3 0/4 ANALYSIS: In addition to the provisions set forth in Florida Statutes 336.09 through 336.12, the City has also established a review process which includes a public hearing before the Planning Board and the submission of signatures from the adjacent and abutting residences. At this time, the applicant has submitted a petition bearing signatures of approval from three (3) of the four (4) adjacent and abutting properties. After conducting a field inspection, it was found that the subject site, which is located in the RS-3 zoning district, is unimproved and contains both public utilities and a Specimen Live Oak tree. A second Specimen live Oak tree is outside ofthe parameters of the applicant's request. On the south side of the ROW, the neighboring property (8201 SW 62 Avenue) installed a wooden fence that encroaches on the southern side of the ROW (please see photograph below). Subject Location Upon researching how the owner was allowed to construct a fence in the ROW, an inter-office memorandum dated August 12, 1994 between William F. Hampton, City Manager and Dean L. Mimms, Director of Building, Zoning and Community Development was found. In the memorandum, Mr. Mimms explains that the owner of 8201 SW 62 Avenue would be permitted to construct a fence twenty-five (25) feet forward of its location, i.e., to the center line of theoretical SW 82 Street. However, should the ROW one day be needed for public purposes, the provisions listed in the warranty deed for the subject property would be implemented. The fence. would have to be JKT e:\Users\mmenende\AppData\local\Microsoft\Windows\Temporary Internet Files\Content.Outlook\TZ48RIT2\PB-16-005 -8151 SW 62 Avenue ROW Abandonment -Staff Report 100516 (3).docx SW 8~ St ROW Abandonment October 5,2016 Page 4 0/4 removed and relocated at the sole expense of the property owner, so as to not extend into the ROW. Upon announcement to the public of the application, the City has received input from residents in the area both supporting and opposing the request (please see attached correspondence). The City Public Works Department has reviewed the request and notes that there are public utilities running through the ROW including a water main, and additional utility improvements are planned for the ROW. If the City Commission agrees to abandon the ROW, it should be conditioned on the property owner(s) dedicating a fifteen (15) foot easement to accommodate the utilities. Further, there is an existing fire hydrant located in the ROW. If the ROW is vacated, it should also be conditioned on the property owner(s) relocating the hydrant, at their expense, to a site selected by the City Manager or his designee. PLANNING BOARD RECOMMENDATION: The Planning Board reviewed the application at a Public Hearing on August 9, 2016. A motion to recommend approval with conditions regarding the dedication of an easement and the relocation of the fire hydrant resulted in a tie vote; a majority vote of the members present is required to pass a matter. RECOMMENDATION: o Staff recommends that the City Commission approve the request for abandonment of ROW, subject ('.~_) to the following conditions: (1) the property owner(s) that are adjacent to the subject property shall_ execute a covenant running with the land, the form of which must be approved in writing by the City Attorney, and which shalt (a) dedicate an easement, the location of which shalt be approved in writing by the City's Public Works Department, of fifteen (15) feet to accommodate public utilities, their maintenance and/or repair and any future improvements and (b) agree to preserve the specimen Live Oak tree and to not damage, abuse or remove it unless it is determined by the City to be a danger to the community; and (2) the property owner(s) shall relocate the fire hydrant, at their expense, to a site selected by the City Manager or his designee. The covenant running with the land shall provide that any violation of the covenant concerning the tree shall cause the ownership of that portion of the property that is abandoned and on which the trunk of the tree is rooted to instantly and automatically be conveyed or to revert to the City and the responsible owner(s) to . incur any appropriate fines. Miami, Florida, and revert the right- of-way back to the property owner. at 8151 SW 62nd Avenue, from which t:l1e right-of. way was originally dedicated. Enclosed please find an executed "Petition to Oose Road" which. Mrs. Morel and her neighbors are submitting pursuant to Chapter 336, Florida Statutes. I further ~ose a check payable to the City of South MiariU in the total amount of $3,000.00, and a copy a boundary survey prepared by Magdiel Frometa with Exacta Land Surveyors, Inc., January 7, 2016. [.have also included the subdivision plat for "Palm Miami Heights", PIat Book 43, Page 37, which depicts the original dedication of the right-of-way and the reversionary clause. . The vacation of the right-of-way is parti~lyimportant becallse of recent burglaries both to the Morel home and the home to the jrnmediate south, b~th abutting this right-of-way. In both instances, the burglars used this area as a staging and escape area for the burglaries. The Morels do not intend to construct any structures on this right-of-way, but simply want to provide a fence and secure landscaping so that additional crime does not occur as a result . Thank you for your assistance in this matter. If you have any questions please do not hesitate to contact me. Very truly yours, ;~~ ~iae: J.~rero SOUTHEAST FINANCIAl.. Mimms, AICP ,oN:'.' Bldg., :.",in~ & COIlOn: /it:.l£d;t, t, !tlililG:2 Date: ,August 12, 1994 Re: 8201 SW' 62 Avenue Dev,' This is to inform you, of the status of the fence whi,ch was recently installed pursuant to building permit no. 8474 (attached) at the subject property, which belongs to Ms; Joan Wagner. ,The is~ue Is the placement of the fence relative to the SW 82 Street public right of way. subsequent to ERPB approval on November 2, 1993, subsequent to permit issuance to Ms. Wagner's contractor Kendall south Fence Co. and subsequent to installation of the fence, Ms. Wagner recently expressed her concern to the city that her fence was not permitted to' be installed at the center linie of theoretical SW 82 Street, while the adjoining property to the east, 8202 SW 61 Avenue, has a fenee at the center line of theoretical SW 82 street. Ms. Wagner's' fence was installed; in accordance with the building permit, 25 feet from the center line of theoretical SW 82 street. After having examined our Land Development code qnd comprehensive I?lan, and after having di'scl.1ssed ,this matter with sta'ff, I have concluded that should the subject property owner wish to apply for a building permit to construct the fence 25 feet forward of its current location, i.e., at the center line of theoretical SW 82 street, SUch a relocation would be allowed by our land development regulations and could be approved. Th~ will be no charge to this applicant for this building permit. ISince the 25-foot right-of- way for theoretical SW 82 street has never been dedicated, the ,subject property owner can construct a fence at this location (center line of theoretical SW 82 street). ' ,. ." C) Ms. Joan Wagner 8201, SW 62 Avenue Page 2 Should the riqht-of-way one day be needed for public purposes, then tlle provisions of the attached warranty deed' for the sUbject property would, be implemented. The fence would 'th.en hkve to be removed a~d relocated at the sole expense of the property owper, so as not to extend into the public right-of-way,_ I will call Ms. Wagner and comm~nicate, these conclusions to her. We represent Emmanuel and Helene Morel, with regard to their request to close a portion of right-of-way at SW 82nd Street in South Miami, Florida, and revert the right-of-way back to the property owner at 8151 SW 62nd Avenue, from which the right-of-way was originally dedicated. This small portion of right-of- way has not been used a street for some time and has been effectively closed for years. The va.cation of the right~of-'way is particularly important because of recent burglaries both to the Morel home and the home to the immediate south, both abutting this right-of-way. In both instances, the burglars used this area as a staging and escape area for the burglaries. The Morels do not intend to construct any structures on this right~of~way, but simply want to provide a fence and secure landscaping so that additional crime does not occur as a result. Thank you for your assistance in this matter. If you have any questions please do not hesitate to contact me. Very truly yours, ."' . .-" . ./~-... >J~'<." ........ -.... :-................ . Mr. Alexander: I'm wriJing to advise you of my opposilion to the Petition to Close a Portion of Right-at-Way at SW 82nd street by Emmanuel and Helene Morel (please see attoched). In conversation with my neighbors, who use this right-ot-way 10 wall< the neighborhood or wolk their dogs through the neighborhood, they & I agree thot this is not in the best interest of our community & city. Instead ot taking this right"of~way froin the residents of the City of South Miami for the stated reason of crime issues, I suggest thot the Morel's increase lighting in (his sec lion of their yard. Again, let me be clear, I am opposed to this taking of ~'out right-or-way! Thank you & should you wont or need to discuss further, please feel free to centael me directly via my phone 305- 666-04711 . Respectfully, Peler T. These tools can help pre- vent crime, help solve crimes and help you know what is going on in your immediate area: NEW MIAMI-DADE POLICE CELLPHONE APP Many crime watchers are using the new COP (Com- munity on Patrol) app, a great tool for reporting everything from crimes to suspicious incidents. Just go to Apple 01' Android app store and search for Com- munity on Patrol. MIAMI-DADE COUNTY SEXUAL OFFENDER & PREDATOR SEARCH Any Florida resident who has been convicted of a sexual offense (including anyone convicted in another state) must register as a sexual offender with the office of the local sheriff. In the case of Miami-Dade County, that is the Miami- Dade Police Department. Sexual offenders must dis- close where they live, and must notify the police when they relocate. This infonna- Miami-Dade Police's new Community on Patrol cell phone app. tion is entered into the Sexual Predator/Offender database of the Florida Department Law Enforce- ment. Members of the pub- lic can search this database at http://giswe b.miami dade.gov /sexoffenders/ and determine whether they or their children, in their rou- tine activities (walking from the bus stop, biking to a friend's honse, or going to the maUl are likely to en- counter these offenders. MIAMI-DADE COUNTY'S CRIME VIEW COMMUNITY Miami-Dade County's Crime View Community is an online tool at http://www.crime mapping.com/map/f1/ miami-dadecotmty, which residents can use to keep themselves infonned about crime in the areas of interest to them, such as near their home, business or other places they frequent. Users can sign up to re- ceive automated email alerts about recent criminal events in specific areas. While this online tool works in all areas of unincorporat- ed Miami-Dade, it doesn't work in some of the munici- palities. Residents should check with their local gov- ernment to see if a similar service is offered by that municipality. HOMICIDE BUREAU - COLD CASE SQUAD Advances in technology and forensics have given a boost to the work of Miami- Dade Police's Cold CMe Squad. However, despite scientific advances and the work of these detectives, there are about 2,000 cold cases that remain unsolved. Maybe you know something that can help solve one of these crimes. To learn about: these cases, go online to http://www.miami dade.gov /police/cold- cases. asp. Perhaps you can help bring justice to the families of these victims.
