WHEREAS, the zoning on 5620 and 5700 sW 67 th Avenue is presently zoned Oy Miami-Dade County Estate Zoning 15,000 Square Foot minimum; and WHEREAS, the owner of5700 SW 67 th Avenue, Ms Fran Bohnsack, indicated to Vice Mayor Welsh on Sunday, October 30, 2016 that CVS Pharmacy offered to purchase her property and had entered into a one-year purchase option with the owner of5620 SW 67 th Avenue so they could build a CVS Pharmacy to compete with the Walgreens Pharmacy on the NW comer of Miller Road and Ludlum Trail; and WHEREAS, both lots are heavily covered with trees; and WHEREAS, traffic generated by the construction of a CVS Pharmacy would negatively impact traffic on SW 67 A venue both on the Miami-Dade County side and on the City of South Miami side; and WHEREAS, the night lighting of a commercial property at this location would negatively affect the quality of life for residents across SW 67 Avenue on the City of South Miami side; and WHEREAS, there is very little offered for sale to the public by CVS Pharmacy that Walgreens does not presently offer; and WHEREAS, the City of South Miami has witnessed the demolition ofa beautiful (all buildings were faced in keystone) strip mall on Bird Rd south of the Red Bird Shopping Center by CVS Pharmacy only for the apparent sole purpose of building a CVS Pharmacy in close proximity to a Walgreens to comply with CVS Pharmacy's apparent business model. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The Commission of the City of South Miami request the Miami-Dade County Board of County Commissioners not change the zoning of 5620 and 5700 SW 67th Avenue from Estate 15,000 square feet minimum to commercial use. Section 2. The City Clerk is hereby directed to transmit this resolution to all members of Miami-Dade County Board of County Commission. Section 3. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 4. Effective Date. This resolution shall become effective immediately upon adoption by vote of the City Commission. PASSED AND ADOPTED this __ day of _____ ,' 2016.
