RESOLUTION NO.
A Resolution acknowledging Commissioner Liebman's (Group Seat II) re-
appointment of Bradley Cassel, as the representative of Group Seat II, to
serve on the Pension Board for the South Miami Pension Plan for a two-year
term ending October 31,2018.
WHEREAS, Article II, Section 8, Sub-section A of the City Charter provides that:
* * * When a Board or Committee is comprised of five members, each City
Commissioner shall appoint one person to serve as a representative on the
Board or Committee. When there are more than five (5) members on a
Board or Committee, each City Commissioner shall appoint one person to
serve as a representative on the Board or Committee, and all members of
such Board or Committee in excess of five (5) shall be appointed by three
(3) affirmative votes of the City Commission based on recommendations
submitted by any City Commissioner. When a Board or Committee has less
than five (5) members, then the selection of all members shall be by three (3)
affirmative votes of the City Commission from recommendations submitted
by any City Commissioner. (Amended 2-09-10)
22 WHEREAS, the Mayor and Commission recognize the important contributions made by
23 those who serve on the various city boards and committees, and wish to have a full complement
24 to each of the active boards and committees; and
25
26 WHEREAS, commencing with appointments made after January 1, 2009, Sec. 2-22
27 "Term Limits" of the Code of Ordinances provides that, appointees are limited to two (2)
28 consecutive two-year terms of membership on a specific commission, board, or committee.
29 After serving a maximum of two (2) consecutive year terms, an appointee shall not be
30 reappointed to the same commission, board or committee unless at least one year has elapsed
31 between the term limited position and the effective date of commencement of the proposed
32 appointment for a new term; and

34 WHEREAS, Commissioner Liebman now desires to re-appoint Bradley Cassel to serve
35 on the Pension Board for the South Miami Pension Plan, as the representative of Group Seat II.
36 Therefore, Mr. Cassel's appointment shall expire October 31, 2018, or upon his removal or until
37 a successor is duly appointed and qualified; and

39 WHEREAS, Mr. Cassel has served on the Pension Board for the South Miami
40 Pension Plan since September 3, 2012; and
41
42 WHEREAS, pursuant to Sec. 2-22 "Term Limits" of the Code of Ordinances, this will be
43 considered to be Mr. Cassel's third two-year term for the purposes of Term Limits; and
44
45 WHEREAS, the City Commission desires to waive term limits as to Bradley Cassel so
46 that he may serve for another two-year term on the Pension Board.

48 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY

COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:

3 Section 1. The conditions required to waive term limits are hereby found to exist and
4 the term limits for Bradley Cassel are hereby waived pursuant to Ordinance No. 06-14-2184. The
5 City Commission hereby acknowledges Commissioner Liebman's right to appoint Bradley
6 Cassel to the Pension Board for the South Miami Pension Plan as the representative of Group
7 Seat II pursuant to the terms of the City Charter.

9 Section 2. The expiration date of this appointment shall be October 31, 2018
10 unless removed earlier, or until a successor is duly appointed and qualified.

12 Section 3. Effective Date. This resolution shall become effective immediately upon
13 adoption by vote of the City Commission.
